That city initiated Official Plan Amendment OP 0910011COKIHH being an amendment to replace Part 4, Policy 1.6 (Site Plan Control), be approved, in the form shown in the attached "Proposed Official Plan Amendment"; and further 2. That city initiated amendment to Chapter 683 of the City of Kitchener Municipal Code being a by-law to amend the City's Site Plan Control By-law to add Article 4 and sections thereto, be adopted, in the form shown in the attached "Proposed By-law" dated March 6, 2009. EXECUTIVE SUMMARY: The purpose of the proposed amendments to the Official Plan and Municipal Code Chapter 683 (Site Plan Control Bylaw) is to introduce new Site Plan Control policies and regulations. The proposed changes would broaden the City's authority to consider the external design of buildings, sustainable streetscape improvements and barrier-free accessibility through the Site Plan application process. BACKGROUND: In October 2006, the Province approved the Planning and Conservation Statute Law Amendment Act (Bill 51). Coming into effect in January 2007, this bill introduced a number of changes to the Planning Act that have the potential to improve the way the City of Kitchener processes development applications under the Act. One such change was the introduction of new legislative authorities pertaining to the Site Plan review process. The changes to Section 41 of the Planning Act enable municipalities to consider exterior design of buildings, sustainable design features in the municipal right-of-way and barrier-free accessibility in the Site Plan review process, provided that Official Plan policies and a Site Plan Control By-law are in place governing their use. These changes enable the City to "promote development that is attractive, well-integrated and environmentally sustainable". Each of 3-1 these improvements are in keeping with the City's vision and enables the City to further advance its Urban Design framework. REPORT: The City is proposing an amendment to the City's Official Plan and Site Plan Control By-law to make use of the new legislative powers afforded by Bill 51. The proposed changes would enable the Site Plan Review Committee to require and review plans, elevations and cross sections addressing two new matters: • matters relating to exterior design of buildings; and sustainable design elements on municipal right-of-ways. The amendment also proposes a section in the Official Plan addressing barrier-free accessibility for aersons with disabilities. Implementation ~~ The Site Plan Control process is the primary means by which to apply the urban design guidelines established in the City's Urban Design Manual. The Site Plan Review Committee endeavours to achieve site and building designs of the highest caliber by evaluating each application on a site-by-site basis. The Manual and component Design Briefs serve as guiding documents and reference points in the review of Site Plan applications. The Committee is cognizant of the fact that each application is different and therefore flexibility is key in the interpretation of the Manual's design standards. The committee balances the need for flexibility against the need for consistency and fairness. The proposed amendments to the Official Plan and Site Plan Control by-law would enable the Site Plan Review Committee to review and approve drawings that address new design features. While the authority may be new, the committee routinely requires and reviews these drawings in current practice. The proposed amendment formalizes this existing practice. In implementation, there will belittle change to the status quo. The policy change merely gives the requirements some additional tenability, as they will be anchored in provincial statute and the City's official plan. The intent is for continued flexibility and objectivity throughout the Site Plan review process. Stakeholder Comments The proposed amendments were discussed at the Site Plan Review Committee meeting on Wednesday March 18, 2009 and at the Home Builder's Liaison Meeting on Friday, March 20, 2009. In response to verbal comments received from both committees, Planning Staff made revisions to the proposed official plan amendment. The proposed official plan amendment was circulated to the prescribed agencies and stakeholders on March 25, 2009. A copy of the circulation letter is attached as Appendix `F'. Staff received written comments from Bell Canada, the Region of Waterloo and the Waterloo Catholic District School Board, attached as Appendix `G'. With regard for Bell Canada's comments, staff agree that Bell Canada is an important stakeholder in the preparation and implementation urban design guidelines and standards. As per their request and in keeping with current practice, staff will ensure that Bell Canada continue to be circulated on the development of urban design guidelines and implementation thereof. With regard for the Region