RECOMMENDATION:
That Council pass a by-law pursuant to Section 31(1 } of the Land Titles Act, R.S.O.1990,
c. L.S, to authorize an application for absolute title for part of Glasgow Street described
as Part 1 on draft Reference Plan prepared by Metz & Lorentz Ltd, dated April 15, 2008
(File No. W1-59-16} being Part of P.I.N. 22698-0990 and PIN 22184-0454;
That an easement in favour of the Regional Municipality of Waterloo, registered as
instrument number WR213082, which expired on December 31, 2008, be deleted from title
to Part of Glasgow Street described as Parts 1 and 2 on Reference Plan 58R-15861 being
PIN 22184-0454;
That the Mayor and Clerk be authorized to execute all documentation required to
complete an application for absolute title and to delete the easement registered as
WR213082 from title, to be prepared and registered by the solicitors for Ira Needles
Commercial Centre Joint Venture (being Brigadoon Holdings Inc., VDL (2005) Limited
and Geoffrey L. Moore Realty Inc.), all to the satisfaction of the City Solicitor.
BACKGROUND:
Council has considered matters relating to the realignment of Glasgow Street west of Ira
Needles Boulevard in connection with the proposed development of the abutting lands owned
by Ira Needles Commercial Centre Joint Venture (INCCJV) (being Brigadoon Holdings Inc., VDL
(2005) Limited and Geoffrey L. Moore Realty Inc.) in Council Reports Numbered DTS-07-081
and CRPS-08-167. The realignment of Glasgow Street is proposed through a draft plan of
subdivision submitted by INCCJV a copy of which is attached. A parcel of land described as
Part Lot 39, GCT, former Geographic Township of Waterloo, now City of Kitchener being Part 1
on Reference Plan 58R-16315 was purchased by the City from Ontario Realty Corporation to
accommodate alternative realignments of Glasgow Street including the one proposed in the
draft plan of subdivision currently under review. Planning staff anticipate reporting to
Development and Technical Services Committee on the draft plan of subdivision on March 30,
2009 and on the related zoning by-law and official plan amendments in or about June, 2009.
REPORT:
The precise location of the realignment of Glasgow Street will be determined through the draft
plan of subdivision approval process. It is anticipated that once that is done the lands for the
newly aligned Glasgow Street will be conveyed to the City in exchange for the lands of that part
of the current alignment of Glasgow Street as illustrated on the attached draft reference plan
prepared by Metz & Lorentz, dated April 15, 2008 (File No. W1-59-16).
In order to facilitate a transfer of these lands it is necessary to complete an application for
absolute title under the Land Titles Act which will confirm the City as owner free of certain
qualifications affecting title as a result of the administrative conversion of the title to the land
titles system. The conversion to absolute title is necessary before a plan of subdivision can be
registered.
A search of title to Glasgow Street has revealed that a temporary easement granted to the
Regional Municipality of Waterloo (registered as instrument WR213082) for access in
connection with the construction of Ira Needles Boulevard, expired on December 31, 2008. It is
in order to delete this easement from title which can be done as part of the application for
absolute title process.
FINANCIAL IMPLICATIONS:
The solicitors for INCCJV will prepare all of the necessary documentation and arrange for the
required reference plan, to the satisfaction of the City Solicitor, and attend to the required
registrations, all at the cost of INCCJV. As this process will be initiated in advance of Council's
consideration of the draft plan of subdivision, and therefore the determination of a realignment
of Glasgow Street, all costs associated with this application are at the sole risk of INCCJV.
COMMUNICATIONS:
Planning and Transportation Planning staff have reviewed this report and concur with its
recommendations.
CONCLUSION:
In anticipation of the final determination of the proposed realignment of Glasgow Street west of
Ira Needles Boulevard through a draft plan of subdivision approval process, an application for
absolute title for that part of Glasgow Street that is to be realigned to facilitate its ultimate
transfer in exchange for the new alignment may proceed at this time. The temporary easement
in favour of the Region has expired and it is in order to delete it from title.
