Appeal - Refreshment Vehicle Location - 932 Victoria St. N.
RECOMMENDATION:
The Committee’s direction is requested.
BACKGROUND:
Chapter 586 (Refreshment Vehicles) of the City of Kitchener Municipal Code requires a 200
metre distance separation between a Refreshment Vehicle and a Place of Refreshment and a
400 metre distance separation between two Refreshment Vehicles. This requirement is for both
new and renewal applications.
REPORT:
Attached is a request from Andrew Head, Dryden Smith & Head Planning Consultants Ltd. on
behalf of their client, Dave Wilson, who wishes to operate a refreshment vehicle at TA
Appliance, 932 Victoria Street North. Mr. Head is requesting an appeal of the Manager of
Licensing’s decision not to issue a licence for the operation of a refreshment vehicle at 932
Victoria Street North. Their client wishes to locate a concession trailer which will sell smoked
meat and smoked meat products such as smoked ribs, pulled pork, etc. Mr. Wilson has received
permission from the owner of the property.
There are currently two Refreshment Vehicles and 6 Places of Refreshment located within the
distance separation. The owners of the affected businesses have been notified and the
Manager of Licensing has received one verbal objection and one written objection which is
attached to this report. In both cases they have indicated that the competition for the food dollar
is already high on Victoria Street and this type of concession trailer would make it more difficult
to operate a profitable business.

notified of the request.
