That DTS Report DTS-09-079 be received for information and for the consideration of
Council.

BACKGROUND:
The subject property straddles the border between the City of Waterloo and the City of
Kitchener and is 35.8 hectares (88.5 acres) in area. The owner of the subject lands, The INC
Corp., is proposing an integrated retail, service and office commercial centre having a total floor
space of approximately 87,883 square metres (946,000 square feet)
The applicant has submitted applications in both the City of Waterloo and the City of Kitchener
to facilitate the proposed development.
The applicant's lands within the City of Kitchener are approximately 18.1 hectares (44.7 acres}
and applications have been received to change the land use designation and zoning from
`General Industrial' to `Planned Commercial Campus'.
The applicant's lands within the City of Waterloo are approximately 17.7 hectares (43.7 acres) in
area. Approximately 13 hectares (32.1 acres) of the Waterloo portion of the applicant's lands
are already designated `Arterial Commercial' and zoned for Commercial 3. The applications in
Waterloo propose to redesignate and rezone the industrial portion of the site, which is
approximately 5.5 hectares (13.6 acres) in area, at the rear of the Commercial 3 zoning (that
otherwise would have limited or no visibility from West Hill Drive) and integrate this portion of
the site into the entire commercial development. They also propose to modify the existing
commercial zoning on the site.
As reported to the Development and Technical Services Committee at their meeting of March
30, 2009, it was Planning Staff's intent to bring the proposed official plan amendment and zone
change applications to a June committee meeting date. Discussions had also taken place with
the applicants in which it was conveyed that Planning Staff would aim for a June public meeting.
There are two issues. The first being that the advertisement for the June 22, 2009 public
meeting needs to be placed in The Record on May 29, 2009. On that date the planning report
needs to be finalized and available to the community as per Council policy. Planning Staff have
been advised by the Region of Waterloo Planning Staff that the Waste Management Division
Waterloo Landfill Liaison Committee has requested that an Odour Study be completed which
could have implications for the proposed development. Also, the review of the Traffic Impact
Study and comments on same are outstanding as of this date. The Region has advised that
they may not be in a position to provide comments on the official plan amendment and zone
change applications by May 29, 2009.
The second issue relates to the date and time of the public meeting. At the time of writing this
report The City of Waterloo is also intending that the planning applications to facilitate the
change in land use in Waterloo be considered at their Council meeting on June 22, 2009 at 7
p.m. The applicants have requested that if their applications in the City of Kitchener are to be
considered on this date, that our Committee consider a different start time so that they may be
able to attend both meetings.
REPORT:
The standard start time for public meetings under the Planning Act in the City of Kitchener is 7
p.m. This is to allow members of the community who have commitments during the business
hours to be able to attend public meetings on planning applications without adverse impact to
their schedules and regular commitments.

The other consideration is that June 22, 2009 is a busy Committee day and is typically full of
agenda items and other public meetings. It is difficult at this point in time to know whether there
will be any other available time beyond the slotted 7 pm public meeting start time to allow for an
alternate start time for a public meeting to consider these applications.
City staff appreciates that the applicants would like to be able to attend both meetings in each of
the municipalities on that date. Without knowing the other Committees' agendas for that day it is
difficult to know whether there will be available time to have a public meeting earlier than 7 pm.
If Council were to consider a later time, even if the meeting in the City of Waterloo were to start
on time at 7 pm it would be difficult to anticipate its ending and when the applicants and any
members of the community would be able to attend at the City of Kitchener on that same
evening.
The last consideration is that there may be the possibility that Planning Staff may not have all
the required input to prepare a planning report with recommendations by the May 29, 2009
advertisement day. As stated, it is Council policy to have a planning report finalized and
available tothe community priorto giving public notice of a public meeting.
To resolve both issues of the time of the public meeting and the ensuring that Planning Staff
have all the available information to prepare a planning report with recommendations by May
29, 2009, it may be appropriate to schedule a public meeting at the August 10, 2009 meeting of
the Development and Technical Services Committee or on another alternate date as Council
sees appropriate.

None.
