Hiscott OFFICIALS PRESENT: Ms. J. von Westerholt, Senior Planner, Mr. J. Lewis, Traffic Technologist, Ms. D. Gilchrist, Secretary-Treasurer and Ms. D. Saunderson, Administrative Clerk Mr. A Head, Vice Chair, called this meeting to order at 10:21 a.m. This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was called to consider applications regarding variances to the City of Kitchener Sign By-law. The Committee will not make a decision on these applications but rather will make a recommendation which will be forwarded to the Committee of the Whole and Council for final decision. The Chair explained that the Committee's decisions with respect to sign variances are recommendations to City Council and not a final decision. He advised that the Committee's recommendations will be forwarded to City Council on Monday February 22, 2010 at 7:00 p.m., and the applicants may register with the City Clerk to appear at the meeting if desired. NEW BUSINESS 1. Submission No.: SG 2010-003 Applicant: Max Becker Enterprises Ltd. Property Location: 1188 Fischer Hallman Road Legal Description: Block 1, Registered Plan 58M-234 Appearances: In Support: N. Dart Contra: None Written Submissions: None The Committee was advised that the applicant is requesting permission to erect 2 fascia signs, one on the southeast end and one on the northwest end of the canopy over the drive-thru, having a height above grade of 3.04m (10') rather than the required 4.3m (14.1') and permission to erect 2 ground supported signs to have a separation of 32.19m (105.61') rather than the required 50m (164.04'). The Committee considered the report of the Development and Technical Services Department, dated February 3, 2010, advising that the subject property located at 1188 Fischer Hallman Road is zoned Neighbourhood Shopping Centre (C-2) in the Zoning By-law and has an Official Plan designation of a Mixed Use Node. The applicant is requesting relief from the following Sections of the Sign By-law: 1. Section 680.10.4(c) of the City's Sign By-law states that the minimum sign clearance shall be 4.3 metres (14 feet) when within 0.6 metres (1.96 feet) of an area intended for vehicular traffic. The applicant is requesting relief from this Section of the By-law to allow for an existing sign to have a 3.04 metres clearance rather than the required 4.3 metres; The intent of this Section of the By-law is to ensure there is sufficient vertical distance from the finished grade directly beneath the sign to the bottom of the lowest attached component of the sign to allow for safe passage of vehicular traffic through the drive-thru. Staff are of the opinion that the requested variance is minor and that a sufficient distance will still be maintained if the variance is approved. Section 680.11.13(a) of the City's Sign By-law states that ground supported signs are prohibited within 50 metres (164 feet) of another ground supported sign on the same property. The applicant is requesting relief from this Section of the By-law to allow a separation distance between the ground supported signs of 32.19 metres rather than the required 50 metres. The intent of this Section of the By-law is to ensure that both signs are appropriately spaced and will not cause interference of each other if located on the same property. The applicant is proposing to locate one sign at the entrance of the drive-thru indicating vehicles to `enter' and the other sign is to be located at the end of the drive-thru, indicating vehicles to `exit'. Staff are of the opinion that the requested variance is minor and the signs will assist in the continuous movement of vehicular traffic through the drive-thru and site overall. The Committee considered the report of the Region of Waterloo Transportation Planner, dated February 4, 2010, advising that they have no objections to this application. Mr. N. Dart, Pride Signs, explained the application noting that the canopy over the drive-thru lane meets building code requirements; however, the sign by-law hasn't taken this type of canopy sign into consideration. Moved by Mr. B. McColl Seconded by Mr. M. Hiscott That the application of Max Becker Enterprises Ltd. requesting permission to erect 2 fascia signs, one on the southeast end and one on the northwest end of the canopy over the drive- thru, having a height above grade of 3.04m (10') rather than the required 4.3m (14.1') and permission to erect 2 ground supported signs to have a separation of 32.19m (105.61') rather than the required 50m (164.04'), on Block 1, Registered Plan 58M-234, 1188 Fischer Hallman Road, Kitchener, Ontario, BE APPROVED, subject to the following condition: That the owner shall apply for and receive approval of a sign permit from the City of Kitchener. It is the opinion of this Committee that: The variance approved in this application is minor in nature. 2. This application is desirable for the appropriate development of the property. 3. The general intent and purpose of the Chapter 680 (SIGN) of the City of Kitchener Municipal Code is being maintained on the subject property. Carried Submission No.: SG 2010-004 Applicant: Canadian Pacific Railway Company Property Location: Manitou Drive (CPR land between Fairway & Webster) Legal Description: Lot 15, Registered Compiled Plan 1525 Appearances: In Support: None Contra: None Written Submissions: None The Committee generally agreed to defer consideration of this application as recommended by staff.
