CRPS-09-039 -ENVIRONMENTAL COMMITTEE WORK PLAN 1200912010) The Committee considered Corporate Services Department report CRPS-09-039, dated April 2, 2009, seeking this Committee's approval of the Environmental Committee's work plan for 2009- 2010. On motion by Councillor J. Smola - it was resolved: "That the Environmental Committee Work Plan (2009/2010), attached to Corporate Services Department report CRPS-09-039, be approved." 2. DTS-09-056 - ON-STREET PARKING -DUKE STREET WEST The Committee considered Development and Technical Services Department report DTS-09- 056, dated March 26, 2009, recommending changes to the location of on-street parking for portions of Duke Street West. On motion by Councillor J. Smola - it was resolved: "That the existing one (1) hour parking time limit on the south side of Duke Street West from a point 76 metres west of Louisa Street to a point 13 metres west thereof, and the existing "No parking anytime" area on the south side of Duke Street West from Louisa Street to a point 76 metres west thereof be deleted from the Uniform Traffic By-law; and further, That the Uniform Traffic By-law be amended to read "No parking anytime" on the south side of Duke Street West from Louisa Street to Shanley Street." 3. DTS-09-05$ - DEMOLITION CONTROL APLLICATION DC 09I03IMIGS - 110 MADISON AVENUE SOUTH - CRISTINA & IOAN NICOLI The Committee considered Development and Technical Services Department report DTS-09- 058, dated April 8, 2009 recommending approval of a Demolition Control Application for the property municipally known as 110 Madison Avenue South, subject to conditions. Ms. D. Ross presented the report noting that the subject property is in the Cedar Hill area and future development on this property will depend on the Ontario Municipal Board decision on the Cedar Hills zoning by-law. DTS-09-05$ - DEMOLITION CONTROL APLLICATION DC 09I03IMIGS - 110 MADISON AVENUE SOUTH - CRISTINA & IOAN NICOLI tCONT'D) "That Demolition Control Application DC09/03/M/GS requesting permission to demolish one (1) single detached dwelling located at 110 Madison Avenue South, owned by Cristina and loan Nicoli, legally described as PLAN 395 LOT 11, be approved subject to the following condition: 1) That the owner obtains a building permit for the proposed single detached dwelling; and, That upon satisfaction of condition 1, the Chief Building Official may authorize and issue a demolition permit under Section 33(6) of the Planning Act subject to the following condition: In the event that construction of the new dwelling is not substantially complete within 2- years of the date of issuance of the demolition permit, the City Clerk may enter on the collector's roll, to be collected in like manner as municipal taxes, $20,000 for each dwelling unit contained in the residential properties in respect of which the demolition permit is issued and such sum shall, until the payment thereof, be a lien or charge upon the land in respect of which the permit to demolish the residential property is issued." 4. DTS-09-059 - DEMOLITION CONTROL APPLICATION DC 09I04IWIGS - 272 WOOLWICH STREET -JEFF & PETER KNIPFEL The Committee considered Development and Technical Services Department report DTS-09- 059, dated April 8, 2009, recommending conditional approval of a Demolition Control Application for 272 Woolwich Street. Mr. A. Pinnell presented the report. On motion by Councillor B. Vrbanovic - it was resolved: "That Demolition Control Application DC09/04/W/GS requesting permission to demolish one (1) single detached dwelling located at 272 Woolwich Street, owned by Jeffrey and Sonya Knipfel, legally described as Tract German Company Pt Lot 66 RP 58R451 Part 1, be approved subject to the following condition: 1) That the owner obtains a building permit for the proposed single detached dwelling; and, That upon satisfaction of condition 1, the Chief Building Official may authorize and issue a demolition permit under Section 33(6) of the Planning Act subject to the following condition: In the event that construction of the new dwelling is not substantially complete within 2- years of the date of issuance of the demolition permit, the City Clerk may enter on the collector's roll, to be collected in like manner as municipal taxes, $20,000 for each dwelling unit contained in the residential properties in respect of which the demolition permit is issued and such sum shall, until the payment thereof, be a lien or charge upon the land in respect of which the permit to demolish the residential property is issued." DTS-09-062 - PLACES TO GROW -MINISTER'S EXEMPTION FROM OFFICIAL PLAN REQUIREMENTS The Committee considered Development and Technical Services Department report DTS-09- 062, dated April 8, 2009, recommending that the City request an exemption from the provincial requirement to bring the Official Plan into conformity with the Provincial Growth Plan by June 16, 2009. In this report staff explain that the local municipalities are awaiting the final approval of the Regional Municipality of Waterloo Official Plan, which is expected on June 16, 2009. DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES APRIL 20, 2009 - 54 - CITY OF KITCHENER 5. DTS-09-062 - PLACES TO GROW -MINISTER'S EXEMPTION FROM OFFICIAL PLAN REQUIREMENTS tCONT'D) Mr. A. Pinard reviewed the report. A discussion took place concerning the wording "within two year of the date of the approval of the Regional Official Plan" and two years from the completion of the Regional Official Plan. Mr. Pinard stated that he thinks it will take two years from the date of approval. Although the Kitchener Growth Management Plan goes a long way towards preparing the necessary Official