BACKGROUND: On September 21, 2009 Council passed a resolution regarding the liquor licence application for Gambero located at 91 Queen Street South in which the applicant is required to enter into a private agreement with the City and abide by certain conditions. Due to a process error, the applicant did not receive a copy of the report before the Council meeting and therefore did not attend the meeting to voice her concerns regarding Condition #4 which is to stop serving alcohol by 12:01 a.m. daily in the first year of operation and thereafter to stop serving alcohol by 2:00 a.m. daily. REPORT: Since April of 2008, the Liquor Licensing Review Committee has recommended that a business where the owner has no experience operating or managing a bar or restaurant where liquor is served be required to stop serving alcohol by 12:01 daily in the first year of operation. This is to ensure that the owner is able to gain experience in managing any issues that may occur with regard to patrons and the service of alcohol. The applicant, Radmila Blagovcanin has expressed concern that this condition will cause financial hardship and make it difficult for her business to be successful if this condition remains. The Committee has received several letters of reference with regards to the applicant and her experience in serving food at various restaurants. They include serving alcohol and food at a Chinese restaurant until early 2008 as well as acting as a part-time employee as a kitchen helperlserver at a banquet hall in Waterloo. Although, she has served liquor at various restaurants and banquet halls in the area, she has not managed or owned a business in Ontario. LLARC is concerned that the applicant has had little to no experience owning/operating a restaurant or bar in Ontario where liquor is served. Based on the letters of reference, Council could consider applying the condition for a lesser amount of time than one year.
