SUBJECT: NO STOPPING -MARLBOROUGH AVENUE
RECOMMENDATIONS:
That the existing No Stopping Monday to Friday 8:00 a.m. to 9:00 a.m., 11:30 a.m. to 1:30
p.m. and 3:30 p.m. to 4:30 p.m. area on both sides of Marlborough Avenue from North
Avenue to the entrance to J.F. Carmichael Public School be amended to No Stopping
Monday to Friday 8:00 a.m. to 4:30 p.m.; and further,
That the Uniform Traffic By-law be amended accordingly.
BACKGROUND:
In a review of signing in school areas it was noted that there is a discrepancy between the
posted signs and the actual regulation as per the Uniform Traffic By-law on Marlborough
Avenue in the vicinity of J.F. Carmichael Public School. Transportation Planning Staff deems
that the signed regulations are appropriate and therefore in order to address enforcement
issues with regard to the discrepancy the Uniform Traffic By-law needs to be amended to reflect
no stopping signs that are currently posted.
REPORT:
On December 17, 1994 a report recommending the installation of no stopping signs on
Marlborough Avenue was approved by Council in order to address safety concerns with regard to
school related vehicular traffic at the then newly built driveway entrance to the school from
Marlborough Avenue. In order to limit the impact to local residents the no stopping was limited to
Monday to Friday from 8 a.m. to 9 a.m.,11:30 a.m. to 1:30 pm and from 3:30 p.m. to 4:30 p.m.

At some point since then the signs have been replaced by no stopping 8:00 a.m. - 4:30 p.m.
signs. This was done in order to have the corresponding posted regulations at this school the
same as at all schools in the City. As per the general provisions of the Uniform Traffic By-law any
portion of the roadway that is opposite the school frontage should have no stopping 8:00 a. m. -
4:30 p.m. signs. Transportation Planning endeavours to create consistency in that portions of
roadways adjacent to or near schools but not covered by the general provisions that require
posted no stopping regulations should have the same posted regulation. This creates an
environment that is predictable and consistent and assists By-law Enforcement Officers in their
endeavours. Marlborough Avenue presents such a case.
Further to this, the no stopping regulation that presently exists within the Uniform Traffic By-law
does not align with the bell times at the school. At this point bell times at the school are 8:55 a.m.
and 3:15 p.m. By having no stopping 8:00 a.m. to 4:30 p.m. regulations in place, any further
changes in bell times at the school would not necessitate potential changes in the By-law to align
no stopping regulations to bell times.
Therefore, in order to align the posted no stopping signs on Marlborough Avenue from North
Avenue to the entrance of J.F. Carmichael School with the regulations in the Uniform Traffic By-
lawthe By-law needs to be amended to no stopping 8:00 a.m. - 4:30 p.m., Monday to Friday.
COMMUNICATIONS:
None are required.
FINANCIAL IMPLICATIONS:
There is no cost associated with this proposed By-law amendment.
