HomeMy WebLinkAboutCRPS-09-126 - Encroachment Agreement - 119 King St W - Matter of TasteREPORT REPORT TO: Committee of the Whole DATE OF MEETING: September 21, 2009 SUBMITTED BY: Jennifer Sheryer, Assistant City Solicitor PREPARED BY: Sherry Handsor, Legal Secretary WARD(S) INVOLVED: 6 DATE OF REPORT: September 15, 2009 REPORT NO.: CRPS-09-126 SUBJECT: ENCROACHMENT AGREEMENT REQUEST - 119 KING ST W (MATTER OF TASTE) - PROPOSED RETRACTABLE AWNING OVER KING ST W ROAD ALLOWANCE RECOMMENDATION: “That the Mayor and Clerk be authorized to execute an Encroachment Agreement, satisfactory to the City Solicitor, with the tenant or property owner and any mortgagee(s) of the property municipally known as 119 King St. W. to legalize a proposed retractable awning which will encroach approximately 7’ 6”, more or less, over the King St. W. road allowance for a length of approximately 15’ 7”, more or less.” BACKGROUND: The tenant, Matter of Taste, located at 119 King St. W. has been awarded a grant through the Downtown Façade Improvement Program and would like to install a retractable awning over the business entrance. REPORT: A request has been submitted by the tenant, Matter of Taste, located at 119 King St. W. for the installation of a retractable awning over the business entrance. The tenant has been awarded a grant through the Downtown Façade Improvement Program in 2009. As part of the grant process, the Downtown Financial Incentives Review Team has reviewed and approved the design of the proposed awning, as it meets the intent of the King Street Façade guidelines. The proposed awning is approximately 15’ 7” long and encroaches approximately 7’ 6” over the King St. W. road allowance. The awning is located approximately 11’ 8” high off of the sidewalk. Attached is a sketch illustrating the location and dimensions of the proposed awning. FINANCIAL IMPLICATIONS: N/A î ó ï CONCLUSION: The appropriate staff has reviewed this request and has no concerns with the location of the proposed retractable awning.
