MINUTES OFTHE REGULAR MEETING HELD SEPTEMBER 15, 2009

Mr. D. Cybalski, Chair, called this meeting to order at 10:00 a.m.
This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was
called to consider applications regarding variances to the City of Kitchener Sign By-law. The
Committee will not make a decision on these applications but rather will make a recommendation
which will be forwarded to the Committee of the Whole and Council for final decision.
The Chair explained that the Committee's decisions with respect to sign variances are
recommendations to City Council and not a final decision. He advised that the Committee's
recommendations will be forwarded to City Council on Monday September 21, 2009 at 7:00 p.m., and
the applicants may register with the City Clerk to appear at the meeting if desired.

The Committee was advised that the applicant is requesting permission for 4 fascia signs to
project 0.91 m (2.98') from the wall on which they are located rather than the permitted 0.4m
(1.31'). Three of these fascia signs will be located on the east elevation of the building and one
will be located on the west elevation.
The Committee considered the report of the Development and Technical Services Department,
dated September 4, 2009, advising that the subject is located at 1014 Victoria Street North
between River Road East and Frederick Street. It is zoned Service Industrial (M-3) in the
Zoning By-law and has an Official Plan designation of Arterial Commercial Corridor.
The applicant is requesting permission to construct fascia signs on the east and west side
elevation of the existing building with a projection of 0.91 metres from the wall rather than the
required maximum projection of 0.4 metres as required in Article 10, Section 680.10.2 of the
City of Kitchener Sign By-law.
In considering the requested variances to the City of Kitchener Sign By-law, Planning staff offer
the following comments.
The proposed variances meet the intent of the Sign By-law, which is to ensure the projecting
signs do not dominate the fagade of the building or surrounding streetscape. The fascia signs
are to be located on the east and west elevation of the existing building and do not front onto
Victoria Street North. The proposed signs appear to be appropriate in area and projection
considering the size of the building. Currently, the east side elevation of the building is bare and

unappealing. Staff feel that the signs are well designed and will significantly improve the fagade
of the building as well as its integration with its surrounding.
The proposed variances are appropriate for the development and use of the land for the
following reasons. The signage is appropriate for the size of the lot and the location of the
building. The signage is proposed on either side of the building and will not be projected onto
Victoria Street. It is staff's opinion that the proposed signs will not adversely affect the
streetscape of the surrounding industrial and commercial neighbourhoods.
The Committee considered the report of the Region of Waterloo Transportation Planner, dated
August 26, 2009, advising that they have no concerns with this application.

That the application of Home HardwarelFurniture requesting permission for 4 fascia signs to
project 0.91 m (2.98') from the wall on which they are located rather than the permitted 0.4m
(1.31'); three signs to be located on the east elevation of the building and one to be located on
the west elevation, on Lot 1, Plan 971, being Parts 6 & 7, Reference Plan 58R-14655, 1014
Victoria Street South, Kitchener, Ontario, BE APPROVED, subject to the following condition:
1. That the owner shall obtain a sign permit from the City of Kitchener prior to the erecting
of the signs.
It is the opinion of this Committee that:
1. The variance approved in this application is minor in nature.
2. This application is desirable for the appropriate development of the property.
3. The general intent and purpose of the Chapter 680 (SIGN) of the City of Kitchener
Municipal Code is being maintained on the subject property.
