HomeMy WebLinkAboutAdjustment - 2003-03-18 SG COMMITTEE OF ADJUSTMENT FOR THE CITY OF KITCHENER MINUTES OF THE REGULAR MEETING HELD MARCH 18, 2005 MEMBERS PRESENT: Messrs. P. Kruse, P. Britton and B. Issac. OFFICIALS PRESENT: Mr. B. Sloan, Principal Planner and Ms. D. Gilchrist, Acting Secretary- Treasurer. Mr. P. Kruse, Chair, called this meeting to order at 10:00 a.m. This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was called to consider applications regarding variances to Chapter 680 (Signs) of the City of Kitchener Municipal Code. The Committee will not make a decision on these applications but rather will make a recommendation which will be forwarded to the Committee of the Whole and Council for final decision. The Chair explained that the Committee's decisions with respect to sign variances are recommendations to City Council and not a final decision. He advised that the Committee's recommendations will be forwarded to City Council on Tuesday, March 31, 2003, at 7:00 p.m., and the applicants may register with the City Clerk to appear at the meeting if desired. Kruse advised that the Committee was in receipt of a request from the applicant's agent to defer consideration of the application to the Committee's April 8, 2003 meeting, and by general consent, it was agreed that this application be deferred to the April 8, 2003 Committee of Adjustment meeting. Submission No.: SG 2003-002 (CONT'D) The Committee considered the comments of the Planning Division, dated March 10, 2003, in which they recommend approval of this application. The Committee considered the comments of the Director of Building, dated March 6, 2003, and of the Transportation Planning Division, dated March 13, 2003, in which they advised they have no concerns with the application. Moved by Mr. P. Britton Seconded by Mr. B. Issac That the application of 754751 Ontario Ltd. requesting permission to erect a ground sign with a setback of 0 m from Ottawa Street rather than the required 3 m (9.84 ft.) on Part Block G, Registered Plan 1202, being Part 1, Reference Plan 58R-5875, 1335 Ottawa Street North, Kitchener, Ontario, BE APPROVED. It is the opinion of this Committee that: 1. The variance approved in this application is minor in nature. 2. This application is desirable for the appropriate development of the property. 3. The general intent and purpose of the City of Kitchener Municipal Code Chapter 680 (Signs) is being maintained on the subject property. Submission No.: Applicant: Property Location: Legal Description: Carried SG 2003-003 Highland Corners Shopping Center Ltd. 491 Highland Road West Registered Plan 1004, being Parts 3, 4 & 6, Reference Plan 58R- 12467 Appearances: In Support: Ms. Michelle Desrosiers Contra: None Public Submissions: In Support: None Contra: None The Committee was advised that the applicant requests permission to erect a pylon sign with a setback from Westmount Road and from Highland Road of 0 m rather than the required 0.4 m (1.31 ft.), with the sign to have an obstructed clearance between the copy portion of the sign and grade of 0.91 m (3 ft.) rather than the required unobstructed clearance of 2.44 m (8 ft.), and permission to use this sign as a third party sign. The Committee considered the comments of the Planning Division, dated March 7, 2003, in which they recommend approval of the application for the sign generally as shown on the drawings submitted with the application, and on the condition that the non-accessory sign be permitted only for those uses at 525 Highland Road West. The Committee considered the comments of the Director of Building, dated March 6, 2003, and of the Transportation Planning Division, dated March 13, 2003, in which they advise they have no concerns with this application. The Committee reviewed correspondence from Kitchener-Wilmot Hydro, dated March 4, 2003, in which they advise that an existing high voltage pole line runs along Highland Road adjacent to the sign. although they have no concerns with the sign as proposed, they request that this Committee not approve any increase in sign height or permit it to be located closer to Highland Road. Britton SG 2003-003 (CONT'D) That the application of Highland Corners Shopping Center Ltd. requesting permission to erect a pylon sign with a setback from Westmount Road and from Highland Road of 0 m rather than the required 0.4 m (1.31 ft.), with the sign to have an obstructed clearance between the copy portion of the sign and grade of 0.91 m (3 ft.) rather than the required unobstructed clearance of 2.44 m (8 ft.) and permission to use this as a non-accessory sign on Part Lots 20 & 21, Registered Plan 1004, being Parts 3, 4 & 6, Reference Plan 58R-12467, 491 Highland Road West, Kitchener, Ontario, BE APPROVED, subject to the following conditions: That the applicant shall obtain a sign permit prior to erecting the sign, which shall be generally in accordance with the drawings submitted with the application. That permission to use this sign as a non-accessory sign shall be restricted to only those uses located at 525 Highland Road West. It is the opinion of this Committee that: The variance approved in this application is minor in nature. This application is desirable for the appropriate development of the property.