of Waterloo's comments, Planning Staff made revisions to the proposed official plan amendment. The Waterloo Catholic District School Board advised that they have no concerns with the proposed amendment. FINANCIAL IMPLICATIONS: No direct capital financial implications to the City. 3-2 COMMUNICATIONS: Notice of the May 11, 2009 public meeting of the Development and Technical Services Committee was advertised in The Record on April 17, 2009. A copy of the advertisement is attached as Appendix `H'. CONCLUSION: The proposed amendments to the City's Official Plan and Site Plan Control By-law will enable the City to make use of the new legislative powers afforded by Bill 51. Currently the Site Plan Review Committee routinely reviews elevations, and as such implementation of the proposed change will have little impact on current practice. In the future, staff may need to develop more detailed design standards pertaining to building elevations and sustainable design improvements in municipal right-of-ways, at which time staff will initiate a full public consultation program, including presentation of a report to the Development and Technical Services committee for approval. Bill 51 provides municipalities with new design tools under Section 41 of the Planning Act (site plan control). Section 41 of the Act has been changed to provide new authority to municipalities to promote development that is attractive, well-integrated and environmentally sustainable. Legislative/Regulatory Changes Key changes to Section 41 of the Planning Act include: • Enhancing municipal authority to consider exterior design details of buildings (such as architectural details, texture and window details) through the site plan control process (note that this authority excludes interior design, layout of specific interior areas and the manner and standards for construction) • Broadening a municipality's authority to implement sustainable streetscape improvements on public boulevards adjoining development sites through the site plan process, subject to official plan and site plan control by-law requirements • Enhancing pre-consultation by enabling applicants to initiate and allowing municipalities to require early dialogue on development proposals, to help ensure municipal design objectives and other planning requirements are clearly understood before site plan proposals are submitted to a municipality • Enabling municipalities to improve accessibility for persons with disabilities through the site plan process To use the new authority around exterior design in Section 41 of the Act, municipalities must adopt specific official plan policies and a site plan control by-law to guide the municipal review of the design aspects of development. Official plan policies may also identify or describe specific areas where exterior design control is important, such as downtown core orwaterfront areas, or public transit nodes and corridors. More specific policies andlor criteria can be included relating to the design and quality of the built environment. Similarly, a municipality must have official plan policies and site plan control by-law provisions in place in order to use the new sustainable design authority in the Act. The public consultation required in the process of establishing official plan policies and the site plan control by-law ensures that the public and landowners have the opportunity to provide input into the design policy framework for the community. These changes mean that development proposals can be better shaped in relation to the character, scale and appearance of surrounding buildings and spaces. The ability for municipalities to consider design features on the exterior face of buildings contributes towards improving the appearance of development proposals and their integration into existing neighbourhoods. The changes also support the environmental quality and health of communities by allowing municipalities to work with development proponents to secure sustainable design features on building exteriors such as green roofs, where this is feasible. Furthermore, the changes help facilitate universal accessibility to buildings and to the spaces surrounding buildings on a development site by requiring plans and drawings, which are submitted to municipalities for approval, to incorporate facilities designed to have regard for people with disabilities. It is also used by the municipality to secure land for road widenings. To a large extent the Site Plan Control strategy is one of the key mechanisms for implementing the urban design policies. 