FEBRUARY 3, 2003
CITY OF KITCHENER
A special meeting of City Council was held at 3:50 p.m. this date, Chaired by Mayor C. Zehr with all
members present.
Notice of this special meeting had been previously given to all members of Council by the City Clerk
pursuant to Chapter 25 (Council Procedure) of the Municipal Code.
Council was in receipt of Corporate Services Department report CRPS-03-022 (L. MacDonald), dated
January 30, 2003, recommending the authorization of an agreement between the City and
Woodbridge Foam Corporation to permit access to Shirley Avenue road allowances for the purposes
of installing a monitoring well.
Moved by Councillor J. Smola
Seconded by Councillor G. Lorentz
"That the Mayor and Clerk be authorized to execute an agreement between the City and
Woodbridge Foam Corporation, the tenant of 68 Shirley Avenue, to permit access to the
Shirley Avenue road allowance for the purpose of installing a monitoring well and conducting
ongoing monitoring of the well, said agreement to expire February 1,2006."
Carried.
Council was in receipt of Strategic Services Department report SSD-03-002 (K. Smith), dated January
30, 2003, recommending authorization to execute an Amending Agreement between the City and the
Ministry of Consumer and Business Services regarding the operation of the Business Enterprise
Centre.
Moved by Councillor M. Galloway
Seconded by Councillor B. Vrbanovic
"That the Mayor and Clerk be authorized to sign an Amending Agreement, satisfactory to the
City Solicitor, with the Ministry of Consumer and Business Services which will amend an
existing Agreement dated October 22, 2001, regarding management services and the
respective roles of the parties relating to the Waterloo Region Government Information Centre
located at The Corporation of the City of Kitchener's City Hall, as set out in report SSD-03-002,
dated January 30, 2003."
Carried.
Council was advised of an additional item for in-camera discussion this date involving a matter
subject to solicitor-client privilege.
Moved by Councillor B. Vrbanovic
Seconded by Councillor C. Weylie
"That an in-camera meeting of City Council be held immediately following this special meeting
to consider a labour relations matter, three litigation or potential litigation matters which are
also subject to solicitor-client privilege and a matter subject to solicitor-client privilege."
Carried.
Moved by Councillor G. Lorentz
Seconded by Councillor J. Smola
"That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and
proceedings of the Council and that the same be taken as read a first, second and third times, be
finally passed and numbered 2003-21 by the Clerk."
Carried.
