HERITAGE KITCHENER MINUTES

The Heritage Kitchener Committee met this date, commencing at 4:06 p.m.

1. DTS-08-134 - HERITAGE PERMIT APPLICATION HPA 2008-V-015
- 1222 DOON VILLAGE RD
- PROPOSED DEMOLITON OF ATTACHED GARAGE AND BARRIER-FREE
ACCESS RAMP
The Committee considered Development and Technical Services Department report DTS-08-
134, dated August 21, 2008 regarding Heritage Permit Application HPA 2008-V-015
concerning the proposed demolition of an attached garage and the demolition and
reconstruction of a barrier-free access ramp at 1222 Doon Village Road, which is located
within the Upper Doon Heritage Conservation District (HCD).
Ms. M. Wade advised that the applicant wishes to demolish the attached garage and barrier-
free access ramp to resolve water issues in the basement of the existing church building. She
stated that the applicant has obtained a quote, which requires the installation of a membrane
around the perimeter of the foundation. In order to apply the membrane along the side and
rear of the building, the existing attached garage and barrier-free access ramp must be
removed. She added that Heritage Planning staff will work with both the applicant and building
staff to develop a design solution for the replacement of the barrier-free access ramp that
addresses the Ontario Building Code requirements while not detracting from the building or
streetscape.
In response to questions, Ms. M. Wade advised that the applicant has indicated that he would
rebuild the existing access ramp soon after the completion of this work. She noted that a
separate heritage permit application would be required if the applicant decides to replace the
access ramp with a lift system.
On motion by Ms. S. Lauber-
it was resolved:
"That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application
HPA 2008-V-015 be aDDroved, to permit the demolition of an attached garage and the
demolition and reconstruction of a barrier free access ramp associated with the church
building located at 1222 Doon Village Road, subject to the final building permit drawings
for the new barrier free access ramp being reviewed and approved by Heritage
Planning staff, prior to the issuance of a building permit."
2. DTS-08-136 - HERITAGE PERMIT APPLICATION HPA 2008-IV-013
- 100 WATER STREET SOUTH
- REPAIR OF CEDAR SHINGLE ROOF
The Committee considered Development and Technical Services Department report DTS-08-
136, dated August 21, 2008 regarding Heritage Permit Application HPA 2008-IV-013
concerning repairs to the cedar shingle roof, including the installation of copper flashings and
galvanized steel eaves troughs and downspouts at 100 Water Street South. In addition, the
Committee was in receipt of a memorandum from Ms. M. Wade, dated August 25, 2008
regarding the use of copper for eaves troughs and downspouts.
Ms. M. Wade advised that report DTS-08-136 recommended approval for the installation of
galvanized steel eaves troughs and downspouts; however, since that report was drafted,
Heritage Planning staff have been able to confirm that the use of copper for the eaves troughs
and downspouts is appropriate for this era of home. As a result, staff are revising their original
recommendation to permit the installation of new copper or galvanized steel eaves troughs and
downspouts.