1. The Council of the City of Kitchener has established a Site Plan Control Area which shall encompass all of the lands within the boundaries of the municipality and shall be applicable to all development excluding: i) Farm operations, farm buildings and the residence of the farm operator on agriculturally zoned land. ii) Single detached dwellings, semidetached dwellings and duplexes except those permitted within or contiguous to Open Space Areas, Environmentally Sensitive Policy Areas, and single detached dwellings, semi-detached dwellings and duplexes forming part of a zero lot line, linked housing, or similar innovation in house grouping developments. Council may by By-law designate all or part of such area to be a Site Plan Control Area. 2. Drawings showing plan, elevation and cross section views may be required for all buildings to be erected, including all buildings to be used for residential purposes regardless of the number of units, within the Site Plan Control Area outlined above. 3. The conservation or enhancement of natural features such as ground water recharge areas shall be considered during the preparation and review of site development proposals and improvement plans and programs. ~ 4. Widenings of highways shall be required as a condition of site plan approval for all development except as excluded in Part 4, Section 1.6.1 within the Site Plan Control Area abutting those Secondary Roads including Arterials, Collectors, Local Streets and Lanes described in Schedule C, Highways to be Widened, and Schedule D, Intersections That May Exceed the Designated Road Allowance. 5. P.13, provide that, where an area is shown or described in the City's Official Plan as a proposed site plan control area, City Council may, by by-law, designate the whole or any part of such area as a site plan control area and by reference to one or more land use designations contained in a zoning by-law; ~, ~ AND WHEREAS Kitchener's Official Plan, known as the Municipal Plan, adopted by City Council on May 24, 1994 and approved by the Regional Council on May 25, 1995, has established a proposed site plan control area which encompasses all of the lands within the boundaries of the City and is applicable to all land use designations with certain exclusions therein and hereinafter set out; ~ AND WHEREAS it is deemed expedient to designate the whole of the City as a site plan control area subject to the said exclusions. By-law 86-137, 14 July, 1986; By-law 2001-224, 26 November, 2001; By-law 2007-41, 26 February, 2007. 683.1.2 Development- defined In this Chapter "development" means the construction, erection or placing of one or more buildings or structures on land or the making of an addition or alteration to a building or structure that has the effect of substantially increasing the size or usability thereof, or the laying out and establishment of a commercial parking lot or of sites for the location of three or more trailers as defined in subsection 168 (5) of the Municipal Act, 2001, c. 25 or of sites for the location of three or more mobile homes as defined in subsection 46 (1) of the Planning Act, R.S. 0. 1990, c. P.13 or of sites for the construction, erection or location of three or more land lease community homes as defined in subsection 46 (1) of the Planning Act R.S.O1990, c. P.13, but does not include the placement of a portable classroom on a school site of a district school board if the school site was in existence on January 1, 2007 as defined in subsection 41 (1) of the Planning Act, R.S.O. 1990, c. P.13. 683.1.3 Site plan approval -all development -exception Any person owning land within the boundaries of The Corporation of the City of Kitchener, except for those lands or land use designations as described in Sections 683.1.1(a} and 683.1.1(b) of this Chapter, shall apply for and obtain site plan approval prior to the development of such land. Article 2 AUTHORITY -DELEGATION 683.2.1 Appointed officers -approval -plans-drawings Save for those cases in which school board properties are proposed for development for non- educational purposes, the Supervisor of Site Plan Development or Manager of Development Reviews or in their absence the City's Director of Planning or the Manager of Long Range and Policy Planning Development and Technical Services Department are hereby delegated as being the appointed officers of the City to exercise City Council's powers or authority under section 41 of the Planning Act, R.S.O. 1990, c. P.13 to approve plans and drawings, to impose conditions and to require agreements. 683.2.2 Mayor -Clerk - to execute agreements The Mayor and Clerk are authorized to execute all agreements required as a result of the exercise of authority delegated to appointed officers with respect to Site Plan Control. By-law 86-137, 14 July, 1986 Article 3 ~ ENFORCEMENT 683.3.1 Fine -for contravention -person Every person who contravenes section 41 of the Planning Act, R.S.O. 1990, c. P.13 and any provision of this Chapter, and, if the person is a corporation, every director or officer of the corporation who knowingly concurs in the contravention, is guilty of an offence and on conviction is liable: (a) on a first conviction to a fine of not more than Twenty-Five Thousand Dollars ($25,000); and (b) on a subsequent conviction to a fine of not more than Ten Thousand Dollars ($10,000) for each day or part thereof upon which the contravention has continued after the day on which the person was first convicted, in accordance with subsection 67 (1) of the Planning Act, R.S.O. 1990, c. P.13. 