SUBJECT: ENCROACHMENT AGREEMENT REQUEST-283
FAIRWAY RD N -PROPOSED WALKWAY AND STAIRS ON
RIVER RD ROAD ALLOWANCE
RECOMMENDATION:
"That, subject to obtaining all other necessary approvals, the Mayor and Clerk be
authorized to execute an Encroachment Agreement, satisfactory to the City Solicitor,
with the property owner(s) and any mortgagee(s) of the property municipally known as
283 Fairway Rd. N. (PIN 22555-0011 LT) to legalize the proposed walkway and stairs
encroachment which will encroach approximately 4.357m x 2.214m, more or less, onto
the River Rd. road allowance."
REPORT:
In conjunction with condominium conversion application 30CDM-08203, an encroachment
agreement is required for proposed walkway and stairs which will be located on the River Rd.
road allowance. The walkway and stairs will run from the sidewalk on River Rd. to the
standpipe connection on the south face of the building. The purpose of the walkway is to allow
firefighters access to the standpipe connection in the case of a fire. The walkway and stairs to
the connection have been reviewed and approved by the Fire Department. The location of the
proposed encroachment is shown as Part 1 on the attached draft reference plan.
Due to timing of Council meetings, this matter is being brought to Council in advance of
obtaining other necessary approvals.

CONCLUSION:
Once all appropriate reviews and approvals have been obtained, it would be in order to
authorize the execution of an encroachment agreement with the owner(s) and any mortgagee(s)
of 283 Fairway Rd. N.
