Korah, P.Eng, Manager of Development Engineering (519 741 2974) WARD(S) INVOLVED: Ward # 4 DATE OF REPORT: February 24, 2010 REPORT NO.: DTS-10-056 SUBJECT: CLASS ENVIRONMENTAL ASSESSMENT STUDY FOR THE STRASBURG CREEK FLOOD CONTROL STRUCTURE -PROJECT STATUS UPDATE AND AMENDMENT TO THE PURCHASE ORDER FOR CONSULTING SERVICES RECOMMENDATION: THAT Council approve the extension of the Purchase Order for consulting services to Stantec Consulting Limited for the additional amount of $330,000 plus applicable taxes to complete the Class Environmental Assessment Study, Detailed Design and Inspection for the Strasburg Creek Flood Control Structure. BACKGROUND: The Strasburg Creek watershed is located in the southwest part of the City of Kitchener (City). The main/middle branch of Strasburg Creek originates northwest of the intersection of Fischer- Hallman Road and Bleams Road and flows generally southeast through swell-defined, well- vegetated valley crossing Huron Road approximately 1 km west of Strasburg Road. The drainage area contributing to the Main Branch of the Creek is approximately 3.6 km2 and 6.4 kmz at the Fischer-Hallman and Huron Road crossings, respectively. The Strasburg Creek Master Watershed Plan (SCMWP) was completed by Paragon Engineering Ltd. (now Stantec Consulting Ltd.) and Ecologistics Ltd. in 1991. As part of the study, a hydrologic modelling for the watershed was completed based on assumed development patterns and recommended a series of major on-line flood control structures to minimize the potential for downstream flooding and erosion impacts. The Grand River Conservation Authority (GRCA) and the City of Kitchener approved the SCMWP shortly after its completion. One of the primary results of the SCMWP was the recommended construction of a Flood Control Structure, at a location just upstream of the main branch's crossing of Huron Road. This structure is to replace the existing berm l spillway structure that has historically created the former Battler's Pond. The function of the proposed structure is to control outflows during infrequent storm events to minimize the potential for negative downstream flooding impacts due to the development of the upstream catchments. 5-1 As a result of the SCMWP, the City had identified the necessity of preparing a Schedule "B" Environmental Assessment (EA) for this project to examine alternatives for the proposed means of providing sufficient controls upstream of Huron Road to minimize the potential for flooding within this area. Stantec Consulting Ltd. was retained to complete the work in 2003 (Council resolution, DTS-03- 038) and work continued until late 2003, when it was decided to wait for the updated watershed modelling to be completed as part of the Alder/Upper Strasburg Watershed Study before finalizing the Strasburg Creek flood control structure EA. Subsequently in 2008, the City authorized additional work to continue the project (Council resolution, DTS-08-066). REPORT: The City had re-initiated the Strasburg Creek Flood Control Structure EA study in 2008, see attached map, study area. As part of the project, a project team and a stakeholders group was set up to inform the study findings. The project team consisted of GRCA, city staff, Region and the consultant, while the stakeholders group consisted of all the affected landowners within the study area. The project team had completed the following tasks as of part of this ongoing Class EA: • The analysis of existing conditions by undertaking field works and site walk. • Prepare and coordinate distribution of Class EA notifications Update computer models to incorporate the final Upper Strasburg Sub watershed Study and Fischer-Hallman Road Culvert EA results • Identify Project alternatives, Evaluation criteria and environmental impacts • Public Information Centre #1 (October 28, 2008) Coordinate design alternatives with the Huron Road Class EA project team • Present the study findings to City of Kitchener Environmental Committee (April 16, 2009) Meet with Ministry of Natural Resources staff to discuss the study findings to understand their concerns and permit requirements. The project team had considerable number of meetings with the stakeholders group, agencies and upstream landowners. Initially 10 meetings were included in the scope of work and due to the nature of the challenges, project team had 38 meetings so far with all the parties. The major challenge on this project is to determine the Regional flow release rate from the lands west of Fischer Hallman Road and at the same time satisfying the Alder Strasburg Watershed Study targets and recommendations. The Region also has to review and agree the concept of the recharge requirements and release rates for these lands to make sure that the Regional wells are not adversely impacted due to the developments. The City is still working with the landowners, GRCA and Region to complete the appropriate analysis and release rate. Staff anticipates that several additional consultations may be required to complete this project. The Huron Road Class EA is also progressing incorporate flood control measures into the Consulting Services will complete the detailed services for the flood control structure. concurrently with this study with the potential to final design and construction. The Stantec design, contract administration and Inspection The reason for changes in the scope of work and associated costs are listed below: 1. Additional meetings -The project team has been required to attend additional meetings to review and consider information provided by the various stakeholders. The meetings to-date have seen progress towards a consensus for an upstream drainage strategy required to finalize the EA. Some additional meetings are required with the 5-2 stakeholders, and further coordination for agency approvals and with the Huron Road design team. 2. Visual Simulation - A visual simulation will be prepared to illustrate the proposed flood control conditions. This is a useful tool for City staff and the community to assist in general understanding of the proposed design. 3. Ministry of Natural Resources (MNR) - The MNR has now confirmed their requirements for review of the proposed flood control structure. This criteria include the submission of a work permit application to confirm approval of the potential location, and subsequently a detailed dambreak assessment of the proposed structure as part of the detailed design process. 4. Detailed Design -The original scope of work only contemplated the completion of the EA and a conceptual design. The project now requires detailed design, final analysis and submission of technical information to the appropriate review agencies in order to secure the requisite approvals. 5. During and Post Construction Services -Assistance during the tendering and construction of the flood control structure, including occasional inspection and certification of the final product. FINANCIAL IMPLICATIONS: The total additional funding of $330,000 is required to complete this project. Funding is available, Middle/South Strasburg Creek Water Course, work order # 223 (previously, Index Code 855221), which is solely funded from the Development Charges Reserve fund. CONCLUSION: The Strasburg Creek Watershed Study Update and Upper Strasburg Creek Class EA have been completed. At this time, the City would like to complete the Strasburg Flood Control EA. Due to the scope changes to this project, staff recommend that the Stantec Consulting Ltd. Purchase Order be increased to complete the Class Environmental Assessment study and subsequent design and post construction services work for the Strasburg Creek Flood Control Structure.
