BACKGROUND: Staff presented a draft of the 2009-2010 and Post 2010 Kitchener Growth Management Plan (KGMP) at the Development and Technical Services (DTS) Committee meeting of February 9t" 2009. The final version of the KGMP was deferred until March 30t", 2009 to allow for additional stakeholder input through meetings and written comments. This report provides a summary of the comments received to date, a response to those comments, an overview of revisions, and additional information that provides clarification. The KGMP attached to this report is now ready for consideration. The KGMP partially implements one of the action items of Kitchener's Growth Management Strategy (KGMS) that was approved by Council on January 26, 2009. More specifically, Goal 6: Action 1 directs the City to establish an ongoing growth management program that entails preparing an annual monitoring report and biannual growth management plans that evolve Kitchener's staging of development process. The February 9t" presentation included a detailed explanation of the evolved staging of development process that assigns one of four levels of priority to each greenfield growth area and the major intensification areas in Kitchener. Key improvements of the new approach that were noted in the presentation include: • The new process addresses intensification opportunities in addition to greenfield development areas as required by Places to Grow; • The KGMP identifies and coordinates all major initiatives that are required to prepare land for development; 7-1 • The timing of the process is changed so as to better inform the Capital Budget and the Development Charges process; and • The prioritization is based on an evaluation of criteria that relate to the Goals of the KGMS and the evaluation is provided in the KGMP. REPORT: Following the February 9t", 2009 DTS Committee meeting, staff undertook additional consultation. Several landowners and consultants provided additional information and feedback through meetings and written responses. This input contributes to the final recommended version of the Growth Management Plan. Staff also obtained further input from internal staff and some external agencies. In accordance with the March 2nd DTS Committee recommendation, staff provided an update on the Kitchener Growth Management Strategy and the implementing Growth Management Plan to the City's Environmental Committee (March 19, 2009) and Economic Development Advisory Committee (March 25, 12009). The Environmental Committee expressed support for the KGMS implementation program and passed a resolution to endorse the KGMP. Staff also presented an update to the Waterloo Regional Homebuilders Liaison Committee on March 20, 2009. Input from the Liaison Committee contributed to the information provided in this report and the final recommended version of the Growth Management Plan. Feedback from the Economic Development Advisory Committee is not incorporated into this report given the date of the meeting relative to the timing of the report. Planning staff also met with the Engineering Division to further refine the timing of upcoming infrastructure projects and to coordinate the timing of the KGMP with the next Development Charges Background Study. Also data items were refined and new subdivision summaries were developed. A request for additional comments was sent out to the City's landowner/consultant contact group. A staff response to the general and parcel-specific comments received to date is outlined below. General Comments In response to several comments, the Growth Management Plan mapping was revised to include numerous amendments, additions and refinements that include the following: • The location of the Countryside Line and asterisk was revised to correspond with the adopted Regional Growth Management Strategy (RGMS) with a notation that it is subject possible changes through the Regional Official Plan review process; • A second city-wide map is now included in the KGMP that shows the individual parcels within the greenfield growth areas; • An additional notation is included on the city-wide maps regarding the ranking scheme and the relation to the Growth Area Subplans for each area; • Intensification Areas ranked as high priority are now indicated in purple so as to differentiate them from greenfield priority areas that are indicated in green; • Glasgow Heights is no longer referred to as a greenfield community given that the last unbuilt parcel is within an Intensification Area; • Major engineering projects that are funded through Development Charges are now identified on the second city-wide map; and • Several editorial suggestions regarding specific parcels were incorporated throughout. 