SUBJECT: DECLARE LANDS SURPLUS OF VACANT LAND ON
FERGUS AVENUE, INCLUDING PART OF SOLON
AVENUE, CLOSED, FOR EASEMENT AND POSSIBLE
CONVEYANCE
RECOMMENDATION:
"That the lands located on Fergus Avenue, in the City of Kitchener, owned by the
Corporation of the City of Kitchener, described as Part of Farm Lot, Registered Plan 589
& Part of 1 foot reserve `A', Part of Lot 196, Streets & Lanes, Registered Plan 687, more
particularly described as Parts 1 -5 on Plan 58R- 16463, being Part of Solon Avenue, an
untravelled closed road allowance, be declared surplus to the City's needs for the
purposes of conveying an easement to Rogers over Parts 2 and 4 of Plan 58R- 16463, and
the possible future conveyance of Parts 1 — 5 on Plan 58R- 16463; and further;
That all costs associated with the closing and conveyance of that portion of Solon
Avenue are to be deducted from any future sale proceeds of said lands; and further;
That the Mayor and Clerk be authorized to execute any documentation in this regard
required by and to the satisfaction of the City Solicitor."
REPORT:
In the course of the City attempting to sell land it owned between 1334 -1336 Weber Street E.
and 101 Fergus Avenue, (See Schedule "A" attached) staff discovered a portion of road
allowance known as Solon Avenue (Parts 1 & 2 of Plan 58R -16463 that had never been closed
and accordingly, the sale of land could not continue until such time as that portion of road had
been closed.
It was further discovered that Rogers was going to require an easement and the existing cables
would encumber the lands in such a way that the lands would not be developable. We have
worked with Rogers to have the cables moved to the most southerly side of the property in order
to maximize the development potential of the lands. The reference plan has been registered
3 -1
(see Schedule "B" attached) and the City is now in a position to convey the required easement
to Rogers in order that the lands can be listed for sale.
That portion of Solon Avenue that was previously not closed, and was affecting the sale of the
lands has now been closed by By -law 2009 -125.
FINANCIAL IMPLICATIONS:
The City has incurred expenses in order to close the portion of Solon Avenue that remained
open and get the property to a state that the easement can be conveyed to allow the sale of the
subject lands. It would be recommended that the lands be sold, keeping in mind that the
expenses that have been incurred to date should be deducted from any sale proceeds.
CONCLUSION:
Staff recommends that Council direct Legal Services to proceed with the conveyance of the
required easement to Rogers and that Economic Development be directed to pursue the sale of
the lands known as Parts 1 -5, Plan 58R- 16463. Any future conveyance of the lands will be
submitted to Council for approval.
