The building contains eleven (11) residential rental units. No units are currently inhabited and the building is currently vacant. The building is commonly known as the Barra Castle and is located within the Victoria Park Area Heritage Conservation District. The subject property is designated as Mixed Use Corridor (a portion of the site is designated as Open Space) in the Mill Courtland Secondary Plan and zoned Commercial Residential Two (CR-2) (a portion of the site is zone Existing Zone (E-1)) in the Zoning By-law. Map 1: Ariel View and Zoning Boundaries* * The area shown as zoned E-1 is designated as Open Space. The area zoned CR-21 R is designated as Mixed Use Corridor. The hatched area represents the middle, rear, and annex portions proposed to be demolished. The Owner is requesting permission to demolish the middle, rear, and annex sections of a residential building (See Appendix A -Demolition Plan) to prepare the site for future redevelopment at a later date. At this time no applications have been filed for the redevelopment of the property. A full neighbourhood circulation was undertaken from November 20, 2009 to December 4, 2009. Although the subject buildings have not recently been utilized for residential use, Demolition Control is required as per Council Policy. 5-2 REPORT: Planning Comments Under the Planning Act, the purpose of Demolition Control is to maintain residential properties within the municipality and to prevent their premature or unjustified removal. Planning staff advises that from past experience demolition is not always followed by timely redevelopment, even if a building permit is issued. In order to ensure timely redevelopment, Planning staff often recommend that a condition requiring the owner to obtain a building permit be included in the approval of Demolition Control. Upon issuance of a building permit, a demolition permit may be issued subject to a significant fine if reconstruction has not been significantly completed within 2 years. This condition is not being recommended for this application. Front View -Portion of Building to be Retained Seven criteria, as outlined in Council Policy I-1010, are used to evaluate the appropriateness of an application to demolish a residential property in circumstances where no building permit will be issued for a new building on the site. 1. Property Subject to the Ontario Heritage Act The subject property is located within the Victoria Park Area Heritage Conservation District and is therefore subject to the policies and guidelines found within the Victoria Park Area Heritage Conservation District Plan. The proposal to demolish the middle, back and annex sections of the Barra Castle building required the submission of a Heritage Permit Application. Report DTS-09-126 recommended approval of Heritage Permit Application HPA-2009-V-010, which proposed the demolition of the middle, back and annex sections of the Barra Castle building, subject to conditions relating to the submission of photo documentation and measured drawings as well as the review and clearance of the final 5-3 building permit for the demolition of the middle, back and annex sections of the Barra Castle building. The recommendations of DTS-09-126 (see Appendix D -DTS-09-126 were approved by Council at the September 14, 2009 special meeting. Heritage Planning have confirmed that the conditions to submit photo documentation and measured drawings have been satisfied. 2. Architectural and Historical Value Heritage Planning staff have no concerns with the proposed demolition of the middle, back and annex sections of the Barra Castle building as these demolitions may assist with the long-term conservation of the original front section of the Barra Castle building. 3. Condition of the Dwelling A Building Inspector visited the property and commented that the building is in an extreme state of disrepair. Some portions near the rear would require a complete structural replacement to become habitable again. Most of the building needs to be stripped back to the original structure to verify integrity before proceeding with repairs. The entire exterior stucco/plaster should be removed to verify integrity of structure beneath 4. Impact of Demolition on Abutting Properties, Streetscape, and Neighbourhood Stability It is Planning staff's opinion that removal of the middle, back, and annex sections of the Barra Castle building will not have a detrimental impact on the surrounding properties. The front portion of the building which is proposed to remain is the only portion of the existing building that will have an impact on the streetscape. 5. Timeframe of Redevelopment Although no formal application has been filed for the redevelopment of the site, it is anticipated by Planning Staff that the Owner will be submitting a site plan pre-submission meeting request in the very near future. 6. Proposed Use In Terms of Zoning and Compatibility with Ad jacent Properties The subject property is subject to Official Plan Amendment OP09/03/COK/HH, a City- initiated amendment for housekeeping modifications to the Cedar Hill, Victoria Park and Victoria Street Neighbourhood Plans for Land Use. The site is also subject to Zoning By-law Amendment ZC09/05/COK/HH, aCity-initiated amendment to implement Mixed Use Corridor zoning to the lands within the Queen Street South Mixed Use Corridor. The subject site is currently designated Mixed Use Corridor in the Official Plan and zoned CR-2 with Special Regulation 1 R. Through the above mentioned zone change the subject site will be rezoned to one of the three Mixed Use Corridor zone categories with or without site-specific provisions. 