683.3.2 Fine -for contravention -corporation 3-7 Where a corporation is convicted under 683.3.1 and/or subsection 67(1) of the Planning Act, R.S.O. 1990, c. P.13, the maximum penalty that may be imposed is: (a) on a first conviction a fine of not more than Fifty Thousand Dollars ($50,000); and (b) on a subsequent conviction a fine of not more than Twenty-Five Thousand Dollars ($25,000) for each day or part thereof upon which the contravention has continued after the day on which the corporation was first convicted, and not as provided in 683.3.1, as provided in subsection 67 (2) of the Planning Act R.S.O. 1990, c. P.13. 683.3.3 Order -prohibiting continuation -repetition Where a conviction is entered under 683.3.1 and/or subsection 67 (1) of the Planning Act, R.S.O. 1990, c. P.13, in addition to any other remedy or any penalty provided by law, the court in which the conviction has been entered, and any court of competent jurisdiction thereafter, may make an order prohibiting the continuation or repetition of the offence by the person convicted, in accordance with subsection 67 (3) of the Planning Act, R.S.O. 1990, c.P.13. By-law 2007-41, 26 February, 2007. 3-8 APPENDIX D AMENDMENT NO. TO THE OFFICIAL PLAN OF THE CITY OF KITCHENER SECTION 1-TITLE AND COMPONENTS This Amendment shall be referred to as Amendment No. to the Official Plan of the City of Kitchener. Sections 1 to 4 inclusive of this document shall constitute the Amendment. SECTION 2 -PURPOSE OF THE AMENDMENT ~~ The purpose of the amendment is to add policies to the Official Plan to broaden the City's authority to consider the external design of buildings, sustainable streetscape improvements and barrier-free accessibility through the Site Plan application process. SECTION 3 -BASIS OF THE AMENDMENT In January 2007 the Planning and Conservation Land Statute Law Amendment Act (Bill 51) came into effect and introduced a number of changes to the Planning Act as well as the Conservation Land Act. One of the primary objectives of the Bill 51 amendments to the Planning Act is to give municipalities more tools "to support sustainable, well designed communities". The Bill provides municipalities with new design tools under Section 41 of the Planning Act (site plan control) to promote sustainability and help manage the design of communities. The Bill expanded the list of matters which a municipality can address through site plan control to include: • Matters relating to the exterior design of buildings; • Sustainable design elements on municipal right-of-ways; and • Barrier-free accessibility for persons with disabilities. A municipality is required to have enabling official plan policies and site plan control by-law in place in order to implement these new Site Plan control tools. The new official plan policies proposed in this amendment are to enable the City of Kitchener to use the new Planning Act tools related to the review of Site Plan applications. 3-9 SECTION 4 -THE AMENDMENT The Official Plan for the City of Kitchener is hereby amended as follows: 1. Part 4, Policy 1.6 is hereby deleted and replaced with the following: "1.6 Site Plan Control Site Plan Control is a strategy used to encourage high quality site and exterior building design. It is used to achieve appropriate siting and massing of a development on a site and to ensure safety, accessibility, attractiveness and compatibility of a development with the site context and overall urban landscape. It is also used by the municipality to secure land for road widenings and implement sustainable streetscape improvements in public boulevards adjoining development sites. To a large extent the Site Plan Control strategy is one of the key mechanisms for implementing the urban design policies, guidelines and design briefs. 1. The Council of the City of Kitchener has established a Site Plan Control Area which shall encompass all of the lands within the boundaries of the municipality and shall be applicable to all development excluding: i) Farm operations, farm buildings and the residence of the farm operator on agriculturally zoned land. ii) Single detached dwellings, semidetached dwellings and duplexes except those permitted within or contiguous to Open Space Areas, Environmentally Sensitive Policy Areas, and single detached dwellings, semi-detached dwellings and duplexes forming part of a zero lot line, linked housing, or similar innovation in house grouping developments. Council may by By-law designate all or part of such area to be a Site Plan Control Area. 2. Proposed development within the Site Plan