Request for Reduced Fee - Joseph Schneider Haus - Heart
and Hand Festival - September 19, 2009
RECOMMENDATION:
That the licence fee for the Heart and Hand Festival on September 19, 2009 taking place at the
Joseph Schneider Haus be reduced to $42.80.
BACKGROUND:
Chapter 549 (Itinerant-Temporary Vendor Permanent-Temporary Markets) of the Municipal
Code states in Section 549.1.5 that a Temporary Retail Market Licence is required for a show
with 5 or more vendors selling their own goods or services. The licence fee is $428.00.
Chapter 501 (Business Licence Fees) states in Section 501.2.5 that where an application is
made for a licence by a recognized, registered bona fide charitable organization, the fee to be
paid shall be 10% of the fee that would otherwise be payable. In cases of doubt as to the
application of this section, the Manager of Licensing shall refer the application to Council for a
decision. In regards to this request, the “charitable” provision does not apply, as each vendor
will keep the proceeds from any sales they make.
REPORT:
A request has been received from Antoinette Duplessis, Curatorial Assistance of Joseph
Schneider Haus requesting Council to reduce the required licence fee of $428.00 to the nominal
fee of $42.80.
This request has been granted each year, except in 2003 when the full licence fee was required.
The Heart and Hand Festival event on Saturday, September 19, 2009 will involve approximately
20-25 vendors selling crafts and offering unique items for sale. The sale will take place outside
on the museum grounds. The museum will raise funds by renting tables and space to the
vendors and each vendor will sell their goods, retaining all monies from the sale.
If the museum was conducting the sale, or instituted a system to process the sale through their
gift shop, a licence would not be required, but the museum does not wish to pursue this option.

FINANCIAL IMPLICATIONS:
Business licence revenue will be reduced by $385.20.