7. Neighbourhood Consultation All property owners within 60 metres of the subject property were notified of the subject proposal and invited to submit comments. Two written responses were received as a result of the public circulation, both in support of the proposed demolition. One adjacent property owner cited concerns that mould and dust from the building will become airborne during the demolition and could possibly enter onto their property. The second respondent was also concerned about the transitioning of the site from its current state to vacant, as well as the transition from vacant to future development. A copy of all neighbourhood correspondence is provided in Appendix C. All property owners within 60 metres of the subject property will receive notice of the Development and Technical Services meeting dealing with this application for information only. Individuals responding in writing, either in favour of or in opposition to the proposed demolition, will be mailed a copy of the staff report. It is Planning staff's opinion that the standard two year redevelopment condition should not be applied to this application and that an unconditional approval be granted for the demolition of 5-4 the middle, rear, and annex sections of the building. The Owner has not finalized redevelopment plans for the property and is not in a position to obtain a building permit for the future redevelopment. The site is currently subject to an Official Plan amendment and a zone change application. The portions of the building proposed for demolition are uninhabitable and the timely removal of those portions may assist in maintaining the remainder of the structure on the site. Heritage Permit Application HPA-2009-V-010, which proposed the demolition of the middle, back and annex sections of the Barra Castle building, subject to conditions relating to the submission of photo documentation and measured drawings as well as the review and clearance of the final building permit for the demolition of the middle, back and annex sections of the Barra Castle building, was approved by Council at the September 14, 2009 special meeting. Heritage Comments Heritage Planning staff had an opportunity to review the Demolition Control Application for the proposed demolition of the middle, back and annex sections of the Barra Castle building located at 393-411 Queen Street South. The subject property is located within the Victoria Park Area Heritage Conservation District and is therefore subject to the policies and guidelines found within the Victoria Park Area Heritage Conservation District Plan. The proposal to demolish the middle, back and annex sections of the Barra Castle building required the submission of a Heritage Permit Application. Development and Technical Services Report DTS-09-126 recommended approval of Heritage Permit Application HPA-2009-V-010, which proposed the demolition of the middle, back and annex sections of the Barra Castle building, subject to conditions relating to the submission of photo documentation and measured drawings as well as the review and clearance of the final building permit for the demolition of the middle, back and annex sections of the Barra Castle building. The recommendations of DTS-09-126 were approved by Council at the September 14, 2009 special meeting. Heritage Planning staff can confirm that the conditions to submit photo documentation and measured drawings have been satisfied. Heritage Planning staff will clear the final condition upon review of the building permit for the demolition of the middle, back and annex sections of the Barra Castle building. It is important to note that the recommendation to approve the demolition of the middle, back and annex sections of the Barra Castle building was based on the following: • The Heritage Impact Assessment concludes that the most significant section of the building is the original front section; • The Heritage Impact Assessment concludes that the middle, back and annex sections were additions to the original front section; • The primary interest in Heritage Conservation Districts is the conservation of those heritage attributes that can be seen from the public realm; • The middle, back and annex sections of the building have limited visibility from the public realm; • The Heritage Impact Assessment and Structural Assessment have identified that the middle, back and annex sections of the building require extensive repair, reinforcement, and reconstruction; • The Heritage Impact Assessment and Structural Assessment conclude that it is not financially viable to restore the middle, back and annex sections of the building; • The entire building has been vacant for over 2 years during which time its condition has • deteriorated significantly; • The proposals to conserve the building have been very limited; 5-5 • The proposed partial demolition, front section restoration, and new addition represent the most viable level of conservation presented within the last 2 years; • The lack of alternative proposals leaves us with the do nothing option whereby the building continues to be vacant and subject to further deterioration; and, • The proposed partial demolition of the middle, back and annex sections of the building will not detract from the character of the Victoria Park Heritage