(PIN 22504-0066 LT) to legalize the existing fence, sheds, and landscaping encroachments which encroach approximately 42.84 m2, more or less, onto the Iron Horse Trail, the gravel driveway access encroachment which encroaches for a width of approximately 3.66m, more or less, onto the Iron Horse Trail, and a paved driveway access and parking space which encroaches for a width of approximately 4.27m, more or less, onto the City's road allowance described as PIN 22504-0167 LT." BACKGROUND: The property owners of 93 Stirling Ave. S. would like to legalize the existing encroachments. There is currently an existing fence, two sheds, various landscaping and a gravel driveway access located on the Iron Horse Trail. There is also a paved driveway access, including a parking space, to the property which is located in a portion of the City's road allowance described as PIN 22504-0167 LT. REPORT: The property owners of 93 Stirling Ave. S. approached the City to request legalization of the existing encroachments. This request is further to a letter that they received from the Enforcement Division advising that an encroachment on the Iron Horse Trail existed and that the encroachment was to be removed or that satisfactory arrangements were to be made. B.2 - 1 There is an existing fence, two sheds and landscaping encroachments which encroach approximately 42.84 m2, more or less, onto the Iron Horse Trail and a gravel driveway access which encroaches for a width of approximately 3.66m, more or less, onto the Iron Horse Trail. There is also a paved driveway access, including a parking space, which encroaches for a width of approximately 4.27m, more or less, onto the City's road allowance described as PIN 22504- 0167 LT. Attached is a plan illustrating the location and dimensions of the encroachments. The Zoning Division has advised that a minor variance for the parking space in the paved driveway access if it is retained. FINANCIAL IMPLICATIONS: N/A CONCLUSION: The appropriate staff has reviewed this request and has no concerns with the location of the existing fence, sheds, landscaping and driveway accesses subject to obtaining the minor variance required for the paved driveway access.
