ENCROACHMENT AGREEMENT REQUEST - TO PERMIT
PARKING ON THE EXISTING DRIVEWAY AT 497 VICTORIA
ST S ON LAWRENCE AVE. ROAD ALLOWANCE
RECOMMENDATION:
"That the Mayor and Clerk be authorized to execute an Encroachment Agreement,
satisfactory to the City Solicitor, with the property owner(s) and any mortgagee(s) of the
property municipally known as 497 Victoria St. S. (PIN 22443-0007 L T) to permit parking
on the existing driveway which encroaches approximately 33.43 square metre, more or
less, over the City's Lawrence Ave. road allowance."
REPORT:
The estate of the owner of the property would like to enter into an encroachment agreement to
allow for the continued use of the existing driveway portion located on the Lawrence Ave. road
allowance. The deceased owner occupied this property since 1952. The driveway encroaches
approximately 33.43 square metres onto the road allowance and the encroachment is set out as
Part 3 on the attached draft reference plan. This is an unusual situation because there is
insufficient space to park a vehicle on the portion of the driveway not owned by the City.
CONCLUSION:
The appropriate staff has reviewed this request and has no concerns with the parking in the
existing driveway.
