BACKGROUND: Changes made to the Ontario Heritage Act through the passage of Bill 60, now afford municipalities the opportunity to list properties that have not been designated under the Act but that the municipality believes to be of cultural heritage value or interest on the Municipal Heritage Register. Further, the Provincial Policy Statement (PPS) issued under Section 3 of the Ontario Planning Act, has been amended and expands the definition of "built heritage resources" to include properties listed by local jurisdictions. Together, the amendments made to the Ontario Heritage Act and the Provincial Policy Statement of the Planning Act, offer an opportunity for the City of Kitchener to update the Heritage Kitchener Inventory of Historic Buildings and strengthen efforts to conserve property identified as being of cultural heritage value or interest to the municipality. On November 27, 2006 Council approved the process for listing non-designated property of cultural heritage value or interest on the Municipal Heritage Register, as outlined in Staff Report DTS 05-213. On January 12, 2009 Council approved the proposal to list 17 privately-owned properties as non-designated property of cultural heritage value or interest on the Municipal Heritage Register, as outlined in Staff Report DTS-08-179. REPORT: City Staff continue to work towards the implementation of the process for listing privately-owned non-designated property of cultural heritage value or interest on the Municipal Heritage Register. The process continues to ensure a thorough and objective evaluation of each property, and an opportunity for public input and consultation. The process involves the following four steps: 1. Initial evaluation by a recorder through completion of a survey form and taking photographs (only where properties are visible from the public realm). 2. Short listing of properties following a review of the recorder's survey form and photographs; undertaken by an evaluation sub committee comprised of City Staff and Heritage Kitchener Committee members. Heritage Planning staff prepare a `statement of significance' for each short-listed property and notify the property owner of the heritage interest in the property. Property owners are invited to make comment and attend the Heritage Kitchener meeting where their property will be considered for possible listing on the Municipal Heritage Register. 3. The City's Heritage Kitchener Committee reviews the merits of the short listed properties; considers the comments of the property owner (if made); and makes a recommendation to City Council. 4. City Council makes a decision on whether or not to list the properties on the Municipal Heritage Register as "non-designated property of cultural heritage value or interest." Listing non-designated property on the Municipal Heritage Register is an important step in identifying the City's cultural heritage resources. It does not impose restrictions or obligations with regard to obtaining heritage approvals, meaning property owners do not require a heritage permit or City approval to make alterations. Listing on the Municipal Heritage Register does increase the amount of time the City has to process demolition applications (up to 60 days), and does have implications in ensuring that the City is consistent with the Provincial Policy Statement when processing Planning Act applications. The properties municipally addressed 1000 Bleams Road; 35 Bridge Street West; 70 Francis Street North; 97 Frederick Street; Huron Road (Plan 585 Lots 18, 19, and 20 Part Lots 5, 6, 7, 8, 15, 16, and 21 SS Huron Road German Company Tract Part Lot 149); 83-85 King Street West; 87-91 King Street West; 93-95 King Street West; 97-99 King Street West; 103-109 King Street West; 709 King Street West; 149-151 Ontario Street North; 33 Queen Street South; 43 Queen Street South; 53-55 Queen Street South; 1738 Trussler Road; and 171-173 Victoria Street North have been recommended by both the recorder and the evaluation sub-committee to be listed as non-designated property of cultural heritage value or interest on the Municipal Heritage Register. As a result, the property owners have been formally notified of the heritage interest and invited to participate in Step 3 of the process. Step 3 involves the Heritage Kitchener Committee meeting scheduled for April 7t", where the properties will be considered for listing as non-designated properties of cultural heritage value or interest on the Municipal Heritage Register. FINANCIAL IMPLICATIONS: None. COMMUNICATIONS: An information package has been mailed to all affected property owners. The information package includes: a letter that describes the heritage interest in the property and the listing process, including how property owners can make comment; a copy of the Municipal Heritage Register brochure; and, a copy of the Statement of Significance which describes the historic place, identifies the key heritage values, and lists the principal heritage attributes. The Statement of Significance also includes photographs of the property and a copy of the Cultural Heritage Resource Evaluation Form, which was completed by the recorder and evaluation sub- committee. An information package was originally circulated to the property owner of 1738 Trussler Road last fall at which time the property owner wrote in support of the process but noted that the barn and driveshed described in the Statement of Significance were held under separate ownership. The proposal was deferred until both property owners were properly notified. Both property owners have now been properly notified. The property owner of Huron Road (Plan 585 Lots 18, 19, and 20 Part Lots 5, 6, 7, 8, 15, 16, and 21 SS Huron Road German Company Tract Part Lot 149) phoned to indicate that