CITY OF KITCHENER
A special meeting of City Council was held at 1:24 p.m. this date, chaired by Mayor C. Zehr with all
members present except Councillors B. Vrbanovic and G. Lorentz.
Notice of this meeting had been previously given to all members of Council by the City Clerk pursuant
to Chapter 25 (Council Procedure) of the Municipal Code.
Mayor C. Zehr advised of a request from staff that Council consider Community Services Department
report CSD-09-042 (P. Houston), dated August 7, 2009, regarding an exemption to Chapter 210
(Cemeteries By-law) of the Municipal Code.
Moved by Councillor K. Galloway
Seconded by Councillor C. Weylie
"That pursuant to Chapter 25 (Council Procedure) of the Municipal Code the following matter
be added to the agenda of the special meeting of Council this date:
• Consideration of Community Services Department report CSD-09-042 (P. Houston), dated
August 7, 2009, regarding an exemption to Chapter 210 (Cemeteries By-law) of the
Municipal Code."
Carried Unanimously by those present.
Council considered the tenders approved in accordance with Chapter 115 (Corporate Management
Team) of the Municipal Code by the Chief Administrative Officer during Council's summer recess.

"That Council ratify the Chief Administrative Officer's decision, undertaken according to policy
respecting Council's summer meeting schedule, awarding Tenders /Expressions of Interest /
Quotations, as follows:

Awarded to: Capital Paving Inc., Guelph ON
Tender price: $1,186,056.55, including provisional items and contingencies of

Carried.
Mayor C. Zehr advised of an additional item for in-camera discussion this date regarding a business
licence issue subject to solicitor-client privilege.

Seconded by Councillor C. Weylie
"That an in-camera meeting of City Council be held this date to consider a labour relations
matter, two matters subject to solicitor-client privilege and alitigation /potential litigation matter
which is also subject to solicitor-client privilege."
Carried.
The meeting then recessed at 1:28 p.m. and re-convened at 6:16 p.m., chaired by Mayor C. Zehr and
with all members present except Councillor G. Lorentz.
Council considered Community Services Department report CSD-09-042 (P. Houston), dated August
7, 2009, regarding an exemption to Chapter 210 (Cemeteries By-law) of the Municipal Code.

Seconded by Councillor J. Smola
"That an exemption be granted from the requirements of Section 11.8 of Chapter 210 of the
Municipal Code (Cemeteries By-law) to allow anon-conforming monument to be placed in the
Children's Section, Lot 41, of Williamsburg Cemetery."
Carried.
Council considered a recommendation arising from Finance and Corporate Services Committee
meeting held this date regarding an exemption to Chapter 450 (Noise) of the Municipal Code.

Seconded by Councillor J. Smola
"That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted
to the Wyandotte Warriors for a street party on Wyandotte Court on August 15, 2009, between
the hours of 2:00 p. m. and 10:00 p. m."
Carried.
Council considered a recommendation arising from Finance and Corporate Services Committee
meeting held this date regarding the appointment of the Municipal Auditor.

"That proposal P09-051, Audit Services, be awarded to KPMG LLP, Waterloo at their proposed
price of $769,260. plus applicable taxes, for a term of five years for the fiscal periods 2009
through 2013; and further,
That section 1.1 of Chapter 103 (Auditor) of the City's Municipal Code be amended to effect
the appointment of KPMG LLP as the City's Auditor."
Carried.
Council considered a recommendation arising from Finance and Corporate Services Committee
meeting held this date regarding sole sourcing for an Organizational Design Review.
Moved by Councillor B. Vrbanovic
Seconded by Councillor J. Smola
"That the consultant selection requirements of the Purchasing By-law be waived and Western
Management Consultants be retained to undertake an Organization Design Review for the
City, for a fee not to exceed $45,990. based on a satisfactory contract being negotiated; and
further,
That the Mayor and Clerk be authorized to execute an agreement, satisfactory to the City
Solicitor, with Western Management Consultants to undertake the Organization Design
Review."
A recorded vote was requested.

Council agreed to the request of Mr. R. Gosse, City Clerk, to add an additional by-law for three
readings this date, being the appointment of a Municipal Auditor.

"That leave be given the Mover and Seconder to introduce the following by-laws for three
readings and that the same be taken as read a first, second and third times, be finally passed and
numbered serially by the Clerk.
(a) Being a by-law to exempt certain lots from Part Lot Control -Part of Lots 92, 93, 96, 97,
100, 101, 102, 105 to 109 inclusive, 112 and 113, Registered Plan 58M-472 -Sorrento
Street.
(By-law No. 2009-106)
(b) Being a by-law to amend Chapter 101 of the City of Kitchener Municipal Code with respect
to Appointment of Staff.
(By-law No. 2009-107)
(c) Being a by-law to amend Chapter 110 of the City of Kitchener Municipal Code regarding
By-law Enforcement.