7-2 The KGMP report was also revised in response to comments. Clarification is provided that lands must be located inside Built Boundary Line in order to be considered as `infill' parcels. The explanation of the Relative Priority Ranking system was revised to specify that lands indicated as Priority C may be considered for potential development approvals provided that all necessary initiatives and technical matters are completed and approved, and provided that all works on active applications on Priority A and B lands are completed. In response to requests, staff have prepared summary charts that list of all the recommended subdivisions and the number of dwelling units by type. These charts are attached to this report as Appendices A and B. Typically this information would be provided in the Annual Monitoring Report which, in the future, will be prepared at the same time as the updated KGMP. More specifically, Appendix A provides an updated chart of the average number of new dwelling units by type (single detached, townhouse, multiples, etc) through building permits. The 10-year average is 1533 new dwelling units (including 1213 street-fronting dwellings -single detached, semis, townhouses) and the median of the highest and lowest of the 5- to 25-year averages is 1438 new dwelling units (including 1160 street-fronting dwellings). Appendix B provides a listing of each plan of subdivision that is draft approved and in circulation along with future plans, with dwelling units by type indicated for lands that are recommended as Priority A and B (highest) for approvals in the coming 15 months. The total number of dwelling units for these greenfield areas that staff are currently working on includes a maximum of approximately 9500 units (including 6200+ street-fronting dwellings). This housing unit summary does not include Priority C or D greenfield lands which are listed in Appendix B along with the number of registered dwelling units that are available for building permits. The projects that staff are prioritizing for 2009-10 are also listed, which includes the necessary works to move some of the Priority C and D lands forward for the next KGMP. Response to Specific Parcel Comments As is common with staging of development consultations, most land owners are requesting advancement in the timing of their lands. Staff have reviewed each request and analyzed the information provided relative to Kitchener's Growth Management goals and the criteria outlined in the KGMP. Based on this analysis several requests cannot be supported. The Growth Area Subplans make it clear what major studies and initiatives need to be completed before proceeding to development approvals. In almost all cases, staff is recommending to proceed with the necessary studies and initiatives so that the requested lands maybe considered for a higher priority in the next Growth Management Plan. The written comments received for specific parcels are attached to this report as Appendix D and brief responses are outlined below. Bridgeport North -Parcel #83 (Activa) The applicant's submission supports the recommended Priority A timing. The main outstanding items relate to clarification from the Region regarding the approach to traffic issues and the current development cap. Grand River North -Parcel #75/110 (Gies) The applicant's submission supports the recommended PriorityA timing. Grand River South -Parcel #70 (Vallevview) The applicant has requested confirmation of details about this parcel at 1290 Zeller Drive and requested that the lands be considered for Priority A instead of Priority B. As identified by the applicant, a revised plan of subdivision is being prepared. Additional time and resources will be 7-3 required to review the revised subdivision application once submitted. Given that the Grand River South Community is identified as a Priority B and that staff would be actively working on both Priority A and B lands for potential approvals, staff therefore recommends that Priority B is appropriate. Staff confirms that the lands are now properly shown on the maps, and that comments regarding neighbourhood planning east of Zeller Drive do not apply to this parcel. Hidden Valley - Parcel G and #57(Pearl Valley) The applicant provided comments with respect to the future consideration of potential `developable' lands within the community. Staff have reviewed and updated some of the information within the subarea analysis. Given the uncertainty regarding the River Road Environmental Assessment project and that future land use and servicing studies area required, staff therefore recommends that Priority D is appropriate. Based on the outcome of initiatives in the coming timeframe, this relative priority will be reviewed in the next KGMP. Huron -Parcel #28 (Activa~ The applicant's submission supports the recommended Priority A timing. As intended by the KGMP, the additional initiatives that are required before registration of additional stages in the subdivision are prioritized for completion in the immediate timeframe. Huron South -Parcel #29 (Becker Estatesl The applicant's submission requests Priority A instead of Priority B timing. Given that the Huron South area is identified as a Priority B, that services are to be coordinated with other lands and that staff would be actively working on both Priority A and B lands for potential approvals, staff therefore recommends that Priority B is appropriate. Doon South Parcels #90 and 106 (Activa) The applicant provided comments with respect to a parcel of land in the Doon South Community (Phases I and II) that is subject to two plans of subdivision. Based on the area specific analysis and the overall criteria, the Doon South Phase I lands result in a recommended Priority B ranking and the Phase II lands as Priority C. As requested, staff are collectively recognizing lands in this area as being plans that were referred to the OMB and that the decision may impact the timing. Staff note that several environmental assessments and new infrastructure is required for development in this area and the initial construction and operating costs have not been determined at this time. The provision of community facilities is to be determined. Laurentian West Phase 3A Parcel #104 (Activa~ The applicant's submission supports the recommended PriorityA timing. Laurentian West Phase 38 Parcel #117 (Activa~ The applicant has requested that the lands be considered for Priority B timing instead of the recommended Priority C. These lands are within the remaining portion of the Laurentian West Community and are subject to a Municipal Plan Amendment proposing an urban land use designation. The Subwatershed Study required for this area is now complete. Currently, some of the comments received on the planning applications indicate that consideration of draft approval is premature at this time. One of the main issues is that the sanitary sewer capacity requires confirmation from Engineering Services. Eventually, an environmental assessment for sewage facility requirements may be needed and this should be completed prior to, or concurrently with potential draft approval. The cost of any new sewage facility or upgrades is not yet determined. The Waterloo Catholic District School Board requires completion of the an accommodation review and then analysis of school accommodation for the subject lands (a site may be required). Public School accommodation is also to be determined (potentially bussing). 4 7-4 Additional considerations to be addressed through the review and approval of the Neighbourhood Concept Plan include heritage impacts, transit and connectivity. These lands are within a sensitive source water protection area. It is also noted that these lands were not identified in the previous Staging Report. Considering the above, the area specific analysis, the overall criteria and the reasonable timing/resources required to complete the outstanding issues, staff recommended that a Priority C is appropriate. Staff do recommend to proceed with determining the school accommodation issues, the sanitary capacity analysis, the Neighbourhood Concept Plan and other possible initiatives and that the overall land use be considered in the new Official Plan. These lands could be a candidate for higher priority in the near future. Southwest Kitchener The comments received for the following parcels of land all request consideration as Priority B (or higher priority) instead of the recommended Priority C timing: Huron -Fischer Hallman Rd Parcel E (Activa) Trussler Southeast Parcel #118 (Tru-villa Trussler Northeast Parcel #120 (Cook) Trussler Northeast Parcel #121 (Schlegel) These parcels are subject to many of the same considerations and collectively represent one of the largest remaining greenfield areas in Kitchener. From a municipal perspective there are several important initiatives that should be completed and approved prior to development, and these items are indentified in the Growth Management Plan. When considering the potential timing of lands, the extent of the required initiatives are not fully known until reviewed by Departments and Agencies and until a more comprehensive approach is considered such as the KGMP. What is clear is that we should learn from past experiences in other areas of the city to ensure that the southwest part of Kitchener is more connected, transit-supportive, environmentally responsible and supportive of achieving complete communities. This area may be needed to achieve our Provincially-mandated target for greenfield density. Each parcel is viable to develop. However, staff want to ensure that each parcel is not considered in isolation and that that there is a comprehensive plan in place to guide the transportation, land use, streetscape design and development of this area. Matters such as school availability, transportation network studies, and environmental assessments for roads require resolution before decisions are made on detailed planning approvals. Because these parcels will be forming new communities, new development in this area will also prompt the need for the municipality to construct and maintain new community and recreation facilities and a comprehensive plan and costing estimate still needs to be done. Given the number of other plans currently within Priority A and B, the number of initiatives throughout the entire city that are prioritized for the next timeframe and the transportation and community/neighbourhood/detailed level planning issues that remain to be resolved, it is not expected that draft approvals could be reached in the next 15 months. Notably, Kitchener currently has the required land supply and considering this area represents one of the largest remaining greenfield areas within our City Urban Area, we should ensure that it is properly planned and managed wisely. Therefore, all lands are recommended as Priority C, with certain initiatives as Priority A and 8 so that consideration could be made to increasing the Relative Priority level in the next KGMP. 5 7-5 Opfion 1 The preferred option is to proceed with the initiatives as outlined in the draft KGMP and the February 9t" DTS Committee presentation. That option provides a realistic and reasonable timeframe that, notwithstanding the land supply, could help proceed to complete initiatives so that in the near future these new lands could be prepared for potential approvals and construction. The draft KGMP is at or beyond maximum internal and external resource levels. Opfion 2 Since the original draft of the KGMP staff has further considered the comments received and the timing of remaining initiatives for the southwest lands. Transportation related initiatives are a critical factor in this