Gosse, Director of Legislated Services/City Clerk PREPARED BY: Patricia Harris, Manager of Licensing WARD(S) INVOLVED: 3 DATE OF REPORT: August 17, 2009 REPORT NO.: CRPS-09-113 SUBJECT: REQUEST FOR REDUCED FEES -ONTARIO INTERCOLLEGIATE WOMEN'S FASTPITCH ASSOCIATION RECOMMENDATION: That the licence fees for the 2009 Canadian University Fastpitch Championships from October 9-12, 2009 at Peter Hallman Ball Yard be reduced to $41.60 for a Temporary Vendor Licence and $24.80 for a Transient Photographer's Licence, provided all approvals are obtained. BACKGROUND: Chapter 549 (Itinerant-Temporary Vendor Permanent-Temporary Markets) of the Municpal Code states in Section 549.1.5 that a Temporary Vendor is any person who sells goods or services in the municipality for less than 250 days in a calendar year. The licence fee is $416.00. Chapter 501 (Business Licence Fees) states in Section 501.2.5 that where an application is made for a licence by a recognized, registered bona fide charitable organization, the fee to be paid shall be 10% of the fee that would otherwise be payable. Incases of doubt as to the application of this section, the Manager of Licensing shall refer the application to Council for a decision. In regards to this request, the "charitable" provision does not apply, as the vendor and photographer are keeping a share of the profits. REPORT: A request has been received from Matt Allen, representative of the Ontario Intercollegiate Womens Fastpitch Association and the Host Committee of the 2009 Canadian University Fastpitch Championships to reduce the required licence fees of $416.00 for a Temporary Vendor Licence and 248.00 for a Transient Photographer's licence. This is the second year the Canadian Championships have been held at the University Level. However, Women's Fastpitch is not recognized as a varsity sport and, therefore, does not receive any funding from their respective athletic departments. All funding comes out of the student athletes pockets. Both the vendor and photographer have agreed to share any profits with the Association in order to reduce the costs of the tournament to the student athletes. 10-1 FINANCIAL IMPLICATIONS: Business licence revenue will be reduced by $597.60.
