AMENDMENT TO TARIFF OF FEES OF CHAPTER 380 OF
THE CITY OF
KITCHENER MUNICIPAL CODE
RECOMMENDATION:
That Schedule "A" - Tariff of Fees of Chapter 380 of The City of Kitchener Municipal
Code be amended to delete the word "unit" and substitute therefore the word "hectare"
on the third line of the fees under the heading "Subdivision and Vacant Land
Condominium; and further
That the amending by-law to effect said change be deemed as having been given First
and Second reading.
REPORT:
It has come to the attention of Planning staff that Line 1237 of the 2010 Comprehensive Fee
Review (Schedule of Fees) inadvertently had some language that was incorrect. The intent of
Line 1237 is that there will be a per hectare fee on plans of subdivision, but the fee schedule
was approved by Council and passed by by-law with a reference to a per unit fee. There has
always been a per hectare fee charged and it is felt that there may have been an attempt to
revise the subdivision fee to reflect the same wording as the condominium fee which does have
a per unit charge.
In order to correct the wording Planning staff in consultation with Legal and Finance staff, are
proposing a minor housekeeping amendment to the by-law. The intent was always to have the
wording as per hectare as it has always been in previous fee schedules. It should be noted that
the correction in not to the detriment of the customers who pay the fees. The web based
published version of fees will also be amended accordingly.
