CITY OF KITCHENER
Heritage Kitchener met this date, chaired by Mr. R. Dyck, commencing at 4:10 p.m., with the following
members present: Messrs. F. Bishop, J. Kerr, K. Kirby and E. Lucy.
Others Present: Ms. D. Gilchrist and Mr. L. Bensason.
Mr. R. Dyck was appointed Acting Chair for this meeting, in the absence of Co-Chairs Councillor M.
Galloway and Mr. Z. Janecki.
A quorum of the Committee was not in attendance, and the Committee Administrator noted that should
any recommendations be forwarded from this meeting to the March 17, 2003 Council meeting, Council
will be advised of the lack of quorum.
1. APPOINTMENT OF NEW HERITAGE KITCHENER MEMBER
On motion by Mr. K. Kirby -
it was resolved:
"That Jill Armstrong be appointed a member of Heritage Kitchener for a term to expire
November 31,2003, to fill the vacancy created by the resignation of Ron Green."
2. DTS-03-035 - HERITAGE PERMIT APPLICATION 2003-V-05 - 69 JOSEPH STREET
The Committee was in receipt of Development and Technical Services Department report DTS-
03-035, dated February 18, 2003, with respect to Heritage Permit Application 2003-V-05,
requesting permission to demolish the property municipally known as 69 Joseph Street, located
in the Victoria Park Area Heritage Conservation District. This property was constructed in 1972,
and has been associated with auto body repair for several years. The City intends to use this
property along with abutting properties to develop a proper entrance to Victoria Park, at the foot
of Gaukel Street.
On motion by Mr. F. Bishop -
it was resolved:
"That pursuant to Section 43 of the Ontario Heritage Act, Heritage Permit Application
HPA 2003-V-05 be approved to permit the demolition of 69 Joseph Street, located within
the Victoria Park Area Heritage Conservation District."
REQUIRED AMENDMENT TO BY-LAW 92-242 - DESIGNATING 115 WOODSIDE AVENUE
PURSUANT TO PART IV OF THE ONTARIO HERITAGE ACT
The Committee was provided with copies of a memorandum from Mr. L. Bensason, dated March
4, 2003, explaining that By-Law 92-242, designating 115 Woodside Avenue (Harry Class Pool)
as being of historic and architectural significance pursuant to the Ontario Heritage Act, was
registered on title to lands extending beyond that property. A request has been received from the
owners of 130 Highland Road West to amend the designating by-law so as not to be registered
against the title of their property.
On motion by Mr. K. Kirby -
it was resolved:
"That Staff be directed to take the necessary steps to amend the legal description
contained in Schedule 'A' of By-law No. 92-242, which designates the Harry Class Pool
pursuant to Part IV of the Ontario Heritage Act, so that the designation applies only to the
land municipally known as 115 Woodside Avenue [PIN 22498-0029(LT)]."

4. HERITAGE PERMIT APPLICATIONS 2003-V-04 AND 2003-V-06 - 14 AND 18 BUERKLE
COURT
The Committee was in receipt of Development and Technical Services Department report DTS-
03-034, dated February 18, 2003, with respect to Heritage Permit Application 2003-V-04
requesting permission to construct a new single family dwelling and garage at the property
municipally known as 14 Buerkle Court, located in the Upper Doon Heritage Conservation
District.
The Committee was in receipt this date of a facsimile from Monarch Construction, dated
February 26, 2003, containing Heritage Permit Application 2003-V-06 requesting permission to
construct a single family dwelling and garage at the property municipally known as 18 Buerkle
Court. Attached to the Heritage Permit Application were elevation drawings, a floor plan and site
plan.
For both Heritage Permit Application 2003-V-04 and Heritage Permit Application 2003-V-06, the
Committee had been provided with a list of building materials and colours. Mr. Jerry Vernhout,
Monarch Construction, was in attendance to represent these applications and answer any
questions the Committee might have in this regard. He displayed samples of the building
materials and colours.
Mr. Bensason displayed images of the location of these two lots which are adjacent to each
other. He noted that a required landscape buffer will be located at the rear of these two lots, and
noted the staff recommendation includes a condition that the landscaping buffer be installed by
June 1,2003, should the Committee choose to recommend approval of these applications.
On motion by Mr. J. Kerr -
it was resolved:
"That pursuant to Section 43 of the Ontario Heritage Act, Heritage Permit Application
2003-V-04 be approved to permit the construction of a new single family dwelling on Lot
63 of Registered Plan 58M-226 (14 Buerkle Court), located in the Upper Doon Heritage
Conservation District, as shown on the plans submitted with the application, subject to the
subdivider installing the required landscaping as per the approved landscape easement
plan by June 1,2003, and use of the following building materials and colours:

64 of Registered Plan 58M-226 (18 Buerkle Court), located in the Upper Doon Heritage
Conservation District, as shown on the plans submitted with the application, subject to the
subdivider installing the required landscaping as per the approved landscape easement
plan by June 1,2003, and use of the following building materials and colours:

5. HERITAGE WEEK EVENTS
Mr. Bensason displayed photographs of the Heritage Showcase which took place at Fairview
Mall on February 15, 2003, and the Mike Wagner Heritage Awards and Reception which took
place at City Hall on February 24, 2003, noting the success of both events.
6. CRITERIA FOR HERITAGE EASEMENT AGREEMENTS
The Committee was in receipt of a policy from the City of Peterborough Architectural Advisory
Committee with respect to categories for heritage designation. The Committee was provided this
date with additional information on heritage easements, as well as the City's new Heritage Tax
Refund Program.
Mr. Bensason advised that in order to qualify for the Heritage Tax Refund Program a property
must be designated pursuant to the Ontario Heritage Act, and be subject to a heritage easement
agreement. A heritage easement agreement is intended as additional protection to preserve the
best examples of heritage properties in the City.
Mr. Bensason asked Committee members to consider potential criteria for heritage easement
agreements which can be discussed in detail at the Committee's next meeting.
PROPOSED DEVELOPMENT - HOMER WATSON HOUSE AND GALLERY, 1754 OLD MILL
ROAD
Mr. Bensason advised of a pending Heritage Permit Application for the Homer Watson House
and Gallery which is designated pursuant to Part IV of the Ontario Heritage Act, and which is
subject to a heritage easement agreement. He requested two members of Heritage Kitchener
participate in a working group to review the proposal and the site, and Ms. J. Armstrong and Mr.
R. Dyck volunteered.
