HomeMy WebLinkAboutDTS-09-114 - Local Environmental Action Fund~~~~~~ Development & Technical Services REPORT T0: Development & Technical Services Committee DATE OF MEETING: August 10, 2009 SUBMITTED BY: Jeff Willmer, Interim General Manager, Development & Technical Services PREPARED BY: Barbara Steiner, Senior Environmental Planner (741-2293) WARD(S) INVOLVED: ALL DATE OF REPORT: August 5, 2009 REPORT NO.: DTS-09-114 SUBJECT: LOCAL ENVIRONMENTAL ACTION FUND (LEAF): AUTHORITY TO EXECUTE AGREEMENTS RECOMMENDATION: THAT the Mayor and Clerk be authorized to execute the 2009 Local Environmental Action Fund (LEAF) legal agreements with the organizations granted monies from LEAF, all such legal agreements to be subject to the satisfaction of the City Solicitor. BACKGROUND: In approving the application and evaluation process for LEAF as outlined in staff report DTS-08- 194, it was confirmed that all successful applicants would be required to enter into a legal agreement with the City setting out the terms and conditions of the LEAF grant. The application forms completed by the grantees also informed them of the requirement to enter into such agreements should their grant be approved. REPORT: A standard-form agreement for LEAF grantees has been drafted by the City Solicitor. Matters addressed include those identified as grantee requirements in DTS-08-194 and in the application forms completed by the grantees-i.e. • Any funding awarded will be for definite purposes, and for projects l programs covering a specific time period • Grantees must recognize the City's contribution in any promotional literature or material. A copy of such literature or material must be submitted to the City and developed in accordance with the City of Kitchener Corporate Standards Manual. • Funding must be used for the purposes for which they were awarded. Any change in funding use requires written notification to, and approval by, the City. 8-1 • The City reserves the right to terminate the release of funds to an applicant should information come to light which indicates that the funds are not being spent in accordance with the terms under which they were secured. • Reporting requirements of the grantee for monitoring purposes and measuring success. Work programs for the project or program funded by LEAF, and as proposed by the grantee in their application or amended by subsequent mutual agreement, will be attached to such agreements as a schedule.
