HomeMy WebLinkAboutCRPS-09-146(1) - INCC Corp Consent Application (2009-035) - Guelph St - EasementsREPORT T0: Special Council DATE OF MEETING: October 26, 2009 SUBMITTED BY: Lesley MacDonald, Director of Legal Services and City Solicitor PREPARED BY: Lesley MacDonald, Direcor of Legal Services and City Solicitor WARD(S) INVOLVED: N/A DATE OF REPORT: October 23, 2009 REPORT NO.: CRPS - 09-146 SUBJECT: AUTHORIZATION FOR INCC CORP AND THEIR AGENT TO INCLUDE THAT PORTION OF GLASGOW STREET PROPOSED TO BE CLOSED, IN THEIRAPPLICATION FOR CONSENT, SUBMISSION 2009-035 PERTAINING TO THE CREATION OFA NUMBER OF EASEMENTS RECOMMENDATION: That General Manager of Financial Services be authorized to execute, on behalf of the City, the Application for Consent with respect to submission 2009-035, confirming that INCC Corp. and their agent may include that portion of Glasgow Street which is proposed to be closed and which dissects INCC Corp's Lands, in said application; and further that INCC Corp. and their agent may act on behalf of the City in regards to that portion of Glasgow Street, all at no cost to the City. BACKGROUND: The draft plan of subdivision with respect to the INCC CORP.'s development on Ira Needles Boulevard contemplates the closure of the portion of Glasgow Street as it dissects the site and the realignment of Glasgow Street around the development. REPORT: In anticipation of the closure of this portion of Glasgow Street and to eliminate the need for the Developer to make a further application respecting these lands once the portion of Glasgow Street is closed, staff supports the inclusions of these lands in the application. In all likelihood by the time the Committee of Adjustment hears the consent application that portion of Glasgow Street will be closed and conveyed to INCC CORP. FINANCIAL IMPLICATIONS: To be at no cost to the City CONCLUSION: The inclusion of these lands at this time is appropriate and timely. ACKNOWLEDGED BY: Troy Speck
