SUBJECT: E09-054 -Construction Management Services -Consolidated
Maintenance Facility
RECOMMENDATION:
That Expression of Interest E09-054, Construction Management Services -Consolidated
Maintenance Facility, be awarded to Melloul-Blarney Construction Inc., Waterloo at their
estimated fee of $452,130., including a contingency of $105,000. and G.S.T., based on a
satisfactory contract being negotiated and an upset fee being established, and further that the
Mayor and City Clerk be authorized to execute an agreement satisfactory to the City Solicitor.
BACKGROUND:
The construction management firm will take on the role of "Constructor". The role involves
assuming responsibility for health and safety of the site, retaining and paying all sub-trades and
contractors and co-ordinating and supervising the contractors working on the site at any given
time.
City staff had considered that the City could accept this role as acost-saving measure for the
project. This was a role, however, for which the City had not previously taken responsibility.
Through discussions with general contractors, consultants, outside lawyers familiar with the
risks and issues involved as well as with internal staff, it was concluded that the City had
insufficient staffing and in-house back-up with the appropriate expertise to take responsibility for
the role. The City would need to retain outside contract staff as well as additional insurance to
mitigate the high risks associated with this role. Any cost savings that might have been realized
would be offset by the additional costs and potential risks. To protect the City's interests, the
decision was made to retain a construction management firm for this role.

REPORT:
In accordance with Chapter 170 of the Municipal Code pertaining to the Selection of
Professional ServiceslConsultants, a Consultant's Review Committee was established
consisting of H. Gross, Director, Project Administration & Economic Investment, C. Fletcher
Director of Facilities Management, L. Proulx, Construction Project Manager -C.M.F., and L.
Gordon, Chief Purchasing Officer.
Expressions of interest were requested from seven known firms and advertised in The Record,
on the City of Kitchener Home Page, and on the Internet through The Ontario Public Buyers
Electronic Tendering Information System. By the closing date of Wednesday June 10t", 2009,
seven (7) responses had been received.
The Review Committee met on Monday June 29t" to review the submissions. A shortlist of five
consultants was selected for further interviews. One firm withdrew from the interview process.
The Committee met on Monday July 6t", 2009 to interview the remaining four shortlisted
candidates. The Committee elected to award the project to Melloul-Blamey Construction Inc.,
Waterloo.
