HomeMy WebLinkAboutAdjustment - 2003-04-08 SG COMMITTEE OF ADJUSTMENT FOR THE CITY OF KITCHENER MINUTES OF THE REGULAR MEETING HELD APRIL 8, 2005 MEMBERS PRESENT: Messrs. S. Kay, P. Britton and B. Issac. OFFICIALS PRESENT: Mr. B. Sloan, Principal Planner and Ms. J. Billett, Secretary-Treasurer. Mr. S. Kay, Chair, called this meeting to order at 9:30 a.m. This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was called to consider applications regarding variances to Chapter 680 (Signs) of the City of Kitchener Municipal Code. The Committee will not make a decision on these applications but rather will make a recommendation which will be forwarded to the Committee of the Whole and Council for final decision. The Chair explained that the Committee's decisions with respect to sign variances are recommendations to City Council and not a final decision. He advised that the Committee's recommendations will be forwarded to City Council on Monday, April 14, 2003, at 7:00 p.m., and the applicants may register with the City Clerk to appear at the meeting if desired. UNFINISHED BUSINESS Submission No.: Applicant: Property Location: Legal Description: SG 2003-001 Candevco Property Seven Limited 370 Highland Road West Lot 88 & Part Lots 86, 89, 90, 91, 92 & 96, Registered Plan 786, being Parts 1-6, Reference Plan 58R-5132, together with a right-of- way over Part 7, Reference Plan 58R-5132 At the request of the applicant's agent the Committee agreed to defer and refer consideration of this application to its meeting to be held on Tuesday, May 20, 2003. Benninger Holdings Inc. 4166 King Street East Part Lot 9, Beasley's Broken Front Concession, being Parts 1, 4 & 7 on Reference Plan 58R-6134 Appearances: In Support: Mr. Russell Lane Contra: None Public Submissions: In Support: None Contra: None The Committee was advised that the applicant requests permission to replace an existing billboard sign, previously approved by the Committee of Adjustment, with a new billboard sign to be located 62 m (203 ft.) from a residential zone rather than the required 150 m (492 ft.). COMMITTEE OF ADJUSTMENT 4 APRIL 8, 2003 Submission No.: SG 2003-004 (Cont'd) The Committee considered the comments of the Planning Division, dated March 31, 2003, advising that the variance is not required as it was approved through Submission No. S 8/94, on the understanding that the replacement sign will be erected in exactly the same location as the existing sign. It is also recommended that the application fee be refunded. The Committee considered the comments of the following public agencies advising that they have no concerns with the application: City of Kitchener Transportation Planning, dated April 2, 2003; City of Kitchener Building Division, dated March 31,2003; Region of Waterloo Transportation Planner, dated April 2, 2003; and Grand River Conservation Authority, dated March 27, 2003. The Committee considered correspondence from Mr. Raymond Kellestine, Corridor Management Officer, Ministry of Transportation, dated March 27, 2003, advising that a Ministry of Transportation Sign Permit will not be required for the proposed sign, provided the sign has no exposure to Highway 8, and is not located within 400 m of the highway. Based on the advice received from the Planning Division, this application was dismissed. Moved by Mr. P. Britton Seconded by Mr. B. Issac That the application fee for Submission No. SG 2003-004 (F.J.
