Grant Murphy, Director, Engineering Services (741-2410} WARD(S) INVOLVED: ALL DATE OF REPORT: May 20, 2009 REPORT NO.: DTS-09-085 SUBJECT: CITY OF CAMBRIDGE TO PROVIDE SANITARY SERVICING TO CONESTOGA COLLEGE SOUTH CAMPUS AND BLAIR BUSINESS PARK LANDS RECOMMENDATION: THAT staff be directed to enter into a memorandum of understanding with the City of Cambridge related to the provision of cross-border wastewater servicing plan to accommodate the Conestoga College South Campus lands and the Blair Industrial lands; AND THAT all expenditures associated with conducting Municipal Class Environmental Assessment Study wastewater servicing plan to accommodate the Conestoga College South Campus lands and the Blair Industrial lands; construction; commissioning and operation of proposed sewage works be at the cost of the City of Cambridge. AND FURTHER THAT the results of the Municipal Class Environmental Assessment Study wastewater servicing plan to accommodate the Conestoga College South Campus lands and the Blair Industrial lands are reported back to Kitchener's City Council prior to the issuance of the Study findings being posted for the mandatory 30 day public review period. BACKGROUND: In February 2009, the City staff was approached by Conestoga College and the City of Cambridge to explore the potential to service the proposed South Campus and Blair Industrial Lands. Conestoga College is proposing to construct a new south campus located on lands south of the Highway 401 at Fountain Street, directly across from the existing Doon campus. This phase of development will include buildings totalling approximately 24,155 m2 (260,000 ft2) situated on a 53.2 hectare (131.5 acre) site. The new campus will become the main site for Conestoga's School of Engineering and Information Technology and must be completed for full opening in August 2011. Private development interests are also exploring the viability to develop 5-1 business park lands to the south of the proposed campus accounting for a total serviced area of approximately 92.7 hectares (229.1 acres). It was identified that a viable option would be to direct sewage flows from Cambridge to the Kitchener, treating these sewage flows at the Kitchener Wastewater Treatment Plant. The purpose of this report is to seek Council direction and approval to proceed with a memorandum of understanding with City of Cambridge to facilitate servicing of the subject lands. REPORT: Staff from both municipalities have met over the past two years to consider various approaches to service the subject lands south of the Highway 401 at Fountain Street. The Region of Waterloo's Wastewater Treatment Master Plan, approved by Regional Council in July 2007, identifies future sanitary sewage generated from the subject lands to be directed to the Kitchener Wastewater Treatment Plant. The subject lands include approximately 92.7 hectares (229.1 acres) of serviceable area and are located in the City of Cambridge, south of Highway 401 at Fountain Street. It is estimated that the servicing of said lands will account for approximately 102.5 Its peak sewage flows based on light industrial development, amounting to less than 1.0% of the total rated capacity of the Kitchener UvvvTP. It is the opinion of the City Engineerthat this servicing can be accommodated at the Kitchener Wastewater Treatment Plant without compromising the development potential in the City of Kitchener. A sanitary servicing study should be undertaken in accordance with the Municipal Class Environmental Assessment (EA) document for municipal projects in order to determine the preferred design alternative. A series of routing alternatives will be explored in order to extend sanitary services across the Highway 401 through the City of Kitchener and directing sanitary sewer flows to the Kitchener Wastewater Treatment Plant, located on Mill Park Drive. The City of Cambridge will be the proponent of the Municipal Class EA Study because it is expected that the proposed infrastructure will be constructed within the City of Cambridge's right of way and is driven by the servicing needs of the lands located in Cambridge. Coupled with this aspect, the study involves works and servicing within two (2) municipalities which requires the City of Cambridge to be a proponent of the Class EA. The Class EA will begin in June 2009 with expected completion in November 2009 in order to meet the College's timelines for the opening of the south campus. A technical advisory committee will be established for the Class EA Study and will include representatives from the City of Kitchener, City of Cambridge, Region of Waterloo, Ministry of Transportation, Conestoga College and Millgate Holdings Inc. MTE Consultants Inc have been hired to provide professional services to the City of Cambridge in order to complete the Class EA Study. Awork plan is attached in Appendix "B" of this report. FINANCIAL IMPLICATIONS: This study was not included in the City's 2009 ten year capital forecast and as such the Study costs incurred by the City of Kitchener will be the responsibility of the City of Cambridge. Ultimately, the Cities of Kitchener and Cambridge will enter into across-border servicing agreement to handle and pay for the sewage flows being conveyed to and treated at the Kitchener Wastewater Treatment Plant. Kitchener has several cross-border agreements already in place with Waterloo, Cambridge, Woolwich Township and Wilmot Township. 