Gosse, Director of Legislated Services/City Clerk PREPARED BY: Patricia Harris, Manager of Licensing WARD(S) INVOLVED: 3 DATE OF REPORT: January 27, 2010 REPORT NO.: CRPS-10-016 SUBJECT: REQUEST FOR A MIDWAY - 707 OTTAWA STREET SOUTH - APRIL 22 TO MAY 2, 2010 RECOMMENDATION: That Homeniuk Rides Inc. be granted permission to operate a midway at Weiland Ford, 707 Ottawa Street South, from April 22 to May 2, 2010, subject to the following: Hours of operation; and Date Start Close Thursday, April 22 3:30 p.m. 10:00 p.m. Friday, April 23 3:30 p.m. 11:00 p.m. Saturday, April 24 10:00 a.m. 11:00 p.m. Sunday, April 25 Noon10:00 p.m. Monday, April 26-Thursday, 3:30 p.m. 10:00 p.m. April 29 Friday, April 30 3:30 p.m. 11:00 p.m. Saturday, May 1 10:00 a.m. 11:00 p.m. Sunday, May 2 Noon9:00 p.m. That the music at the Midway be turned down at 8:00 p.m. excepting those evenings preceding a school day when it shall be turned off at 8:00 p.m.; and That the music be turned off one hour before closing time on the evenings preceding a non- school day; and That parking arrangements be reviewed with Transportation Planning staff to ensure adequate off-street parking will be provided; and further, ï ó ï That the required licence be obtained prior to operating the Midway. BACKGROUND: A letter has been received from Linda Homeniuk, Vice President of Homeniuk Rides Incorporated requesting permission to operate a midway at 707 Ottawa Street South, Weiland Ford car lot. Council has approved similar requests in the past, the latest being March 9, 2009. REPORT: In the letter from Ms. Homeniuk, it is being requested that permission be granted to operate a midway during the following times, April 22 to May 2, 2010 and with the following conditions with respect to the music being played. Date Start Close Thursday, April 22 3:30 p.m. 10:00 p.m. (music off at 8:30 p.m.) Friday, April 23 3:00 p.m. 10:00 p.m. (music off at 8:30 p.m.) Saturday, April 24 10:00 a.m. 11:00 p.m. (music off at 10:00 p.m.) Sunday, April 25 Noon10:00 p.m. ( music off at 9:00 p.m.) Monday, April 26-Thursday, 3:30 p.m. 10:00 p.m. (music off at 8:30 p.m.) April 29 Friday, April 30 3:30 p.m. 11:00 p.m. (music off at 10:00 p.m.) Saturday, May 1 10:00 a.m. 11:00 p.m. (music off at 10:00 p.m.) Sunday, May 2 Noon9:00 p.m. In the past with the operation of a midway at this site, concerns were raised by an area resident regarding the music, and in consideration of this concern, Council has required the music to be turned off at 8:00 p.m. on the evenings preceding school days, and to be turned down at 8:00 p.m.on all other nights. It should be noted that Ms. Homeniuk’s request does not comply with past Council direction. As directed in the by-law the Regional Health Unit and the City’s Traffic Division have been advised of this request. FINANCIAL IMPLICATIONS: None COMMUNICATIONS: Ms. Homeniuk has been supplied with the mailing labels to enable her to contact the area residents.