Plan changes, Mr. Pinard advised that staff want to take a look at the Kitchener Growth Management Plan wholistically. Further, staff has spoken with the Ministry and have been advised that municipalities can take the route of requesting this exemption. On motion by Mayor C. Zehr - it was resolved: "WHEREAS the Province's Places to Grow Act, 2005 requires municipalities within the Greater Golden Horseshoe Growth Plan Area to amend their Official Plans to conform with the Provincial Growth Plan by June 16, 2009; and, WHEREAS area municipalities in the Regional Municipality of Waterloo are dependent upon completion of the Regional Municipality of Waterloo Official Plan in order to complete area municipal official plans and conform with the Places to Grow Act, 2005; and, WHEREAS the Region of Waterloo is in the midst of reviewing its Official Plan to, among other things, bring the Regional Official Plan into conformity with the Places to Grow Act, 2005; and, WHEREAS the Region contemplates adoption of the new Regional Official Plan by June 16, 2009; and, WHEREAS the Draft Regional Municipality of Waterloo Official Plan contains provisions requiring area municipal official plans to be brought into conformity with the approved Regional Municipality of Waterloo Official Plan within two years of the date of approval of the Regional Official Plan; NOW THEREFORE BE IT RESOLVED that the Council of the Corporation of the City of Kitchener hereby advises the Ministry of Energy and Infrastructure that the City of Kitchener cannot achieve the conformity requirements of the Places to Grow Act, 2005 by June 16, 2009 and hereby requests that the Minister extend the period for Official Plan conformity for area municipalities in the Regional Municipality of Waterloo to within two years of the approval of the Region of Waterloo Official Plan; AND FURTHER that the Mayor be authorized to forward the letter attached as Appendix "A" to Development and Technical Services Department report DTS-09-062 to the Minister of Energy and Infrastructure." 6. DTS-09-06$ - KITCHENER GROWTH MANAGEMENT PLAN UPDATE The Committee considered Development and Technical Services Department report DTS-09- 068, dated April 9, 2009, recommending that this Committee's consideration of the 2009-2010 and post 2010 Kitchener Growth Management Plan be deferred and referred to this Committee's scheduled meeting of May 11, 2009, to allow staff sufficient time to review all the proposals submitted on March 30, 2009 and to meet with some of the stakeholders. Mr. Pinard presented the report, noting that another possibility is to hold a special meeting on May 25, 2009 with a special Council meeting to follow the same day. Mayor Zehr asked that it be noted that at the meeting of March 30, 2009, neither he or the Committee directed staff to favour anyone of the proponents that presented their position at that meeting. DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES APRIL 20, 2009 - 55 - CITY OF KITCHENER 6. DTS-09-06$ - KITCHENER GROWTH MANAGEMENT PLAN UPDATE tCONT'D) On motion by Mayor C. Zehr - it was resolved: "That final consideration of the 2009-2010 and Post 2010 Kitchener Growth Management Plan, as attached to Development and Technical Services Department report DTS-09- 048, be deferred and referred to a special Development and Technical Services Committee meeting to be held on May 25, 2009; with any recommendation made by the Committee on this matter to be considered at a Special Council meeting to be held on May 25, 2009." 7, HWY $ AND HWY 401 INTERCHANGE IMPROVEMENTS Mr. G. Cooke, Stantec Consultants Ltd. and Mr. S. Howard, Ministry of Transportation were in attendance this date to inform this Committee of the Ministry's intended design and timing for interchange improvements at Highways 401 and 8. $. DTS-09-035 - ZONE CHANGE APPLICATION ZC 0$I29IWIAP - 276 WOOLWICH STREET -FREDERICK & ANITA VOISIN The Committee considered Development and Technical Services Department report DTS-09- 035, dated March 25, 2009, recommending approval of a zone change application for 276 Woolwich Street to change the zoning from Agricultural Zone (A-1) to Residential Three Zone (R-3) with special regulations and a Holding Provision for services and roadworks. The report explains that the current zoning is not consistent with the Official Plan designation of Low Rise Residential and this zone change would bring the zoning into conformity with the Official Plan. Ms. D. Ross reviewed the report noting that the holding provision will stay on the land until the Region confirms that the transportation issues have been resolved. In response to a question from Councillor Smola, Ms. Ross advised that the severed lots will be consistent with the Residential Three (R-3) zoning. Mr. H. Handy, GSP Group, was in attendance on behalf of the applicants and intended purchaser, in support of the staff recommendation. He advised that they will be able to submit two Applications of Consent, and he noted that the existing house will remain on the retained land. On motion by Councillor J. Smola - it was resolved: "That Zone Change Application ZC08/29/W/AP (276 Woolwich Street, Frederick and Anita Voisin) for the purpose of changing the zoning from Agricultural Zone (A-1) and Residential Three Zone (R-3) with 304R and 307R to Residential Three Zone (R-3) with Holding Provision for Services and Roadworks 19HSR, on lands legally described as Part Lot 66, German Company Tract, in the City of Kitchener, be approved in the form shown in the "Proposed By-law" dated March 18, 2009, attached as Appendix "A" to Development and Technical Services Department report DTS-09-035, without conditions." 9.
