HomeMy WebLinkAboutCRPS-09-155 - Declare Surplus Lands - Health Sciences Campus REPORT REPORT TO: Committee of the Whole DATE OF MEETING: December 14, 2009 SUBMITTED BY: Lesley MacDonald, Director of Legal Services and City Solicitor PREPARED BY: Lesley MacDonald, Direcor of Legal Services and City Solicitor WARD(S) INVOLVED: Ward 6 DATE OF REPORT: December 10, 2009 REPORT NO.: CRPS -09-155 SUBJECT: DECLARE LANDS SURPLUS FOR CONVEYANCE OF EASEMENTS AND TRANSFER OF PROPERTY TO UNIVERSITY OF WATERLOO FOR PURPOSES OF THE HEALTH SCIENCES CAMPUS RECOMMENDATION: That the City of Kitchener hereby declare the lands located at the intersection of King Street W. and Victoria Street South, in the City of Kitchener described as Part of Lots A, B, 1-3, 7-12, Plan 420, and Part of Park Lot 448, Plan 375, being Parts 1 & 2, Plan 58R- 16455 surplus to the City’s needs for the purposes of conveying the required easements to K-W Hydro and The Regional Municipality of Waterloo and the subsequent conveyance of the lands to The University of Waterloo for the Health Science Campus and road widenings to The Regional Municipality of Waterloo; and further, That the Mayor and Clerk be authorized to execute the necessary documentation to effect these transactions, said documentation to be to the satisfaction of the City Solicitor. BACKGROUND: On February 13, 2006, Council approved a transaction with L.P. Holdings Inc., for the staged City acquisition of the lands located at 521 King Street W. Subsequently on March 27, 2006 Council authorized the staged transfer of the said lands to the University of Waterloo to facilitate the Health Sciences Campus. REPORT: It is now in order to officially transfer these lands to the University and to effect said transfer these lands need to be declared surplus to the City’s needs. This transaction is exempt from obtaining an appraisal of the lands pursuant to Ontario Regulation 815/94 made under the Municipal Act. FINANCIAL IMPLICATIONS: None, the land has been donated to the City of Kitchener and in turn is being donated to the University of Waterloo. CONCLUSION: In order to facilitate the above transactions, it is necessary to declare the subject lands as surplus to the City’s needs.
