EXEMPTION TO CHAPTER 210 MUNICIPAL CODE
(CEMETERIES BY-LAW)
RECOMMENDATION:
That an exemption be granted from the requirements of Section 11.8 of Chapter 210 of the
Municipal Code (Cemeteries By-Law) to allow a non-conforming monument to be placed in the
Children’s Section, Lot 41, of Williamsburg Cemetery.
BACKGROUND:
A monument for a child has been completed and paid for through donations, and is to be
installed at the Williamsburg Cemetery. The monument does not conform to the requirements of
Section 11.8 of Chapter 210 of the Municipal Code (Cemeteries), in that it does not have a base
that is separated from the monument, with a two inch polished margin on all sides of the base.
The monument instead has a pedestal structure.
REPORT:
The family of the deceased child has viewed the monument and is anxious to proceed with the
installation. Due to the sensitive circumstances of this matter, City staff would also like to
proceed with the installation of the monument.
FINANCIAL IMPLICATIONS:
None
CONCLUSION:
An exemption to Section 11.8 of Chapter 210 of the Municipal Code (Cemeteries) is appropriate
given the circumstances of this matter.
