McCrea, Assistant City Solicitor WARD(S) INVOLVED: 4 DATE OF REPORT: September 16, 2009 REPORT NO.: CRPS-09-127 SUBJECT: SALE OF PART OF PLAINS ROAD, CITY OF KITCHENER RECOMMENDATION: That the Mayor and Clerk be authorized to execute an Agreement of Purchase and Sale with Becker Estates Ltd., to purchase a portion of Plains Road in the City of Kitchener, containing approximately 1.02 hectares, to be conditional on the closure of the road and such other terms and conditions as are satisfactory to the City Solicitor. BACKGROUND: Becker Estates Ltd. is proposing to develop its lands located at the corner of Huron Road and Fischer Hallman Road in the City of Kitchener for a mixed use development. Part of Plains Road bisects their parcel of land. Becker Estates Ltd. have appealed their applications for official plan amendment, zoning by-law amendment and plan of subdivision to the Ontario Municipal Board for approval. The development proposal incorporates part of the lands of Plains Road and its commemoration as a heritage resource. Negotiations between City staff and representatives of Becker Estates Ltd. continue in order to resolve or reduce the outstanding planning issues. City staff reported to Development and Technical Services Committee on the proposed development and OMB appeals in Report No. DTS-09-133. An environmental assessment was completed on or about June 23, 2009 for the closure of the subject part of Plains Road and the recommendations of the environmental assessment have been incorporated into the conditions of draft plan approval. Ultimately, the remaining portion of Plains Road will connect directly to a street within the draft plan of subdivision. As anticipated by the development proposal Becker Estates Ltd. has submitted an offer to purchase that part of Plains Road that bisects their lands to be incorporated into their proposed development in accordance with the proposed conditions of draft plan approval. 5)-1 REPORT: Attached as Appendix `A' to this report is a sketch illustrating the portion of Plains Road to be closed and conveyed to Becker Estates Ltd. The principal terms and conditions of the offer to purchase may be summarized as follows: • Those portions of Plains Road to be incorporated into the Purchaser's development will be purchased (approximately 1.02 hectares/2.52 acres), save and except those portions to be included in neighbourhood parks to be commemorated as a heritage resource (approximately 0.37603 hectarel0.929 acres); • The purchase price will be the appraised fair market value; • All costs associated with the closure and conveyance of this part of Plains Road will be paid by the Purchaser; • The sale will be conditional upon satisfactory completion of the City's real property disposal procedures and the passage of a by-law to close the road pursuant to the Municipal Act, 2001; draft plan of approval of the Becker Estates Ltd. plan of subdivision 30T-07205, execution and registration of the subdivision agreement; and construction of the temporary turning circle at the terminus of the open portion of Plains Road. FINANCIAL IMPLICATIONS: The Purchaser will be paying the appraised fair market value for that part of Plains Road to be closed and incorporated into their development (save and except those portions to be included in neighbourhood commemoration parks) and all costs associated with the closure and conveyance of the road. COMMUNICATIONS: A Schedule B Class Environmental Assessment for the Closure of Plains Road was completed and filed with the Ministry of the Environment. The portion of Plains Road to be closed and sold pursuant to the offer to purchase from Becker Estates Ltd. has been incorporated into the draft plan of subdivision and draft conditions of approval under appeal to the Ontario Municipal Board for approval. Both of these processes involve notification to the public and relevant public agencies. Notice of a proposed by-law to close Plains Road will be given in accordance with the requirements of the Municipal Act, 2001 and the City's Municipal Code.
