Gosse, Director of Legislated Services/City Clerk Prepared By: Patricia Harris, Manager of Licensing Ward(s) Involved: 3 Date of Report: February 24, 2009 Report No.: CRPS-09-022 Subject: REQUEST FOR REDUCED FEE -OPPORTUNITIES WATERLOO REGION -2631 KINGSWAY DRIVE-MAY 2, 2009 RECOMMENDATION: That Opportunities Waterloo Region be approved to hold a temporary retail market at the Unity Centre for Practical Christianity, 2631 Kingsway Drive on May 2, 2009 from 10 a.m. to 3 p.m. provided the necessary licence, including Health and Fire approvals is obtained; and That the licence fee for the temporary retail market licence be reduced to $42.80. BACKGROUND: Chapter 541 Itinerant-Temporary Vendor Markets} of the Municipal Code states in Section 549.1.5 that a Temporary Retail Market Licence is required for a show with 5 or more vendors selling their own goods or services. The licence fee is $428.00. Chapter 501 Business Licence Fees} states in Section 501.2.5 that where an application is made for a licence by a recognized, registered bona fide charitable organization, the fee to be paid shall be 10% of the fee that would otherwise be payable. Incases of doubt as to the application of this section, the Manager of Licensing shall refer the application to Council for a decision. In regards to this request, the "charitable" provision does not apply, as each vendor will keep the proceeds from any sales they make. REPORT: Attached is a letter from Candace Wormsbecker, Community Garden Capacity Builder, Opportunities Waterloo Region requesting Council to reduce the required licence fee of $428.00 to the nominal fee of $42.80. The Community Garden Council of Region of Waterloo anon-profit organization, in conjunction with Opportunities Waterloo Region is organizing the first annual "Community Garden Fest". The focus of the event is to promote Urban Agriculture which includes community gardens, backyard gardens and rooftop gardens. This event will involve vendors selling seeds, gardening books, CD's and food. Each vendor will sell their goods retaining all monies from the sales made.
