RECOMMENDATION:
That pursuant to Section 27 of the Ontario Heritage Act, the following properties be listed
on the Municipal Heritage Register as non-designated properties of cultural heritage
value or interest, in accordance with the Statements of Significance attached as
Appendix 'A' to Development and Technical Services Department report DTS-09-129
^ 22-26 Charles Street West;
^ 15-29 Duke Street East;
^ 10 Duke Street West;
^ 156 Duke Street West;
^ 1255-1291 Fischer Hallman Road;
^ 1940 Fischer Hallman Road;
^ 1683 Huron Road;
^ 468 Trussler Road; and,
^ 12 Wellington Street North.
BACKGROUND:
Changes made to the Ontario Heritage Act through the passage of Bill 60, now afford
municipalities the opportunity to list properties that have not been designated under the Act but
that the municipality believes to be of cultural heritage value or interest on the Municipal
Heritage Register. Further, the Provincial Policy Statement (PPS) issued under Section 3 of the
Ontario Planning Act, has been amended and expands the definition of "built heritage
resources" to include properties listed by local jurisdictions. Together, the amendments made to
the Ontario Heritage Act and the Provincial Policy Statement of the Planning Act, offer an
opportunity for the City of Kitchener to update the Heritage Kitchener Inventory of Historic

Buildings and strengthen efforts to conserve property identified as being of cultural heritage
value or interest to the municipality.
On November 27, 2006 Council approved a 4-step process for listing non-designated property
of cultural heritage value or interest on the Municipal Heritage Register, as outlined in Staff
Report DTS-05-213.
The process involves the following steps:
1. Initial evaluation by a recorder through completion of a survey form and taking
photographs (only where properties are visible from the public realm).
2. Short listing of properties following a review of the recorder's survey form and
photographs; undertaken by an evaluation sub committee comprised of City Staff and
Heritage Kitchener Committee members.
Heritage Planning staff prepare a `statement of significance' for each short-listed
property and notify the property owner of the heritage interest in the property. Property
owners are invited to make comment and attend the Heritage Kitchener meeting where
their property will be considered for possible listing on the Municipal Heritage Register.
3. The City's Heritage Kitchener Committee reviews the merits of the short listed
properties; considers the comments of the property owner (if made); and makes a
recommendation to City Council.
4. City Council makes a decision on whether or not to list the properties on the Municipal
Heritage Register as "non-designated property of cultural heritage value or interest."
The 4-step listing process ensures a thorough and objective evaluation is undertaken for each
property, and provides an opportunity for public input and consultation.
Listing non-designated property on the Municipal Heritage Register is an important step in
identifying the City's cultural heritage resources. It does not impose restrictions or obligations
with regard to obtaining heritage approvals, meaning property owners do not require a heritage
permit or City approval to make alterations. Listing on the Municipal Heritage Register does
increase the amount of time the City has to process demolition applications (up to 60 days), and
does have implications in ensuring that the City is consistent with the Provincial Policy
Statement when processing Planning Act applications.
Since approving the 4-step process, Council has added 40 properties to the Municipal Heritage
Register as non-designated properties of cultural heritage value or interest.
REPORT:
The properties municipally addressed 22-26 Charles Street West; 15-29 Duke Street East; 10
Duke Street West; 156 Duke Street West; 1255-1291 Fischer Hallman Road; 1940 Fischer
Hallman Road; 1683 Huron Road; 468 Trussler Road; and, 12 Wellington Street North have
been recommended by both the recorder and the evaluation sub-committee to be listed as non-
designated property of cultural heritage value or interest on the Municipal Heritage Register. As
a result, the property owners have been formally notified of the heritage interest and invited to
participate in Step 3 of the process. Step 3 involves the Heritage Kitchener Committee meeting
scheduled for September 1, 2009, where the properties will be considered for listing as non-
designated properties of cultural heritage value or interest on the Municipal Heritage Register.
It should be noted that 4 of the 9 properties proposed for listing as non-designated property of
cultural heritage value or interest on the Municipal Heritage Register have been evaluated by

means of a Heritage Impact Assessment and/or Conservation Plan, which supported a specific
Planning Act application. In all cases, the Heritage Impact Assessment (HIA) and/or
Conservation Plan (CP) identified these properties as significant cultural heritage
resources worthy of conservation under both the Ontario Heritage Act and the Ontario
Planning Act. Listing of non-designated property on the Municipal Heritage Register formally
identifies that a property is of cultural heritage value or interest to the Municipality, and is a
critical step in the conservation process. In addition, listing provides an interim level of
protection from demolition by delaying issuance of a demolition permit for 60 days, thus
providing the municipality with sufficient time to consider and proceed to designate the property
under Part IV of the Ontario Heritage Act. A list of these properties is provided below.

