SUBJECT: AUTHORIZATION FOR EXECUTION OF LICENSE
AGREEMENT WITH THE INCC CORP. WITH RESPECT TO
THE LANDS DESCRIBED AS PARTS 12, 13, 15, 16 AND 17
ON PLAN 58R-16652
RECOMMENDATION:
That the Mayor and Clerk be authorized to execute a License Agreement with The INCC Corp.,
for the use of the lands described as Part of Lot 39, German Company Tract being Parts 12, 13,
15, 16, and 17 on Reference Plan 58R-16652 for the purpose of a parking lot, landscaped
areas, access to adjoining lands and other similar or collateral uses in conjunction with The
INCC Corp.'s operation of adjoining lands as a commercial and retail operation; said agreement
to be to the satisfaction of the City Solicitor.
BACKGROUND:
On October 6, 2008 Council authorized the acquisition of the parcel of Hydro One lands
described as Part 1 on Reference Plan 58R-16315, a copy of which is attached, to facilitate the
ultimate realignment of Glasgow Street, the exact location to be accommodated within the Part
acquired. The City took title to Part 1 on Reference Plan 58R-16315, the costs of which were
borne by the Ira Needles Commercial Centre Joint Venture (INCCJV) (now known as The INCC
Corp.). The exact location has subsequently been confirmed through the subdivision process
and by-laws are on the November 2, 2009 Council agenda to address the closure of a portion of
the existing Glasgow Street and the opening of the realigned portion of Glasgow, located on a
portion of Part 1 and described as Part 14 on Reference Plan 58R-16652.
REPORT:
Now that the location of the realigned Glasgow Street has been determined, the remaining
portions of Part 1 on Reference Plan 58R-16315, described as Parts 12, 13, 15, 16, and 17 on
Reference Plan 58R-16652, see attached reference plan attached and more specifically the
Detail A on the left side of the Plan, are surplus to the road realignment and the City's needs.
The INCC Corp. would like to use this land for the purpose of a parking lot, landscaped areas,
access to adjoining lands and other similar or collateral uses in conjunction with their
commercial and retail operation on adjoining lands. The INCC Corp. would like to enter into a
license agreement with the City with respect to this proposed use on satisfactory terms to be
negotiated with the City Solicitor. Since INCCJV paid the purchase price and assumed all costs
at the time the City acquired Part 1 from Hydro, the City would not be charging any fee and is
prepared to give them a long term license up to 100 years.
FINANCIAL IMPLICATIONS:
There is no cost to the City and no revenue proposed as a result of this arrangement since
INCCJV paid for the lands and associated costs to acquire the lands at the time the City took
title to the property.
CONCLUSION:
In order to facilitate the timely development of this portion of the lands in conjunction with the
development of the adjacent lands owned by The INCC Corp., staff are seeking Council's
endorsement of this approach in anticipation of all the details being worked out by the City
Solicitor thereafter.