area. The number and type of initiatives and development applications that the City's Transportation Planning section is currently and expected to be involved in is significant. If an additional project management resource was allocated to handle the upcoming transportation studieslmaster plans and other growth-related projects it may be possible to proceed with initiatives in southwest Kitchener in a more timely manner than originally proposed. If this occurred, a potential timeline of initiatives is attached for consideration as Appendix C. Although we may have our required 3-and 10- year housing supply, given the upcoming review of employment, commercial and mixed use lands within the city, and given that we will have to plan for the 20-year supply in the Official Plan, it makes sense to consider potential land use designations for lands in southwest Kitchener within the next two years as part of the Official Plan review. In most cases development applications have been received and are under review for several parcels of land in the KGMP. The file manager will be responsible for providing updated comments on each application pending completion of the KGMP. FINANCIAL IMPLICATIONS: This growth management plan identifies the recommended timing of development and improves the coordination of land use planning with infrastructure projects and budgeting. The timing and amount of development approvals and construction in a given year will have financial implications for the municipality. The intent is to refine the growth management planning process over time to reflect the expected impact and costs of infrastructure and community facilities along with an identification of potential development charge revenueslimpacts and maintenanceloperating budget implications for each growth area. This would form a strategic plan to be considered in September of every second year and would assist in capital budgetlforecast planning for growth related studies, infrastructure and community facility items. The recommended timing of development program generally reflects the current Capital Budget and Forecast for engineering and community infrastructure. There are significant impacts in the immediate term (1-6 years) for projects/infrastructure that are already identified that would service growth. There are perhaps more infrastructure projects under consideration now then in recent years. The proposed timing reflected in the Growth Management Plan provides an approach that attempts to strategically manage these projects and coordinate them with the timing of development. If any changes are suggested this could have significant financial implications for the municipality. Some parcels of land are subject to ongoing development applications which may have legal/financial implications. 6 7-6 GaI~I~IUN~C~4TI~NS: There is no formal public notice requirement. This growth management plan is an implementation action item from the KGMS which included two phases of community engagementlcommunication. Staff engaged in as many additional meetings and communication with affected Departments, Agencies and other stakeholders as possible. Should issues regarding specific growth areas or initiatives be debated, it may be necessary to obtain mare input from affected agencies €such as the School Boards, Region, etc.}. C~NCLUSI4N: Staff are recommending a comprehensive plan for the future growth of the city. The plan is intended to consider, at least at a high level, all development matters that contribute to completing communities, Resources and time are required in order to complete engineering studieslreviews, design and construct new infrastructure, parks, schools and community centres. The Kitchener Growth Management Plan provides a strategic basis for coordinating infrastructure both engineering and community facilities with land use planning and approvals. Major remaining initiatives are provided for each growth area and aver time the KGMP will be further linked tv the Capital BudgetlForecastond Development Charges process. The City is currently at a paint in time where growth pressures continue in all areas of the city and where we are about to construct a significant amount o infrastructure within a short period o time. This new infrastructure in the next several years could potentially service the remaining greenfield lands in the city. The current economic considerations are not only about job creation but also about fiscal responsibility for the municipality to strategically invest in this new infrastructure. In that regard, .staff could take a more cautious and strict approach to growth management. However, given the current scenario, the maximum approach is provided. Any amendments to the recommended timing will have consequences to the ability to complete initiatives in many areas, financial impacts and more pressure for new facilities. In the end, vue need to ensure that we are considering both intensification abjectiyes and wisely managing the limited greenfield lands that we have left to deliver complete communities. The recommended 24a9-~ g and Post 241 o Kitchener Growth Management Plan provides a balance of all interests and coordination of initiatives and development from a municipal perspective. This tool continues to evolve our more than 40 year tradition of staging of development. The KGMP can help stimulate growth and help manage the proper and orderly growth of the city in a fiscally responsible manner, ~..4 ~, .~.