Control Area outlined above may not be permitted until such time as the City has approved drawings showing plan, elevation and cross-section views for all buildings to be erected (including all buildings to be used for residential purposes regardless of the number of units) sufficient to display the following: a) exterior building design considerations including, without limitation: i) Character ii) Scale ~ j iii) Appearance iv) Design features v) Sustainable design. b) sustainable design elements within an adjoining City right-of-way, including without limitation: i) Trees ii) Shrubs iii) Hedges iv) Plantings and other groundcover v) Permeable paving materials vi) Street furniture vii) Curb cuts and driveway ramps viii) Waste and recycling containers ix) Bicycle parking facilities. 3-10 The exterior design of all buildings proposed through site plan, as well as the sustainable streetscape design elements as described herein, shall be consistent with any applicable Council-approved design policies, guidelines and design briefs. 3. The conservation or enhancement of natural features such as ground water recharge areas shall be considered during the preparation and review of site development proposals and improvement plans and programs. 4. Widenings of highways may be required as a condition of site plan approval for all development except as excluded in Part 4, Section 1.6.1 within the Site Plan Control Area abutting those Secondary Roads including Arterials, Collectors, Local Streets and Lanes described in Schedule C, Highways to be Widened, and Schedule D, Intersections That May Exceed the Designated Road Allowance. •~. 5. The provision of barrier-free accessibility for persons with disabilities, in keeping with the City's Barrier Free Accessibility design standards as outlined in the Urban Design Manual, shall be implemented during the preparation and review of site development proposals and improvement plans and programs." 3-11 PROPOSED BY-LAW (March 6, 2009) BY-LAW NUMBER OF THE CORPORATION OF THE CITY OF KITCHENER APPENDIX E (Being a by-law to amend Chapter 683 of the City of Kitchener Municipal Code regarding Site Plan Control) WHEREAS it is deemed expedient to amend Chapter 683 of the City of Kitchener Municipal Code adopted by By-law 88-100, hereinafter called the "Code"; NOW THEREFORE the Council of the Corporation of the City of Kitchener enacts as follows: ^ " 1. Chapter 683 of The Code is hereby amended by adding the following Article and sections thereto: "Ar i 14 tce k -~ .ts PLANS AND DRAWINGS 684.4.1 The drawings to be approved pursuant to subsections (4) and (5} of section 41 of the Planning Act, R.S.O. 1990, c. P.13 may be required to address, among other matters, the following: (a) Matters relating to the exterior design of buildings, including without limitation, the character, scale, appearance and design features, and their sustainable design; and (b) Sustainable design elements within any adjoining City right-of-way, including without limitation, trees, landscaping, permeable paving materials, street furniture, curb ramps, waste and recycling containers and bicycle parking facilities. 684.4.2 As a condition of approval of the plans and/or drawings referred to in subsections (4} and (5) of section 41 of the Planning Act, R.S.O. 1990, c. P.13 and Section 684.4.1, the City may require the owner of the lands to: (a) Provide and maintain, to the satisfaction of and at no expense or risk to the City, the facilities, works or matters set out in Section 41(7) of the Planning Act; (b) Enter into one or more agreements with respect to the provision and maintenance of such facilities, works or matters; and (c) Enter into one or more agreements to ensure that development proceeds in accordance with the approved plans and drawings as required by subsections (4) and (5) of section 41 of the Planning Act, R.S.O. 1990, c. The purpose of the proposed amendments is to introduce enabling policies to make use of new Site Plan Control tools created by the Province. The proposed changes would broaden the City's authority to consider the external design of buildings, sustainable streetscape improvements and barrier-free accessibility through the Site Plan application process. The public meeting will be held by the City's DEVELOPMENT AND TECHNICAL SERVICES COMMITTEE, a Committee of Council which deals with Planning Matters on MONDAY, May 11 2009 at 7:00 P.M. IN THE COUNCIL CHAMBERS, 2ND FLOOR, CITY HALL, 200 KING STREET WEST, KITCHENER. Any persons may attend the Public Meeting and make written and/or verbal representation in respect to the applications. If a person or public body does not make oral submissions at this public meeting or make written submissions to the City prior to the approval of the site plan control by-law amendment or adoption of the Official Plan amendment, the Ontario Municipal Board may dismiss a subsequent appeal.