On motion by Ms. L. Brohman -
it was resolved:
"That pursuant to Section 33 of the Ontario Heritage Act, Heritage Permit Application
HPA 2008-IV-013 be aooroved, to permit the repair of the cedar shingle roof;
installation of new copper or galvanized steel eaves troughs and downspouts; and, the
installation of copper flashings at 100 Water Street South, in accordance with the
information submitted with the application."
3. DTS-08-137 - HERITAGE PERMIT APPLICATION HPA 2008-IV-012
- 748 ZELLER DRIVE
- INSTALLATION OF A NEW CEDAR SHINGLE ROOF
The Committee considered Development and Technical Services Department report DTS-08-
137, dated August 21, 2008 regarding Heritage Permit Application HPA 2008-IV-012
concerning the installation of a new cedar shingle roof with copper flashings and the repair of
the return eaves on the west gable end of the farmhouse at 748 Zeller Drive.
Ms. M. Wade advised that the proposed cedar shingle roof, copper flashings, and repair of the
return eaves on the west gable end would complement the heritage character of the
farmhouse. She stated that originally it was proposed as a condition of approval, that Heritage
Planning staff would review and approve the construction and appearance of the continuous
ridge vent. However, the applicant has since provided drawings of the continuous ridge vent
and staff are satisfied that it would not detract from the character of the farmhouse.
Mr. Robert Woolner, Applicant was in attendance in support of HPA 2008-IV-012 and
confirmed the use of cedar shingles, as opposed to installing a cedar shake roof.
On motion by Ms. E. Gallaher -
it was resolved:
"That pursuant to Section 33 and Section 37 of the Ontario Heritage Act, Heritage
Permit Application HPA 2008-IV-012 be aooroved, to permit the installation of a new
cedar shingle roof with copper flashings on the farmhouse and the repair of the return
eaves on the west gable end of the farmhouse at 748 Zeller Drive, in accordance with
the information submitted with the application."
4. DTS-08-135 - HERITAGE PERMIT APPLICATION HPA 2008-IV-014
- 70 KING STREET EAST
- PROPOSED NEW ENTRANCE ON FREDERICK STREET
The Committee considered Development and Technical Services Department report DTS-08-
135, dated August 21, 2008 regarding Heritage Permit Application HPA 2008-IV-014 which
proposes the construction of a new entrance on the Frederick Street elevation of 70 King
Street East.
Ms. M. Wade advised that the new entrance would be one storey in height so as not to impact
the series of uninterrupted tapering metal ailerons (or metal fins) which wrap around both the
Frederick and King Street elevations and would be angled to match the King Street entrances.
She stated that the bulkhead above the new entrance would project approximately 2 feet 2
inches and would be clad in stucco and painted in colours to match the existing limestone
fagade, doors, and windows. She commented that staff are of the opinion that the character of
the building expressed through Solidity and Motion of the limestone fagade and steel fins
would be maintained and that the proposed alterations are within an acceptable range.
Accordingly, staff are recommending approval of HPA 2008-IV-014.
In response to questions, Ms. M. Wade advised that the applicant is proposing the introduction
of projecting signs on both the Frederick and King Street elevations; which would be the

subject of a separate heritage permit application. She noted that staff are not aware of any
other alterations proposed for the exterior elevations of the building.
Mr. Dan Baker, Obsidian Group Inc. advised that it is anticipated that the Heritage Permit
Application for the projecting signs would be submitted to Heritage Planning staff by the end of
this week, which would enable it to be reviewed at the October 7, 2008 Heritage Kitchener
meeting. He stated that given its weight, it would not have been feasible to use limestone for
the bulkhead, so alternatively they decided to use stucco fashioned to replicate the
appearance of limestone. He noted that there should not be a distinguishable difference
between the two surfaces, especially given that the bulkhead would be located approximately 9
feet off the grou nd.
On motion by Mr. G. Zeilstra -
it was resolved:
"That pursuant to Section 33 of the Ontario Heritage Act, Heritage Permit Application
HPA 2008-IV-014 be aooroved, to permit the construction of a new entrance on the
Frederick Street Elevation at 70 King Street East, in accordance with the plans
submitted with the application, subject to the final building permit drawings being
reviewed and confirmed as acceptable by Heritage Planning staff, prior to issuance of a
building permit."
5. 234 TILT DRIVE HERITAGE IMPACT ASSESSMENT (HIA) - UPDATE
Mr. L. Bensason advised that a Heritage Impact Assessment (HIA) was made a condition of
the registration of Plan of Subdivision 30T-04208 given evidence indicating that 234 Tilt Drive
was a log structure circa 1850s. He stated that at the May 6, 2008 Heritage Kitchener
meeting, the Committee considered the Built Heritage Assessment Preliminary Report for 234
Tilt Drive prepared by Archaeologix Inc., which recommended a partial demolition and
documented removal of layers of cladding so that the log structure could be seen and more
thoroughly assessed. He added that to date, considerable work has been done to the interior
of the building to expose the original log structure and noted that the exterior of the building
was covered in shiplap cladding and then insulbrick. He stated that Ms. Nancy Tausky,
Heritage Consultant, Archaeologix Inc., informed staff that the removal of the insulbrick has
exposed holes in the shiplap cladding, which could lead to moisture penetration and negatively
impact the original log structure. Accordingly, staff have requested that Archaeologix Inc.
provide additional information and options from a material conservation perspective prior to
moving forward. He pointed out that Archaeologix Inc. anticipate presenting the final HIA at
the October 7, 2008 Heritage Kitchener meeting and will be scheduling a site visit for the
members of Heritage Kitchener prior to that date.
6. DOORS OPEN WATERLOO REGION - HERITAGE KITCHENER DISPLAY AT KITCHENER
CITY HALL
The Committee was in receipt of the 2008 Doors Open Waterloo Region, Heritage Kitchener
Display sign-up sheet. Mr. K. Kirby noted that the event would be taking place between 10:00
a.m. to 4:00 p.m. on Saturday, September 20, 2008. He then encouraged all members to e-
mail Mr. C. Goodeve to indicate the times they are available to manage the Committee's
display, which will be located at Kitchener City Hall. Ms. M. Wade agreed to confirm where in
City Hall the display would be located and Ms. L. Brohman advised that she and Ms. Lauber
would be willing to work with staff to develop the display.
7. PROCEDURE FOR THE REVIEW OF PROPERTY NOMINATIONS TO THE MUNICIPAL
HERITAGE REGISTER
The Committee was in receipt of a memorandum from Ms. M. Wade, dated August 21, 2008
regarding the process for listing privately owned non-designated property of cultural heritage
value or interest to the Municipal Heritage Register (MHR).