5-2 COMMUNICATIONS: Engineering Services Division staff have met three times over the last year with City of Cambridge staff, along with Conestoga College and Millgate Holdings Inc. (owner of the Blair Industrial lands). A letter from Conestoga College was received on May 5t" 2009 requesting consideration by Council be given to accommodating for sanitary servicing from Cambridge to Kitchener (see attachment 1). The City of Cambridge has entered into an agreement with the landowners in accordance with the land purchase agreement and these landowners have agreed to pay for the study costs and is included in the May 13t" letter to the City of Kitchener. In this letter, it states that the City of Cambridge will be acting as the environmental assessment proponent, and requests that a memorandum of understanding between the Cities of Kitchener and Cambridge be created in order to provide for amulti-jurisdictional servicing plan (attachment 2). A follow-up letter stating the City of Cambridge Council's adopted resolution of May 11t" was also received (attachment 3). CONCLUSION: A request from the City of Cambridge to enter into a memorandum of understanding with the City of Kitchener related to the provision of multi-jurisdictional wastewater servicing plan to accommodate the Conestoga College South Campus lands and the Blair Industrial lands has been received. It was identified that a viable option would be to direct sewage flows from Cambridge to the Kitchener, treating these sewage flows at the Kitchener Wastewater Treatment Plant. The discharge of sanitary flows can be accommodated at the Kitchener Wastewater Treatment Plant and a servicing study will be conducted in accordance with the Municipal Class Environmental Assessment process to determine the most viable option for servicing design and routing in cooperation with the City of Cambridge. Based on an approved design approach, the Cities of Kitchener and Cambridge would enter into across-border servicing agreement to handle and pay for the sewage flows being conveyed to and treated at the Kitchener Wastewater Treatment Plant. Further, a servicing agreement between the Cities of Kitchener and Cambridge would be required. STUDY PR~~~NENT The Municipal Class Environmental Assessment as amended in ~O.g~ states proponent means: "The Municipality ar Public Utilities Corimission which is carrying out the project or which is ultimately responsible for the works constructed by the private secta~'. The City of Cambridge will be the proponent of the Class E.A. Study because i# is expected the infrastructure tv be constructed will be maintained by the City of Cambridge. Also, the study involves works and services within two municipalities and the City of Kitchener staff would prefer to have the City of Cambridge act as the proponent. Study, Schedule `B' Page 3 CONSULTANT SELECTION The land owners have hired the consulting firm of MTE Consultants Inc. far the professional engineering services to complete this Class EA Study. The firm was hired prior to the City of Cambridge being identified as the proponent far the Class EA Study. MTE Consultants Inc, has completed similar study projects and has experience in the Municipal Class Environmental Assessment documents. MTE Consultants Inc. has prepared a work schedule and a cost estimate of 8g,~1.aD, plus Q.S.T., for the study. The schedule and cost has been attached as Appendix "~' of this report. Staff is recommending that an exemption be granted from the Caty's Purchasing By-law to permit MTE Consultants inc. to be hired for professional services an the study subject to the CitylOwners financial agreement being in place. City of Kitchener staff have no issues with the consulting firm. CITY ~~ I~CITCHENER C~M1I~ENTS Planning staff had various meetings in the past two years with Kitchener staff with respect to sanitary sewer servicing needs of the subject lands. Kitchener staff is aware of the needs and circumstance far the usage of Kitchener's infrastructure. It was also identified that this procedure and interdependency on infrastructure is not new between the municipalities. The Gateway Development on ~Id King Street in Kitchener outlets to the sanitary sewer on Shang Hill and is being treated at the Preston vl~astewater Treatment Facility. Kitchener staff has requested an official letter from the City of Cambridge forthe intent and scope of the Sanitary Sewer Servicing Class EA Study for the City of Kitchener' acceptance. Staff i also recommending that the City of Kitchener be farrnally requested to allocate sanitary sewage treatment capacity at the Kitchener vl~aste vvater Treatment plant to accommodate these lands. Study -Schedule `B' THAT the City of Cambridge act as the Proponent far the Conestoga College South Campus and Blair Industrial Lands Sanitary Sewer Servicing Class E.A. Study, Schedule `B'; AND THAT the Mayor and Clerk be authorized to enter into an agreement with Conestoga College and Millgate Holdings Inc. whereby the costs of preparing the Sanitary Sewer Servicing Study be the responsibility of Conestoga College and Mitigate Holdings Inc.; AND THAT notwithstanding the City of Cambridge's Purchasing By-law, the consulting firm of MTE Consultants 1nc., be hired #or professional engineering services to complete the servicing study; AND THAT the City of Cambridge formally request the City of Kitchener to allocate sewage treatment capacity at the Kitchener 1lvaste uVater Treatment plant to accommodate the Conestoga College South Campus lands and Blair Industrial lands; AND FURTHER THAT City staff continue to advise and consult with the City of Kitchener regarding the Sanitary Sewer Servicing Study and EA.
