REQUESTS FOR PERMISSION TO OPERATE
DOWNTOWN SIDEWALK PATIOS FOR 2009 SEASON
RECOMMENDATION:
1) "That, subject to obtaining all necessary staff approvals, the Mayor and Clerk be
authorized to execute an Encroachment Agreement satisfactory to the City
Solicitor, with the owner(s) or operator(s) of Matter of Taste, located at 119 King
Street West, for the operation of a sidewalk patio for a period not to commence
prior to execution of the Agreement by all parties and such use to terminate no
later than October 31, 2009 or such later date as approved by the Director of
Operations; and further
2) That, subject to obtaining all necessary staff approvals, the Mayor and Clerk be
authorized to execute an Encroachment Agreement satisfactory to the City
Solicitor, with the owner(s) or operator(s) of Taste of Philly Cheese Steak, located
at 98 King Street West, for the operation of a sidewalk patio for a period not to
commence prior to execution of the Agreement by all parties and such use to
terminate no later than October 31, 2009 or such later date as approved by the
Director of Operations; and further
3) That, subject to obtaining all necessary staff approvals, the Mayor and Clerk be
authorized to execute an Encroachment Agreement satisfactory to the City
Solicitor, with the owner(s) or operator(s) of Exhibit Cafe, located at 10 King Street
West, for the operation of a sidewalk patio for a period not to commence prior to
execution of the Agreement by all parties and such use to terminate no later than
October 31, 2009 or such later date as approved by the Director of Operations;
and further

4) That, subject to obtaining all necessary staff approvals, the Mayor and Clerk be
authorized to execute an Encroachment Agreement satisfactory to the City
Solicitor, with the owner(s) or operator(s) of 1725194 Ontario Limited o/a Dallas
located at 312 King Street West for the operation of a sidewalk patio for a period
not to commence prior to execution of the Agreement by all parties and such use
to terminate no later than October 31, 2009 or such later date as approved by the
Director of Operations."
REPORT:
Each of the operators has requested permission to operate a patio for the 2009 season. The
owners or operators of these businesses have all had patio encroachment agreements with the
City in the past and there are no changes to any of the patio layouts. The standard
encroachment agreement will be amended include a clause to deal with the King Street
reconstruction project and the necessity to remove the patios as needed due to construction.
FINANCIAL IMPLICATIONS:
None.
CONCLUSION:
The appropriate staff has reviewed these requests and have no concerns, and all required
licence fees have been paid. Therefore, it is in order to authorize the execution of
encroachment agreements with the above-mentioned restaurant owners/operators.
