Lorentz, commencing at 3:45 p.m. with the following members present: Mayor C. Zehr and Councillors C. Weylie, M. Galloway, B. Vrbanovic, J. Smola and J. Gazzola. Officials Present: Ms. S. Adams, Ms. K. Kugler, Ms. P. Houston, M. B. Snyder, Ms. L. Bulgin, Ms. D. Gilchrist and Messrs. J. Fielding, R. Pritchard, F. Pizzuto, G. Sosnoski, R. Gosse, S. Turner, J. Witmer, G. Melanson, R. Weber, K. Baulk and M. Mitchell. 1. CSD-03-028- NOTICE OF TERMINATION OF PROMOTION AGREEMENT RE KMAC CONCERTS - NEXT PRESENTATIONS CANADA LTD. The Committee was in receipt of Community Services Department report CSD-03-028 dated February 3, 2003, recommending that the City's agreement with Next Presentations Canada Ltd. pertaining to concert exclusivity for events at the Kitchener Memorial Auditorium be terminated. It was resolved: "That the notice of termination received from Next Presentations Canada Ltd. dated January 27, 2003 be accepted, regarding the Promotion Agreement dated October 1, 2001 pertaining to concert exclusivity for events at the Kitchener Memorial Auditorium Complex; subject to the ongoing obligations contained in the agreement following termination." CRPS-03-028 - NOISE BY-LAW EXEMPTION - 44 FAIRFIELD AVENUE The Committee was in receipt of Corporate Services Department report CRPS-03-028 dated February 17, 2003, recommending an exemption from Municipal Code Chapter 450 (Noise) for a property at 44 Fairfield Avenue. It was resolved: "That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Patrick Cairney for a company party for the Tiuni Group at 44 Fairfield Avenue, between the hours of 4:00 p.m. and 6:30 p.m. on June 7, 2003, with a scheduled rain date of June 14, 2003." CRPS-03-024 - RIGHT OF ACCESS - BLOCK 90, REGISTERED PLAN 1495 (ANVIL STREET) - SESTAN ELECTRIC CONSTRUCTION LIMITED The Committee was in receipt of Corporate Services Department report CRPS-03-024 dated February 5, 2003, recommending right of access over City lands to a land-locked parcel of land owned by Sestan Electric Construction Limited. It was resolved: "That a right of access over City owned land known as Block 90, Registered Plan 1495, (off Anvil Street) be granted to Sestan Electric Construction Limited (or any successors thereto), to permit continued pedestrian and vehicle access to Sestan's remaining land forming part of Part 1 on Plan 58R-8062, which is located west of the City's expropriated land being Part 4 on Plan 58R-13325; and, That subject to the satisfaction of the City Solicitor, the Mayor and Clerk be authorized to execute any necessary documents to give effect to such right of access; and further, That such right of access continue until Block 90 is opened as a road or Sestan Electric Construction Limited, by agreement or order of the Ontario Municipal Board, takes possession of all or part of Block 90, and subject to the satisfaction of the City Solicitor, the Mayor and Clerk are hereby authorized to execute any necessary documents to give effect to the latter." COMMUNITY SERVICES COMMITTEE MINUTES FEBRUARY 17~ 2003 - 11 - CITY OF KITCHENER 4. CSD-03-029 - AGREEMENT WITH ANDREW MCKAY - REMOTE CONTROLLED SAILBOAT RENTALS - VICTORIA PARK LAKE The Committee was in receipt of Community Services Department report CSD-03-029 dated February 6, 2003, recommending an agreement with Andrew McKay which will allow him to rent remote control sailboats for use on Victoria Park Lake. The Committee raised concerns with the proposed 5 year term for the agreement, and was advised by staff that Mr. McKay requires assurance as to the length of the agreement before investing in these sailboats. Mr. Melanson assured the Committee that the conditions in the agreement will be clear and the agreement will contain the usual escape clause. On motion by Councillor J. Gazzola - it was resolved: "That approval in principle be given to an agreement with Andrew McKay regarding remote control sailboat rentals on Victoria Park Lake, as set out in Community Services Department report CSD-03-025; with the agreement to be presented at a future Community Services Committee meeting for final approval." CSD-03-025 -COMMEMORATIVE INSTALLATION AT MEMORIAL COMPLEX - RECOGNITION OF KITCHENER-WATERLOO'S KRAUT LINE AUDITORIUM The Committee was in receipt of Community Services Department report CSD-03-025 dated January 28, 2003 concerning installation of a wall mounted granite feature at the Kitchener Memorial Auditorium to