HomeMy WebLinkAboutCouncil - 2009-09-14 S SPECIAL COUNCIL MINUTES SEPTEMBER 14, 2009 CITY OF KITCHENER A special meeting of City Council was held at 1:06 p.m. this date, chaired by Mayor C. Zehr with all members present except Councillor G. Lorentz. Councillor K. Galloway was in attendance for part of the meeting. Notice of this special meeting had been previously given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. Mayor C. Zehr advised that in regard to the item concerning the Barra Castle, 393-411 Queen Street South, there are two recommendations for Council’s consideration: a recommendation to identify the property as being of very high cultural heritage value which was deferred from the August 24, 2009 Council meeting; and, the recommendation from Heritage Kitchener to approve a permit to demolish parts of the Barra Castle. Mr. Leon Bensason, Interim Manager, Long Range Planning, advised that staff is in support of the two recommendations. Mr. Paul Puopolo, owner and applicant, gave a presentation showing the condition of various sections of the building and advised he was in support of the two recommendations. Councillor J. Gazzola advised that when this matter was dealt with by Heritage Kitchener, there were some members who raised concerns with only the front part of the building being saved, however, it was shown that the deterioration of the other parts of the building have progressed too far. Moved by Councillor J. Gazzola Seconded by Councillor B. Vrbanovic “That the property municipally addressed 393-411 Queen Street South (commonly known as the Barra Castle) and located within the Victoria Park Heritage Conservation District, be identified as a property of very high cultural heritage value or interest, for the purpose of enforcement under the Property Standards for Maintenance and Occupancy by-law, as outlined in Development and Technical Services Department report DTS 09- 073.” Carried. Moved by Councillor J. Gazzola Seconded by Councillor B. Vrbanovic “That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application HPA- 2009-V-010 be approved to permit the demolition of the sections of 393-411 Queen Street South (Barra Castle building) known as the middle, back, annex and south-west balcony, in accordance with the Heritage Impact Assessment submitted with the application, subject to the following condition: i) That photo documentation of the building be undertaken, in accordance with the City’s Photo Documentation and Recording Guidelines, and submitted to heritage planning staff prior to the issuance of a building permit; and, ii) That modified measured drawings/photographs of the exterior of the front section of the building, including the south-west balcony, be prepared and submitted to heritage planning staff prior to the issuance of a building permit; and, further, iii) That the final building permit drawings be reviewed and heritage clearance issued by heritage planning staff prior to the issuance of a building permit.” Carried. Moved by Councillor B. Vrbanovic Seconded by Councillor J. Smola "That an in-camera meeting of City Council be held this date to consider a personal matter and a matter subject to solicitor-client privilege." Carried. SPECIAL COUNCIL MINUTES SEPTEMBER 14, 2009 - 241 -CITY OF KITCHENER Councillor J. Gazzola raised a concern that although the personal matter listed on the in-camera agenda was appropriate for closed session discussion, there may be certain aspects of that matter that should be discussed in open session. Mayor C. Zehr advised that for the purposes of the closed session only those aspects of the matter dealing with identifiable persons would be discussed. The meeting then recessed at 1:20 p.m. and re-convened at 7:01 p.m., chaired by Mayor C. Zehr will all members present except Councillor G. Lorentz. Mayor C. Zehr advised that notice was given in the newspaper that Council will be considering a by- law to close a portion of Carisbrook Drive and he asked if there were any members of the public in attendance to speak for or against the proposed by-law. There were none. Moved by Councillor J. Smola Seconded by Councillor C. Weylie “That leave be given the Mover and Seconder to introduce the following by-laws for three readings and that the same be taken as read a first, second and third times, be finally passed and numbered serially by the Clerk. (a) Being a by-law to close and convey part of the public highway known as Carisbrook Drive in the City of Kitchener. (By-law No. 2009-122) (b) Being a by-law to amend Chapter 101 of the City of Kitchener Municipal Code with respect to Appointment of Staff. (By-law No. 2009-123) (c) To confirm all actions and proceedings of the Council. (By-law No. 2009-124).” On motion the meeting adjourned at 7:03 p.m. MAYOR CLERK