COMMUNICATIONS:
An information package has been mailed to all affected property owners. The information
package includes: a letter that describes the heritage interest in the property and the listing
process, including how property owners can make comment; a copy of the Municipal Heritage
Register brochure; and, a copy of the Statement of Significance which describes the historic
place, identifies the key heritage values, and lists the principal heritage attributes. The
Statement of Significance also includes photographs of the property and a copy of the Cultural
Heritage Resource Evaluation Form, which was completed by the recorder and evaluation sub-
committee.
The owner of the property municipally addressed 22-26 Charles Street West submitted a letter
dated August 10, 2009 indicating that he may wish to redevelop his property and therefore he
does not want his building to be listed as anon-designated property of cultural heritage value or
interest on the Municipal Heritage Register. Heritage Planning staff provided a response letter
dated August 14, 2009 noting that listing as anon-designated property of cultural heritage value
or interest on the Municipal Heritage Register does not prevent development and that staff
would appreciate the opportunity to discuss the owners concerns prior to the September 1St
Heritage Kitchener Committee meeting.
The owner of the property municipally addressed 468 Trussler Road submitted a letter dated
August 18, 2009 indicating that they support the listing of their property as anon-designated
property of cultural heritage value or interest on the Municipal Heritage Register.
The owners of the properties municipally addressed 112 Benton Street, 418 Glasgow Street and
55 Woolwich Street were also circulated an information package. These owners submitted
objections to listing their property as non-designated property of cultural heritage value or
interest on the Municipal Heritage Register. Heritage Planning staff have decided to defer a

recommendation on these properties in order to provide an opportunity to discuss the concerns
of the property owners.
CONCLUSION:
Identifying specific local cultural heritage resources is a vital first step toward upholding the
City's responsibility to protect and conserve its heritage. The following properties have
undergone thorough and objective evaluation through the City's process for listing property on
the Municipal Heritage Register:

designated property of cultural heritage value or interest on the Municipal Heritage Register.

included in Appendix `A' of this report.

Description of Historic Place
22-26 Charles Street West is a two storey early 20th century brick building built in the
Industrial Vernacular architectural style. The building is situated on a 0.48 acre parcel of
land located on the north side of Charles Street West between Gaukel Street and
Ontario Street South in the City Commercial Core Planning Community of the City of
Kitchener within the Region of Waterloo. The principal resource that contributes to the
heritage value is the industrial building.
Heritage Value
22-26 Charles Street West is recognized for its design, physical, historical and
associative values.
Although the building is not a notable, rare or unique architectural style, the buildings
design and physical value relate to the Industrial Vernacular architectural style that is in
good condition with many intact original elements. The building features: yellow brick;
flat roof; large window openings which once held 36 pane windows with two sets of 8
pane windows that folded out; shallow buttressing between windows; concrete headers
and sills; and, concrete panels below first floor window openings.
The associative and historic values relate to the original property owner and industrial
uses of the building. Isaac Hoffman, the west ward alderman from the first Town
Council (1871), is believed to be the original property owner. The original use was an
industrial factory known as Canada Furniture Manufacturers. Later industrial uses
included: The Berlin Robe & Clothing Co. Ltd. and the Fischman Spring Co. (later
known as the General Spring Company). In addition, the buildings associative and
historic values relate to the importance of industry in shaping the growth of the City.

Description of Historic Place
15-29 Duke Street East is a two storey mid 20th century concrete building built in the
Modern Classical architectural style. The building is situated on a 0.93 acre parcel of
land located on the south side of Duke Street East between Queen Street North and
Frederick Street in the City Commercial Core Planning Community of the City of
Kitchener within the Region of Waterloo. The principal resource that contributes to the
heritage value is the public building.
Heritage Value
15-29 Duke Street East is recognized for its design, physical, contextual, historical and
associative values.
The public building is a notable, rare and unique example of the Modern Classical
architectural style. The building is in good condition with many intact original elements.
The building features: a two storey building that extends 176 feet along Duke Street
and 96 feet along both Frederick and Queen Streets; rectangular ground level plan; `u'-
shaped second level plan; Duke Street fagade with a series of strong verticals capped
by a strong horizontal; projecting cornice; band of geometrical motifs; stone around
window openings and main entrance; bronze light fixtures and sculpted bronze panels;
coat of arms; and, granite and limestone on the Queen, Duke and Frederick Street
facades. The public building contributes to the continuity and character of the
streetscape due to its orientation and close proximity to the sidewalk and road at the
intersection of Duke Street and Queen Street. The public building is recognized as both

