Design & Construction Engineer (741-3030) WARD(S~ INVOLVED: Ward # 3 DATE OF REPORT: January 15, 2009 REPORT NO.: DTS-10-028 SUBJECT: Acquisition of Hydro One Lands for Blockline Road Extension RECOMMENDATION: That the Mayor and Clerk be authorized to execute an Agreement of Purchase and Sale with Ontario Realty Corporation acting as agent on behalf of Her Majesty the Queen in right of Ontario as represented by The Minister of Energy and Infrastructure to acquire approximately 0.52 acres of land described as Parts 12,13 and 14 on Reference Plan 58R-16139, to accommodate the extension of Block Line Road at a purchase price of $86,500.00 plus associated costs; and further, That the City Clerk be authorized to execute on behalf of the City the Statutory Declaration as provided by Ontario Realty Corporation acting as agent on behalf of Her Majesty the Queen in right of Ontario as represented by The Minister of Energy and Infrastructure; and further, That the Mayor and Clerk be authorized to execute the necessary documentation, satisfactory to the City Solicitor, to effect the acquisition of said lands. BACKGROUND: The City completed the Class Environmental Assessment for Block Line Road from Homer Watson Boulevard to Courtland Avenue in 2001. The Walterfedy Partnership on behalf of City of Kitchener has completed the detailed design for the Extension of Block Line Road from Hanover Street to Lennox Lewis Way in 2009, while Block Line Road from Homer Watson Boulevard to Hanover Street was constructed in 2001 as a separate project. 4-1 REPORT: The Walterfedy Partnership on behalf of City of Kitchener has completed the detailed design for the extension of Block Line Road from Hanover Street to Lennox Lewis Way (see attached map). As per consultants proposed design, the City needs to purchase several properties for extension of the Block Line Road from Hanover Street to Lennox Lewis Way. One of the land parcels belongs to Hydro One; the exact area of the land is 0.5192 acres (shown as Parts 12, 13 and 14 on Reference Plan 58R-16139). Hydro One has determined the consideration of these lands at $86,500 (based on market value). Hydro One requires an Order-in-Council to sell these lands which has been secured and it expires on February 18, 2010, therefore this transaction must be completed by February 18, 2010. City staff had several discussions with Hydro One and Ontario Reality Corporation, and they are in agreement to transfer the required land to the City to accommodate the road construction. FINANCIAL IMPLICATIONS: This project is a Development Charge project. All the purchase costs, including reference plan, appraisal, Ontario Realty Corporation's engineering and review and legal fees, land transfer tax, Land Registry fees and disbursements and all incidental costs associated with this transaction are to be paid by the City of Kitchener. The City has sufficient funds available in the Capital project account # 861238 to accommodate this land purchase. CONCLUSION: Staff recommends that the City acquires this land from Hydro One to accommodate proposed extension of Block Line Road.