Conservation District, including the immediate neighbourhood and the Queen Street South streetscape. Heritage Planning staff note that any future development proposals on the lands, including alterations (i.e. restoration, additions, new construction and/or demolitions will require the submission of a Heritage Permit Application supported by a Heritage Impact Assessment. Based on the above noted information, Heritage Planning staff have no concerns with the proposed demolition of the middle, back and annex sections of the Barra Castle building as these demolitions may assist with the long-term conservation of the original front section of the Barra Castle building. Urban Design Comments Urban Design Staff advised that the subject property is subject to Official Plan Amendment OP09/03/COK/HH, aCity-initiated amendment for housekeeping modifications to the Cedar Hill, Victoria Park and Victoria Street Neighbourhood Plans for Land Use. The site is also subject to Zoning By-law Amendment ZC09/05/COK/HH, aCity-initiated amendment to implement Mixed Use Corridor zoning to the lands within the Queen Street South Mixed Use Corridor. The subject site is currently designated Mixed Use Corridor in the Official Plan and zoned CR-2 with Special Regulation 1 R. Through the above mentioned zone change the subject site will be rezoned to one of the three Mixed Use Corridor zone categories with or without site-specific provisions. Staff further advised that the general Official Plan policy intent for lands within the Mixed Use Corridors is to allow for transit-supportive intensification to serve surrounding residential and employment areas and that in the absence of an approved site plan and building permit for redevelopment the demolition control application alone does not support the land use objectives of the Official Plan for Mixed Use Corridors. Planning staff acknowledge these concerns and will endeavour to ensure that the objectives of the Official Plan are considered as part of any future development applications. Engineering Comments As a portion of the building will remain, there is no need to cap the existing services at this time. In the future when there is further redevelopment they Owner will need to replace all services. Building Inspector Comments Building staff advised that the property features a 3 storey apartment building comprised of numerous additions to the original stone/concrete farmhouse. Currently there is surface parking provided at the right side of property. The building consists of approximately 15 units and was constructed with at least 3 separate additions to main house at front. The front portions are concrete bearing walls with wood framed floor and roof. The rear additions appear to be wood frame with exterior stucco/plaster bearing on poured concrete foundation. The exterior stucco over brick/concrete shows evidence of cracking and peeling and water is penetrating the structure at several locations. The roof is in poor condition with significant cracking evident on the surface and large areas of water penetration at rear. Almost all exterior 5-6 doors and windows have been damaged or removed and boarded over. There are existing oil tanks located on the right side of the property in a concrete vault under the parking area. The building appears to have been heated by hot water radiators powered by an oil fired boiler. The boiler room was not accessible for this investigation. Most services have been removed, plumbing fixtures are all damaged or removed, and electrical components have been partially removed. The interior finishes are damaged, paint and plaster are peeling throughout, and many of the hardwood floors are buckling due to moisture. Partial renovations have left the structure and services exposed to the elements. The building is in an extreme state of disrepair. Some portions near the rear would require a complete structural replacement to become habitable again. Most of the building needs to be stripped back to the original structure to verify integrity before proceeding with repairs. The entire exterior stucco/plaster should be removed to verify integrity of structure beneath. A demolition permit is required. FINANCIAL IMPLICATIONS: No new or additional capital budget requests are expected with this recommendation. COMMUNICATIONS: Preliminary circulation of the demolition control application was undertaken from November 20, 2009 to December 4, 2009 to internal agencies and all property owners within 60 metres of the subject property. All comments that were received from internal agencies are attached as Appendix B. Two written comments were received from neighbouring landowners and are discussed in the Neighbourhood Consultation section of this report and provided as Appendix C. An information letter will be circulated to all property owners within 60 metres of the subject property in advance of the Development and Technical Services Committee Meeting dealing with the subject application. In addition, all respondents of the neighbourhood circulation will be circulated a copy of the staff report. CONCLUSION: Planning staff is satisfied that the proposed demolition is justified. As such, staff recommends that Demolition Control Application DC09/14/Q/GS requesting permission to demolish the middle, rear, and annex portions of a building located at 393-411 Queen Street South, owned by Polocorp Incorporated, legally described as Plan 397 PT Lot 5, be approved, without conditions.