a neighbourhood and City landmark due to its location. Additional context is provided by
the two park spaces, including the war memorial, at each end of the public building.
Historically, the public building was built in 1937-38 as part of the Department of Public
Works cross-Canada building program that resulted from the enactment of the Public
Works Construction Act of 1934. Between 1934 and the outbreak of the war building
projects in medium sized cities, such as Kitchener, involved the construction of
moderately sized public buildings that were handsome in design, practical in layout and
well-built. The public building program provided valuable space for needed services and
helped to alleviate unemployment. The construction of the public building was important
to Kitchener's pre-war economic recovery. Kitchener needed larger and improved
federal services and therefore the Board of Trade petitioned the federal government for
a new building. In January of 1937 an Order of Council granted authority for the
purchase of a lot from the estate of the Breithaupt family at the cost of $40,000.00. The
building was designed by the Department of Public Works. Construction began in late
1937 to accommodate a Post Office, Customs, National Defense, Trade and
Commerce, the Radio Commission, Income Tax and an apartment for a caretaker. The
building officially opened in 1938 just in time to help with the increased demands that
industries would have to meet during the Second World War.
Heritage Attributes
The heritage value of 15-29 Duke Street East resides in the following heritage
attributes:

10 Duke Street West is a three storey mid 20th century brick building built in the
Colonial Revival architectural style. The building is situated on a 0.55 acre parcel of land
located on the north side of Duke Street West between Ontario Street North and Queen
Street North in the City Commercial Core Planning Community of the City of Kitchener
within the Region of Waterloo. The principal resource that contributes to the heritage
value is the commercial building.
Heritage Value
10 Duke Street West is recognized for its design, physical, contextual, historical and
associative values.
The design and physical values relate to the Colonial Revival architectural style that is
in good condition with many intact original elements. The building features: red brick; 11
bays along Duke Street and 6 bays along Queen Street; main entrance door with door
surround, transom and entablature; brick columns with capitals and base; 8/12 windows
with headers and sills; the band between the 2nd and 3rd floors; and, the parapet at the
roofline. The building contributes to the continuity and character of the streetscape due
to its orientation and close proximity to the sidewalk and road at the intersection of
Duke Street and Queen Street.
The associative and historic values relate to the original owner and use of the property.
The Economical Mutual Fire Insurance Company was founded in 1871 by a group of
people in Berlin (now Kitchener) in order to protect against the devastating hardships
caused by fire and lighting. The company issued its first policy on a house and barn on
November 25, 1971. The name of the company was changed in 1937 dropping the fire

designation when the directors decided to enter the casualty field, giving its agents a
complete portfolio including automobile, plate glass, accident and health. The company
started in the law office of Alexander Millar, one of Berlin's pioneer barristers. The first
office was at the southwest corner of King Street and Ontario Street while the second
office was on Queen Street North between King Street and Duke Street. The third office
was the building at the corner of Queen Street North and Duke Street West. The
building was built c. 1949 for the company and used until 1989. The building was
featured in the "1854-1954 City of Talent Kitchener Centennial" publication as
Kitchener's oldest financial institution serving its citizens continuously for eighty-three
years.

156 Duke Street West is a two storey late 19t" century brick building built in the Classic
Revival architectural style. The building is situated on a 0.44 acre parcel of land located
on the north side of Duke Street West between Water Street North and College Street in
the City Commercial Core Planning Community of the City of Kitchener within the
Region of Waterloo. The principal resource that contributes to the heritage value is the
industrial building.
Heritage Value
156 Duke Street West is recognized for its design, physical, contextual, historical and
associative values.
The building is a notable example of the Classic Revival architectural style. The original
building is in good condition and features: an L-shape plan with three bays along Duke
Street; yellow brick laid in the American bond style; decorative brickwork, including
pilasters, belt courses, cornice, and corbels; front door opening with radiating brick
voussoirs and narrow label moulds; flat, semi-circular and segmentally arched window
openings; brick voussoirs; label moulds; concrete lintels; and, window sills.
August and Charles Boehmer originally owned a hardware store. In 1875 they began
manufacturing boxes for the button industry. In 1893 they built the factory on Short
Street (now Duke Street West) for a total cost of $3000. By 1908 they became a limited
company that sold permanent or set-up boxes. The switch to folding boxes
necessitated the construction of an addition to the Duke Street building in 1954. In the
mid 1960s a building on Belmont Street replaced the Duke Street building. The
company remained in the Boehmer family until 1974.

