Eng, Manager, Development Engineering (741 2974) Ward(s) Involved: 4 Date of Report: November 23, 2009 Report No.: DTS - 09 -178 Subject: Detailed Design, Contract Administration and Inspection Service -Culverts within the Doon Creek Subdivision RECOMMENDATION: That the normal procedure be waived for the selection of Engineering Consultants and that the City retain MTE Consultants as the Engineering Consultant to undertake the detailed design, contract administration and inspection for the two culverts located at Robert Ferrie Drive and Forest Creek Road, within the Doon Creek Subdivision (30T-04204); -and - That the Mayor and Clerk be authorized to execute an Engineering Agreement for the provision of professional engineering services between the City of Kitchener and MTE Consultants at a total cost of $68,500 excluding applicable taxes for completion of the two culverts project upon receipt of the necessary funds from LVH Developments (DC) Inc. who are providing front-end financing for this project in exchange for development charge credits; -and - That the Mayor and Clerk be authorized to execute a Development Charges Credit Agreement with LVH Developments (DC) Inc. payment of the costs of the consultant fees and the construction of the two culverts project. BACKGROUND: As part of the Doon Creek Subdivision, the two culverts are required to cross Tributary J2 with the extension of Robert Ferrie Drive and the crossing of Doon South Creek with Forest Creek Drive (refer, culvert location map, Appendix A). As part of the Doon South Community Plan, these two culverts were anticipated as part of the overall design of the community. The proposed closure of Tilt Drive necessitates these additional crossings to preserve the scenic road characteristics of Tilt Drive and ultimately Stauffer Drive and Groh Drive and further enhance the connectivity of these neighbourhoods. REPORT: The City received a request from LVH Developments (DC) Inc. proposing that the City retain MTE Consultants Inc. as City's engineering consultant to undertake the detailed design, 5-1 contract administration and inspection for the Doon Creek Culverts. The overall planning and environmental reports and other studies have been completed as part of the community planning process and in more detail as part of the subdivision applications process. In order to proceed with the development of this subdivision, staff recommend that the MTE Consultants Inc. be appointed to complete this project. MTE and their sub consultant will complete the following task as part of this project; a) Final Design • Compile detailed base plans generated from topographic survey data and supplemented with information gathered through field visits to the site • Assess proposed roadway and waterway geometrics, and develop preferred cross-sections for roadway, creek and culvert • Assess the hydraulic characteristics of the culvert and impacts to the adjacent lands • Coordinate details of the headwalls, railing and other appurtenances in accordance with the City of Kitchener's design standards and in consultation with Operations Staff. b) Approval process To complete these work there will be a minimum of two permits required to construct these culverts. A fill permit will be needed from the GRCA and a Permit to Take Water (PTTV~ will be required from MOE. MTE will prepare the permit applications, design drawings and other required details to obtain the approvals. c) Tendering, Inspection and Construction Administration MTE Consultants Inc. will prepare tender documents, specifications and other details in accordance with City of Kitchener standards. Further, MTE will provide tender analysis, full time inspection and contract administration during this project. FINANCIAL IMPLICATIONS: The construction of the two culverts located on Robert Ferrie Drive and Forest Creek Drive are identified items in the Development Charges Project #13.1.9, refer to attached document Appendix B. LVH Developments (DC) Inc. have agreed to finance the cost of the detailed design, contract administration, inspection and construction to advance the timing for completion of same. Accordingly, the contributing developer will receive credits towards their applicable Development Charges at the time of Building Permit application, in accordance with the polices and procedures in place at that time. 5-2 CONCLUSION: In order to support the development within this area, it is necessary to initiate the detailed design, contract administration, inspection and construction for the two culverts at this time.