the municipal address and acreage on the Statement of Significance were incorrect. Heritage Planning staff have corrected this information and re- circulated arevised Statement of Significance to both property owners. No written comments were submitted in response to the information package distributed earlier this year. However, the property owner for 628 New Dundee Road phoned to discuss the proposal and requested additional information. In an effort to provide a reasonable amount of time to review and respond to the information, Heritage Planning staff have decided to defer consideration of 628 New Dundee Road until the June Heritage Kitchener meeting. Lastly, the property owner for 152 Shanley Street was circulated an information package; however, the information was returned indicating that the owner was unknown. Heritage Planning staff have chose to defer consideration for this property until the owner is notified of the process and provided the opportunity to participate and provide comment. CONCLUSION: Identifying specific local cultural heritage resources is a vital first step toward upholding the City's responsibility to protect and conserve its heritage. The building is situated on a 1.53 acre parcel of land located on the north side of Bleams Road between Washburn Drive and Trillium Drive in the Country Hills West planning community of the City of Kitchener within the Region of Waterloo. The principal resource that contributes to the heritage value is the fieldstone house. Heritage Value or Interest 1000 Bleams Road is recognized for its design, physical, historical and contextual values. The house is an example of the Georgian architectural style. The house is in good condition and features a unique fieldstone construction whereby the house is built into the bank of the land. The residence is situated on a 0.24 acre parcel of land located on the north side of Francis Street North between Duke Street West and Water Street North in the City Commercial Core Planning Community of the City of Kitchener within the Region of Waterloo. The principal resource that contributes to the heritage value is the house. Heritage Value 70 Francis Street North is recognized for its design, physical and historic values. The building is an excellent example of the Queen Anne architectural style. The building is in good condition with many intact original elements. The building features an asymmetrical plan; buff brick; rock-faced stone foundation; steeply pitched gable roof; projecting two storey bay with gambrel roof on south elevation; fan brackets with ornamental pendants; frieze board with simple dentillated trim; turret with steeply pitched polygonal roof; front door with raised panels, and a single light with beveled glass, three sidelights with beveled glass, and a transom with beveled glass; semi circular openings with radiating voussoirs and moulded brick trim; 1/1 double hung windows with concrete sills; and, front porch. The house was built in 1898 by Albert Ruby for $2800. Albert Ruby, along with Hartman Krug, was the co-founder of Krug Furniture in 1880. Albert Ruby was the first secretary- treasurer of Krug Furniture and remained in that position until his death on July 3, 1932. The property remained in the Ruby family for 85 years from 1881 to 1966. The building features an irregular plan; painted brick; rusticated block foundation; modified gable roof; octagonal tower with an eight-sided conical roof; plain fascia, moulded soffit, and frieze with dentils and mouldings; 1/1 windows with flat rusticated lintels; large first floor windows with half-round transoms; 1/1 round topped windows with decorative surrounds and keystone; main entrance door with sidelights and transom; three part oriel window; three section window with a two section elliptical-arch transom and brick label; and, two storey bay window with a bracketed pediment gable above. The principal resource that contributes to the heritage value is the commercial building. Heritage Value 103-109 King Street West is recognized for its design, physical, historic and contextual values. The building is a rare and unique example of the Classic Revival architectural style. The building is in good condition with many intact original elements. The building features brick construction of a colour unique to the area, a brick parapet wall with intricate brick details, brick pilasters, continuous stone lintels and sills, and original window openings. The building was built c. 1908 as part of the Huehn Block built by Christian Huehn. Christian Huehn was an accountant for the Breithaupt Leather Company. He was also the founder of the Fischman Spring Company and he presented Kitchener with the site for St. Mary's General Hospital. The building is also associated with the Masons in the City of Kitchener. The construction of the building provided an opportunity for the Grand River Masonic Lodge to acquire space. The upper floors were designed to include a lodge room, a dinner room, and other rooms. The building served as the centre for Masonic activity for 47 years (c. 1908 - c.1956). The building features double brick construction; red and buff brick; stone foundation; a hipped roof; a pair of projecting rectangular bays with a gable roof on the front facade; wood details including brackets, soffits, fascia and return eaves; half round windows with brick voussoirs; double hung windows with brick voussoirs; 1St and 2nd storey verandahs; and transoms over the front doors. The building contributes to the visual and architectural continuity of the streetscape, and is considered to be a neighbourhood landmark within the City. Upon construction, the building was used as asemi-detached residential dwelling. Today, the building has been converted for office use.