During the 1980's the building was adapted to accommodate residential uses and is
representative of one of Kitchener's early examples of the adaptive re-use of buildings.

located at the south west corner of Bleams Road and Fischer Hallman Road in the
Trussler Planning Community of the City of Kitchener within the Region of Waterloo.
The principal resource that contributes to the heritage value is the house.
Heritage Value
1255-1291 Fischer Hallman Road is recognized for its design, physical, contextual,
historical and associative values.
The house is a notable example of the Italianate architectural style with an attractive
and unique design, composition, craftsmanship and detail. The house is in good
condition with many intact original elements. The house features: yellow (buff) brick
construction; side hall plan; shallow pitched roof; front verandah with shingle handrail;
hung wood windows; front door with transom; octagonal bay on front; rectangular bay
on side; brick arched window and door voussoirs; brick relief panels below the bay
windows; wood brackets and soffits; and, fieldstone foundation with patterned concrete
parging. Adjacent to the house one will also find the concrete platform that was once
used to facilitate the mounting and dismounting of carriages and wagons.
The house was built in 1887 by Abraham D. Clemens for $4000 and sold to Anthony
Henhoeffer in 1890 by a Mr. Boehmer, the mortgage holder.

Description of Historic Place
1940 Fischer Hallman Road is cone-and-a-half storey late 19t" century stone building
built in the Victorian Gothic architectural style. The building is situated on a 55.25 acre
parcel of land located on the east side of Fischer Hallman Road between Huron Road
and Plains Road in the Huron Park Planning Community of the City of Kitchener within
the Region of Waterloo. The principal resource that contributes to the heritage value is
the house.
Heritage Value
1940 Fischer Hallman Road is recognized for its design, physical, contextual, historical
and associative values.
The house is a notable, rare and unique example of the Victorian Gothic architectural
style with an attractive and unique design, composition, craftsmanship and detail. The
house is in good condition with many intact original elements. The house features: an `L'
shape plan; wood eaves and fascia; wood windows with stone voussoirs; stone
construction; gable rooflines; corbelled chimneys; south entrance doorway with blue
coloured glass transom and green and red coloured glass sidelights; east porch with
posts and decorative scroll brackets; and, stain glass windows. Interior features include:
wood moulding, casing and trim; plaster mouldings, including chandelier medallion;
staircase; doors and hardware.
The house was built in 1870 by John Wallace after purchasing the property from his
father, Hugh Wallace, in 1869. John Wallace named the farm "Thornhill." John Wallace
was a Scottish pioneer and the house is a reflection of his prosperity, affluence and
prominence. He was a prominent land holder, a member of the Doon Presbyterian

Church, and a boarder of teachers who taught at Plains School. John sold the farm in
1904. The house was purchased by Roy Becker in 1936.

located on the north side of Huron Road between Amand Drive and Fischer Hallman
Road in the Trussler Planning Community of the City of Kitchener within the Region of
Waterloo. The principal resource that contributes to the heritage value is the house.
Heritage Value
1683 Huron Road Road is recognized for its design, physical, contextual, historical and
associative values.
The house is a rare example of the Ontario Gothic architectural style with some
influences from Italianate architecture. The house is in good condition with many intact
original elements. The house features: `T' plan; medium pitch side gable roof; yellow
brick laid in the stretcher bond pattern; front entrance features: wood door with carved
panels and two lights with semi-circular arched heads, paneled door jambs with carved
brackets separating the transom panes, transom with red and blue panes, sidelights,
Carpenter's box lock; intact with arched narrow windows including coloured glass
transom and sidelights; 2/2 segmentally arched wood windows with voussoirs; wood
sills; chimneys; rounded-arch window in dormer; single-bay verandah with shed roof
and engaged wooden posts with chamfered corners and scrollcut brackets; and, large
split faced granite fieldstone foundation. The interior of the house features: dark cherry
with a single strip of light maple wood flooring in the kitchen; pine flooring throughout
the remainder of the house; 12" moulded wood baseboards; doors with 5" moulded
wood casings; windows with simple moulded casings; and, centre hall staircase with
dark cherry newel post, turned balusters and curved banister.