7. PROCEDURE FOR THE REVIEW OF PROPERTY NOMINATIONS TO THE MUNICIPAL
HERITAGE REGISTER (CONT'D)
Mr. C. Goodeve advised that staff are proposing to modify the format of the Heritage Kitchener
Agenda to include a section entitled Consent Items. He stated that a standard component of
all Standing Committee agendas, Consent Items enable a committee to more expeditiously
deal with matters that are considered not to require debate, noting that one motion is used to
move the recommendation contained in each staff report listed as Consent Items. Ms. M.
Wade added that this process would be used for non-controversial properties proposed to be
listed on the MHR. She stated that, as those properties would have already been evaluated by
a Field Team and short listed by the MHR Sub-committee; a formal presentation would not be
made by Heritage Planning staff at a Heritage Kitchener meeting. She noted that the
completed Cultural Heritage Resource Evaluation Form and the draft Statement of
Significance, including photographs, would still be circulated to the Committee with each
agenda package.
In response to questions, Mr. L. Bensason advised that unlike the process for designating
properties under the Ontario Heritage Act (OHA), there is no legislated appeal process
prescribed for the listing of non-designated properties of cultural heritage value or interest to
the MHR. He added that the City's process for adding properties to the MHR was designed to
be as transparent as possible and to afford an owner with multiple opportunities to express
concern regarding the listing of their property. He noted that having a property listed on the
MHR does not require a property owner to submit a heritage permit application or prevent the
owner from making alterations to their property. Rather, its only implication is that it delays the
consideration of a demolition application by 60 days to provide the City with time to consider
designating the listed property under the OHA.
Ms. L. Brohman suggested that given the negative interpretation that some persons may have
regarding this process, the materials circulated to property owners about the MHR should
clearly indicate that an owner can still make alterations to their property without having to seek
the City's approval.
Several members expressed support for modifying the Heritage Kitchener Agenda to include a
Consent Items section, noting the potential to expedite the process for listing non-designated
properties of cultural heritage value or interest on the MHR.
8. DTS-08-138 - ADDITION OF 7 FISCHER COURT AND 6 GORDON AVENUE TO THE
MUNICIPAL HERITAGE REGISTER
Ms. L. Brohman declared a conflict of interest as she is the owner of one of the properties
proposed for listing on the Municipal Heritage Register (MHR) and did not participate in any
voting or deliberation regarding this matter.
The Committee considered Development and Technical Services Department report DTS-08-
138, dated August 13, 2008 regarding the addition of 7 Fischer Court and 6 Gordon Avenue to
the MHR as non-designated properties of cultural heritage value or interest.
On motion by Ms. E. Gallaher -
it was resolved:
"That pursuant to Section 27 of the Ontario Heritage Act, the following properties be
listed on the Municipal Heritage Register as non-designated properties of cultural
heritage value or interest, in accordance with the Statements of Significance attached as
Appendix 'A' to Development and Technical Services Department report DTS-08-138:
· 7 Fischer Court; and,
· 6 Gordon Avenue"
9. GENERAL DISCUSSION - PROPOSED DESIGNATION OF 11 YOUNG STREET AND 156-
158 KING STREET WEST
The Committee undertook a general discussion regarding a proposal to direct staff to proceed
with the initial steps in the process to designate 11 Young Street (Mayfair Hotel) and 156-158

King Street West (P. Hymmen Hardware) under Part IV of the Ontario Heritage Act. It was
noted that these properties are currently listed on the Municipal Heritage Register as non-
designated properties of cultural heritage value or interest. Following a brief discussion, the
Committee agreed to defer and refer consideration of this matter to the October 7, 2008
Heritage Kitchener meeting.
