McCrea, Assistant City Solicitor (Ext -2266) WARD(S) INVOLVED: DATE OF REPORT: Wednesday, June 17, 2009 REPORT NO.: CRPS-09-094 SUBJECT: RELEASE OF POTENTIAL ENCROACHMENT - 93/95 KING STREET WEST RECOMMENDATION: That the Mayor and Clerk be authorized to execute an agreement, satisfactory to the City Solicitor, with the owner of 93195 King Street West to release a potential encroachment onto King Street. BACKGROUND: During the reconstruction of King Street West it was discovered that the basement of the property known as 93195 King Street West projects beyond its property line into the King Street road allowance. City staff has determined that it would be appropriate to remove the basement projection from the road allowance during the reconstruction activities. REPORT: Following the discovery of the basement projection at 93/95 King Street West, City staff conducted further investigations and discussions with the property owner. Based on the best available information it appears that the basement projection was built at the same time as the building in 1909. The owner is agreeable to releasing any rights to an encroachment on the City road allowance it may have and to have the projection removed. FINANCIAL IMPLICATIONS: The costs to address this basement projection will be paid for from the King Street Reconstruction project budget.