commemorate the 'Kraut Line', rated by Sports Illustrated as the 5th best ever line of the National Hockey League. Mr. M. Fried was in attendance on behalf of the citizen / staff committee proposing the commemoration. He briefly reviewed the importance of the 'Kraut Line' to the N.H.L., and the work done by the citizen / staff committee. He advised of the committee's support for the recommendation contained in the staff report. Examples of the type of granite commemorative, produced by Superior Monuments, were displayed. Mr. Fried assured the Committee that all funds will be in place prior to production and installation of this commemorative. Several members of the Committee questioned the "Sponsorship admin, fee" as noted in the project budget, and staff and were directed to determine if this fee can be reduced. On motion by Councillor J. Smola - it was resolved: "That approval be granted, in principle, to install a wall mounted granite commemorative of Kitchener-Waterloo's famous 'Kraut Line' at the Kitchener Memorial Auditorium Complex, as outlined in Community Services Department report CSD-03-025; and further, That a general provision grant in the amount of $10,000. be approved, in principle, in support of the project; with final approval being contingent on the balance of the project funds being raised prior to commencing the project." CSD-03-031 - LEASE AGREEMENT WITH THE OPTIMIST CLUB OF FOREST HEIGHTS - LANDS AT REAR OF FOREST HEIGHTS COMMUNITY CENTRE - 1700 QUEENS BLVD The Committee was in receipt of Community Services Department report CSD-03-031 dated February 7, 2003, respecting a lease by the Optimist Club of Forest Heights and potentially the Forest Heights Community Association, for use and placement of playground equipment at the Forest Heights Community Centre. Mr. Melanson advised that some of the funding is coming form the Trillium Foundation, and they require the proposed lease before providing the funds. He further advised that if it is determined that the lease is not required, he will inform Council. COMMUNITY SERVICES COMMITTEE MINUTES FEBRUARY 17~ 2003 -12 - CITY OF KITCHENER CSD-03-031 - LEASE AGREEMENT WITH THE OPTIMIST CLUB OF FOREST HEIGHTS - LANDS AT REAR OF FOREST HEIGHTS COMMUNITY CENTRE - 1700 QUEENS BLVD (CONT'D) On motion by Councillor B. Vrbanovic - it was resolved: "That subject to the satisfaction of the City Solicitor, the Mayor and Clerk be authorized to execute a 5 year lease and any other necessary documents with the Optimist Club of Forest Heights; and if required the Forest Heights Community Association, regarding a portion of land located at the rear of the Forest Heights Community Centre at 1700 Queen's Blvd. for use and placement of playground equipment, as generally set out in Community Services Department report CSD-03-031; and further, That such authority be subject to the Optimist Club of Forest Heights raising or receiving the funding for, and purchase of, the playground equipment." CSD-03-030 - UPDATE AND DEMONSTATION RE: AUTOMATED PROGRAM REGISTRATIONS The Committee was in receipt of Community Services Department report CSD-03-030 dated February 7, 2003, providing background and current information on the City's new automated program registration, which allows Community Services patrons to register for programs via the web and / or touch-tone phone. Staff proved a demonstration of program registration on the web. CRPS-03-026 - PUBLIC NOTICE POLICY - MUNICIPAL ACT, 2001 The Committee was in receipt of Corporate Services Department report CRPS-03-026 dated February 17, 2003, recommending a new Council Policy with respect to Public Notices under the new Municipal Act. The report also recommends the development of policy respecting public notices outside the Municipal Act. On motion by Mayor C. Zehr - it was resolved: "That the policy appended to Corporate Services Department report CRPS-03-026 relative to public notification required but not prescribed under the Municipal Act, 2001 as amended, be adopted as Council Policy; and further, That staff be directed to investigate and report on development of a further policy or policy amendment regarding public notices outside of those required in the Municipal Act, including such notice as may be advisable to promote open and accessible government." UNFINISHED BUSINESS LIST The Committee directed staff to update the issues listed on the Committee's Unfinished Business List. 10.
