BACKGROUND: The subject property is located at 1270 Fischer Hallman Road. The subject lot has 64.0 metres of frontage on Fischer Hallman Road and is located 100 metres south of Bleams Road. The property contains a single detached dwelling that was constructed in approximately 1961. An addition was constructed to house a printing establishment which is currently in operation. The property is designated as Business Park in the Official Plan and is currently zoned Restricted Business Park (B-2). REPORT: 1. Planning Comments The purpose of the application is to rezone the lands to Business Park Service Centre (B-3) to allow for a restaurant use on the property. The applicant has requested the zone change to allow for a hot dog vending stand on the site, which is classified as a restaurant in the Zoning Bylaw. Official Plan Conformity and Zoning By-law Amendment The City's Official Plan designates the subject property as Business Park which encourages technical andlor scientific businesses such as computer, electronic, data processing, and research and development firms. Certain key locations on the perimeter of the Business Park which are at intersections of Primary, Secondary or Trunk Roads perform more of a service function by concentrating a range of commercial and support operations which primarily serve the needs of the industrial community. According to Zoning By-law 85-1, the subject property is zoned Restrictive Business Park (B-2). This zone permits a range of uses including Biotechnological Establishment, Building Material and Decorating Supply Sales, Commercial Parking Facility, Computer, Electronic or Data Processing Business, Day Care Facility, Dwelling Unit, Educational Establishment, Industrial Administrative Office, Laboratory, Manufacturing, Printing Establishment, Religious Institution, Repair Service, Research and Development Establishment, Sale, Rental or Service of Business Machines and Office Supplies, Sale, Rental, Storage or Service of Tools and Industrial, Farm or Catering Equipment, Scientific, Technological or Communications Establishment, Security or Janitorial Services, Service, Storage or Repair of Motor Vehicles or Major Recreational Equipment, Surveying, Engineering, Planning or Design Business, Tradesman or Contractor's Establishment, Transportation Depot, Truck Transport Terminal, Veterinary Services, Warehouse, and Wholesaling. The proposed Business Park Service Centre (B-3) district permits all uses noted in the B-2 zone, as well as beverage and beverage-making equipment sales, carwash, commercial recreation, commercial weighing, convenience retail, craftsman shop, exhibition facility, financial establishment, funeral home, garden centre and nursery, gas station, health clinic, health office, hotel, office, personal services, private club or lodge and union hall, restaurant, sale and storage of heating fuel, sale of monuments, sale, rental, storage service, storage or repair of motor vehicles or major recreational equipment and Parts and Accessories for Motor Vehicles or Major io-2 Recreational Equipment, sale, rental, storage or service of tools and industrial, farm or catering equipment, sale of pets and pet supplies, sale of sporting goods, and studio. These uses are consistent with the Business Park designation. The hot dog vending stand will serve as a support business in the Business Park district and is easily accessible by major arterial roads. In the opinion of Planning staff, the proposal conforms to the Official Plan. Compatibility and Character The subject proposal is to allow for the development of a hot dog vending business on the property. It is Planning staff's opinion that the applicant's plans are small in scale and will be compatible with the surrounding area. The proposed development of the property with a hot dog vending cart is deemed "Not Development" by the Supervisor of Site Development and therefore the project is not subject to Site Plan approval. The project is small in scale and will only operate seasonally. The proposed development does not create an increase in the amount of required for off-street parking. 2. Property Owner Comments No property owner comments were received. 3. DepartmentlAgency Comments The application was circulated to all applicable agencies and internal departments and eight responses were received. Respondents include the Grand River Conservation Authority, the Regional Municipality of Waterloo, Waterloo Catholic District School Board, Waterloo Region District School Board, as well as four internal departments, specifically Engineering, Building, Transportation Planning, and Community Services. The City of Kitchener's Engineering Department is in support of the proposed zone change and development, but states that any further changes, other than the proposed hot dog vending stand] to the site plan will not be supported by Engineering as there are no municipal services available until the Strasburg Trunk Sanitary Sewer is extended and other municipal services become available. Further, any site plan application other than a hot dog stand will require a sanitary, watermain, and storm connection. Services will not be available until the surrounding development proceeds. The City's Transportation Planning Department commented that prior to the approval of the zone change, the applicant be required to submit a site plan showing how the site will operate in terms of access, traffic circulation, and on-site parking. Transportation Staff have since reviewed the proposed parking plan and are satisfied that it is acceptable and that all required parking has been provided. The Regional Municipality of Waterloo commented that they have no objection to the proposed zone change application, but that Regional staff will provide comments on the proposed hot dog vending stand development during the Site Plan process. Specifically, the Region will comment with regard to vehicle access and on-site parking. The Region will require that a road salt management plan be completed prior to Site Plan approval. Regional staff also commented that no service connections to the Regional watermain located on Fischer Hallman Road would be permitted and that the subject property is within a Sensitivity 4 Wellhead Protection Area designated in the Regional Official Policies Plan. Regional development charges will apply. The Region provided revised comments on May 27, 2009 after being advised that the proposed development would be deemed "Not Development" by the City's Supervisor of Site Development. Regional Transportation Planning Staff are satisfied that the safety concerns identified earlier by Regional Staff regarding the off-street parking and potential traffic problems 10-3 on Fischer Hallman Road have been addressed and resolved by the City. The Region is satisfied with the new revised parking plan which illustrates six (6) off-street parking spaces and the proposed location of the hot dog vending cart. At the request of City Staff, Regional Staff have revisited the requirement for a Road Salt Management Plan and have waived this requirement. Regional Staff have further identified that at the time of any future planning application, the conveyance of an additional ten foot road widening along the frontage of the property will be required by the Region. The Region also notes that as required by City policy, any future develop of the property will require Site Plan Approval, at which time the Region reserves the right to request the aforementioned road widening. All comments previously made by the Region and not amended above are still considered to be valid. All of the comments received are attached hereto as Appendix "C." FINANCIAL IMPLICATIONS: No new or additional capital budget requests are expected with this recommendation. COMMUNICATIONS: Preliminary circulation of the original application was undertaken on December 17, 2008 to departments and agencies and all property owners within 120 metres of the site. Notice of the June 22, 2009 public meeting of the Development and Technical Services Committee will be advertised in The Record on May 29, 2009. A copy of the advertisement is attached as Appendix "B". CONCLUSION: In summary, the Department of Development and Technical Services recommends that Zone Change Application ZC08127/FIGS be approved in the form shown in the "Proposed By-law", dated May 20, 2009. This should be addressed as part of any stormwater management and site plan required for development of the site.