The house is located in close proximity to Huron Road, which is one of Ontario's oldest
transportation routes. The farmhouse with the long laneway sheltered by large old
maple trees is a reminder of the agricultural life that prevailed in the area for so many
years. The house was likely built by Robert Orr in 1881 and was sold to Albert Ludolph
in 1920 for $7,500.

land located at the south east corner of Highway 7 and Trussler Road in the Laurentian
West Planning Community of the City of Kitchener within the Region of Waterloo. The
principal resource that contributes to the heritage value is the house.
Heritage Value
468 Trussler Road is recognized for its design, physical, contextual, historical and
associative values.
The house is an example of the Gothic Revival architectural style. The house
demonstrates a rare and unique method of construction as the stone walls appear to be
load bearing. The house is recognized for its design, composition, craftsmanship and
details particularly in relation to the well coursed and consistently split stone elevations
and the unusual gothic details such as the two-centred arched windows. The house is in
poor condition and is in need of repair and restoration. The house features: fieldstone
construction; `T' shaped plan; gothic centred arched windows; 6/6 wood window;
window openings with voussoirs; beaded sloped soffits and the cornice moulding at the
roof overhang; two storey front verandah; and, subtle stone quoining at the corners of
the house.

12 Wellington Street North is a two storey 20t" century brick building built in the Italian
Renaissance architectural style. The building is situated on a 0.2 acre parcel of land
located on the north side of Wellington Street North between King Street West and
Moore Avenue in the KW Hospital Planning Community of the City of Kitchener within
the Region of Waterloo. The principal resource that contributes to the heritage value is
the residential building.
Heritage Value
12 Wellington Street North is recognized for its design, physical, historic and associative
values.
The building is a notable, rare and unique example of the Italian Renaissance
architectural style. The building is in good condition with many intact original elements.
The building features: atwo-storey house constructed of red and black rug brick laid in
a Flemish bond; an L-shaped plan with projecting attached garage at the side and
projecting porch and balcony at the front; hipped roof with green metal tiles; three
dormers, including an eyebrow dormer on the front fagade, one hipped roof dormer on
the south fagade and one hipped roof dormer on the north fagade; chimney; large
dentils located just below the eaves; wood front entrance door with a leaded glass light
and leaded glass sidelights; three semi-circular headed French doors with an `S'-
shaped concrete keystone on the main fagade that open onto a patio with iron railing;
three sets of five square decorative tiles inlaid in the brick above the French doors;
leaded glass casement windows with a fixed light and a metal balconet; leaded glass
windows; wood garage doors with 3 quarter pane windows; and, large Palladian
window with original wood surrounds, detailing and a projecting balconet.

APPENDIX `A': STATEMENTS OF SIGNIFICANCE
Steven Chris arrived in Canada from northern Greece in 1912. In 1925, S. Chris
purchased the Station Hotel and commissioned prominent local architect W.H.E.
Schmalz to design his residence at 12 Wellington Street North. The residence remained
in the Chris family between 1925 and 1953.
W.H.E. Schmaltz was born in Berlin in 1890. He attended Suddaby School and the
Berlin Collegiate and Technical Institute. He also attended the Royal Military College in
Kingston and studied architecture at the University of Toronto. In 1914 he began
practicing architecture in Berlin and continued to work until his retirement in 1960. He is
well known for his design of Kitchener's City Hall (1924-1973). He also designed an
addition to Waterloo College in 1926, the Waterloo County Farmers' Market in 1973
and over 75 churches in Ontario. He was also active in the community serving as a
member of: the Kitchener Park Board for 19 years; the KW Kiwanis Club for 52 years,
including terms as president and historian; the KW Hospital Commission for 5 years;
the Kitchener Musical Society for 50 years, including terms as president and historian;
the Waterloo Historical Society, including terms as president and director; the Ontario
Pioneer Community Foundation; the Architectural Conservancy of Canada; the Ontario
Association of Architects; the Royal Architectural Institute of Canada; the Kitchener
Chamber of Commerce; the Royal Philatelic Society of Canada; the Retired Business
Men's Club; and St. Paul's Lutheran Church.
